7 An Act relating to counties; amending 19 O.S. 2021,
7 Section 270, which relates to confidentiality of
8 Department of Defense Form 214 (DD Form 214);
8 authorizing the inclusion of grandchildren to view DD
9 Form 214; and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 19 O.S. 2021, Section 270, is
13
14 amended to read as follows:
14
15 Section 270. A. The county clerk shall keep any Department of
15
16 Defense Form 214 (DD Form 214) filed with the clerk, including any
16
17 DD Form 214 that was filed before the effective date of this act,
17
18 separate from records available for public inspection and shall not
18
19 make the DD Form 214 available to any person except as provided in
19
20 this section. A record of the names of veterans who have filed DD
20
21 Forms 214 with the clerk shall be made available for public
21
22 inspection.

23 B. The county clerk may authorize the viewing or copying of a
23
24 veteran's DD Form 214 only by the veteran, the veteran's spouse or,

1 child, or grandchild, a guardian for or a person having power of
1
2 attorney for the veteran, spouse, or child, or grandchild upon
2
3 presentation of a court order showing the appointment, the executor
3
4 or administrator of the estate of the veteran or spouse upon
4
5 presentation of a court order showing the appointment, a
5
6 representative of the United States Department of Veterans Affairs,
6
7 a funeral director upon presentation of a contract signed by the
7
8 person responsible for the funeral costs for the veteran, or a
8
9 person authorized by the court to view or copy the DD Form 214 upon
9
10 presentation of the court order. The clerk shall record the names
10
11 and addresses of all persons viewing or copying a DD Form 214.
11
12 C. A county clerk shall not be liable or responsible for any
12
13 harm or damages that may occur as a result of any person obtaining,
13
14 copying or viewing a DD Form 214.

15 SECTION 2. This act shall become effective November 1, 2026.
