7 An Act relating to the Supplemental Nutrition
7 Assistance Program; amending 56 O.S. 2021, Section
8 241.3, which relates to the limitation of benefits;
8 requiring certain elements of the program to be no
9 less restrictive than federal law; prohibiting
9 certain adoption or implementation; providing for
10 certain enforcement; requiring certain
10 qualifications; prohibiting certain waiver;
11 prohibiting certain exemptions; requiring recording
11 of exemptions; providing for eligibility limits;
12 establishing limits on recertification; providing for
12 eligibility determination methods; prohibiting
13 certain rule, guidance, or policy; providing for
13 codification; and declaring an emergency.

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

17 SECTION 1. AMENDATORY 56 O.S. 2021, Section 241.3, is
17
18 amended to read as follows:
18
19 Section 241.3. A. Except as otherwise provided by law or
19
20 waiver, all able-bodied recipients eighteen (18) years of age to
20
21 fifty (50) years of age, who are not disabled or raising minor
21
22 children, may receive food stamps for only three (3) months in each
22
23 thirty-six-month period except in months in which such recipients
23
24 are employed for at least twenty (20) or more hours per week. The

1 Department of Human Services shall enforce the provisions of this
1
2 section and any approved waivers or other provisions pursuant to law
2
3 in effect for this state as of the effective date of this act in
3
4 designated areas and populations.

5 B. 1. A family applying for food stamps after the fifteenth
5
6 (15th) day of each month shall be eligible to receive the total
6
7 amount of their initial allotment and their regular first allotment.
7
8 2. A household allotment of food stamps may be reduced by up to
8
9 twenty-five percent (25%) if a family is sanctioned in another
9
10 program established pursuant to the Statewide Temporary Assistance
10
11 Responsibility System.
11
12 3. An individual in a treatment center shall designate the
12
13 treatment center as the recipient of such individual's food stamp
13
14 allotment.
14
15 4. Operating procedures for the food stamp programs in local
15
16 offices may vary to reflect local differences.
16
17 5. The Department is authorized to use the amount of a
17
18 household food stamp allotment to subsidize a job under a work
18
19 supplementation or support program.
19
20 C. Beginning October 1, 2013, the Department of Human Services
20
21 shall not request a waiver to provide Supplemental Nutrition
21
22 Assistance Program services to able-bodied adults without
22
23 dependents.

1 D. Upon effective date of this act, the Oklahoma Department of
1
2 Human Services shall administer the Supplemental Nutrition
2
3 Assistance Program pursuant to the Food and Nutrition Act of 2008,
3
4 as amended, and regulations promulgated thereunder. The Department
4
5 shall administer the program using eligibility standards, benefit
5
6 determinations, work requirements, time limits, exemptions, and
6
7 verification procedures that are no less restrictive than those
7
8 required by federal law. The Department shall not adopt or
8
9 implement any option, waiver, or discretionary policy that expands
9
10 eligibility or delays enforcement of federal requirements unless
10
11 such option is expressly required by federal statute or regulation.

12 SECTION 2. NEW LAW A new section of law to be codified
12
13 in the Oklahoma Statutes as Section 241.3A of Title 56, unless there
13
14 is created a duplication in numbering, reads as follows:
14
15 A. The Oklahoma Department of Human Services shall enforce the
15
16 work requirements and time limits applicable to able-bodied adults
16
17 without dependents as provided in 7 U.S.C. � 2015(o).
17
18 B. An able-bodied adult without dependents shall not receive
18
19 Supplemental Nutrition Assistance Program (SNAP) benefits beyond the
19
20 applicable federal time limit unless the individual:
20
21 1. Meets the work, workfare, education, or training
21
22 requirements specified in federal law; or
22
23 2. Qualifies for an exemption explicitly authorized under
23
24 federal statute or regulation.

1 C. The Department shall not request or implement a statewide or

2 broad geographic waiver of Able-Bodied Adults Without Dependents
2
3 (ABAWD) work requirements unless federal law requires approval of
3
4 such a waiver based on objective economic criteria.

5 SECTION 3. NEW LAW A new section of law to be codified
5
6 in the Oklahoma Statutes as Section 241.3B of Title 56, unless there
6
7 is created a duplication in numbering, reads as follows:
7
8 A. Discretionary exemptions from Able-Bodied Adults Without
8
9 Dependents (ABAWD) work requirements shall be applied only on an
9
10 individualized, case-by-case basis.
10
11 B. The Oklahoma Department of Human Services shall not:
11
12 1. Reserve or carry forward unused exemptions;
12
13 2. Automatically assign exemptions based on geography,
13
14 category, or administrative convenience; or
14
15 3. Apply exemptions absent documented individual circumstances.
15
16 C. Each exemption shall be recorded in the case file and made
16
17 available for audit or legislative review.

18 SECTION 4. NEW LAW A new section of law to be codified
18
19 in the Oklahoma Statutes as Section 241.3C of Title 56, unless there
19
20 is created a duplication in numbering, reads as follows:
20
21 A. The Oklahoma Department of Human Services shall determine
21
22 Supplemental Nutrition Assistance Program (SNAP) eligibility using
22
23 the gross income, net income, and asset limits established under 7
23
24 U.S.C. �� 2014 and 2015.

1 B. The Department shall not confer SNAP eligibility based on
1
2 receipt of nominal, non-cash, or token assistance benefits.
2
3 C. Categorical eligibility shall not be used to waive income or
3
4 asset tests except where such waiver is expressly mandated by
4
5 federal law.

6 SECTION 5. NEW LAW A new section of law to be codified
6
7 in the Oklahoma Statutes as Section 241.3D of Title 56, unless there
7
8 is created a duplication in numbering, reads as follows:
8
9 A. The Oklahoma Department of Human Services shall require
9
10 Supplemental Nutrition Assistance Program (SNAP) eligibility
10
11 recertification at the shortest interval permitted under federal
11
12 law.
12
13 B. The Department shall prioritize frequent recertification and
13
14 interim reporting for:
14
15 1. Households containing one or more able-bodied adults without
15
16 dependents;
16
17 2. Households reporting zero income; and
17
18 3. Households with income that is irregular, unverifiable, or
18
19 inconsistent.
19
20 C. Verification procedures authorized under federal law shall
20
21 be utilized to ensure continued eligibility and accuracy of reported
21
22 information.

1 SECTION 6. NEW LAW A new section of law to be codified

2 in the Oklahoma Statutes as Section 241.3E of Title 56, unless there
2
3 is created a duplication in numbering, reads as follows:
3
4 A. For purposes of Supplemental Nutrition Assistance Program
4
5 (SNAP) eligibility determination, the Oklahoma Department of Human
5
6 Services shall include the income and assets of all household
6
7 members as required by 7 U.S.C. � 2014, regardless of whether a
7
8 household member is eligible to receive benefits.
8
9 B. No household shall be determined eligible for SNAP benefits
9
10 if the total household income or assets exceed federal eligibility
10
11 limits.
11
12 C. The Department shall not exclude income or assets in a
12
13 manner that is not expressly authorized under federal law.

14 SECTION 7. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 241.3F of Title 56, unless there
15
16 is created a duplication in numbering, reads as follows:
16
17 The Department shall not promulgate any rule, guidance, or
17
18 policy, nor request any waiver, that has the effect of expanding
18
19 eligibility, delaying work requirements, increasing benefit
19
20 duration, or relaxing verification standards beyond what is
20
21 expressly required by federal law.

22 SECTION 8. It being immediately necessary for the preservation
22
23 of the public peace, health or safety, an emergency is hereby
23

1 declared to exist, by reason whereof this act shall take effect and
1
2 be in full force from and after its passage and approval.
