7   An Act relating to public health; defining term;

7   prohibiting administration of gene-based vaccines

8   until certain date; providing penalties; providing

8   for codification; and declaring an emergency.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12  SECTION 1.      NEW LAW  A new section of law to be codified

12

13 in the Oklahoma Statutes as Section 1-1432 of Title 63, unless there
13

14 is created a duplication in numbering, reads as follows:
14

15  A. As used in this section, "gene-based vaccine for infectious

15

16 diseases" means a vaccine for infectious diseases developed using
16

17 messenger ribonucleic acid (mRNA) technology, modified mRNA
17

18 technology, self-amplifying mRNA technology, or deoxyribonucleic
18

19 acid (DNA) technology. The term does not include gene therapy
19

20 products used to treat cancer or genetic disorders.

21  B. Until June 1, 2030, a health care provider shall not provide

21

22 or administer a gene-based vaccine for infectious diseases to any
22

23 person in this state.

1      C. A health care provider found in violation of this section

1

2 shall:
2

3      1. Upon conviction, be guilty of a misdemeanor punishable by a

3

4 fine not to exceed Five Hundred Dollars ($500.00) for each incident;
4

5 and
5

6      2. Be subject to disciplinary action by the appropriate

6

7 licensing board.

8      SECTION 2. It being immediately necessary for the preservation

8

9 of the public peace, health or safety, an emergency is hereby
9

10 declared to exist, by reason whereof this act shall take effect and
10

11 be in full force from and after its passage and approval.
