7 by Section 5, Chapter 11, O.S.L. 2024 (47 O.S. Supp.
8 2025, Sections 6-103 and 6-106), which relate to the
8 issuance of driver licenses; requiring the provision
9 of certain proof of lawful presence; creating certain
9 designation for certain licenses; requiring Service
10 Oklahoma to submit certain report; allowing for the
10 promulgation of rules by Service Oklahoma; amending
11 47 O.S. 2021, Sections 6-114, as last amended by
11 Section 4, Chapter 171, O.S.L. 2025, and 6-115, as
12 last amended by Section 6, Chapter 330, O.S.L. 2025
12 (47 O.S. Supp. 2025, Sections 6-114 and 6-115), which
13 relate to the issuance of driver licenses;
13 disallowing certain renewal option for certain
14 licenses; updating statutory references; updating

17 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
17
18 SECTION 1. AMENDATORY 47 O.S. 2021, Section 6-103, as
18
19 amended by Section 40, Chapter 282, O.S.L. 2022 (47 O.S. Supp. 2025,
19
20 Section 6-103), is amended to read as follows:
20
21 Section 6-103. A. Except as otherwise provided by law, Service
21
22 Oklahoma shall not issue a driver license to:
22
23 1. Any person who is under eighteen (18) years of age, except
23
24 that Service Oklahoma may issue a Class D license to any person who
24

1 attains sixteen (16) years of age on or after August 15, 2000, and
1
2 meets the requirements of Sections Section 6-105 and 6-107.3 of this
2
3 title;
3
4 2. Any unemancipated person who is under eighteen (18) years of
4
5 age and whose custodial legal parent or legal guardian does not
5
6 approve the issuance of a license as required by Section 6-110.2 of
6
7 this title or objects to the issuance of a license or permit by
7
8 filing an objection pursuant to Section 6-103.1 of this title;
8
9 3. Any person whose driving privilege has been suspended,
9
10 revoked, canceled, or denied in this state or any other state or
10
11 country until the driving privilege has been reinstated by the state
11
12 or country withdrawing the privilege;
12
13 4. Any person who is classified as an excessive user of
13
14 alcohol, any other intoxicating substance, or a combination of
14
15 alcohol and any other intoxicating substance, and inimical to public
15
16 safety, in accordance with rules promulgated by the Department
16
17 Service Oklahoma, until all requirements granting or reinstating
17
18 driving privileges are met, including, but not limited to,
18
19 abstinence from the use of alcohol, any other intoxicating
19
20 substance, or any combination of alcohol and any other intoxicating
20
21 substance for a minimum of either twelve (12) months or eighteen
21
22 (18) months, as determined by OAC 595:10-5 670:15-11-11, immediately
22
23 preceding application for or application for reinstatement of
23
24 driving privileges;

1 5. Any person who is required by Section 6-101 et seq. of this
1
2 title to take an examination, unless the person shall have
2
3 successfully passed the examination;
3
4 6. Any person who is required under the laws of this state to
4
5 deposit proof of financial responsibility and who has not deposited
5
6 such proof;
6
7 7. Any person who is physically deformed or who is afflicted
7
8 with any mental disease or physical condition that would impair the
8
9 driving ability of the person or when the Commissioner of Public
9
10 Safety, from information concerning the person or from the records
10
11 and reports on file in the Department of Public Safety, determines
11
12 that the operation of a motor vehicle by such person on the highways
12
13 would be inimical to public safety or welfare;
13
14 8. Any person who is a nonresident, as defined in Section 1-137
14
15 of this title;
15
16 9. Any alien noncitizen, unless such person presents valid
16
17 documentation of identity and authorization for presence in the
17
18 United States issued pursuant to the laws of the United States;
18
19 provided, no license shall be issued to any alien noncitizen whose
19
20 documentation indicates the alien noncitizen is a visitor or is not
20
21 eligible to establish residency; or
21
22 10. Any person who possesses a valid license to operate a motor
22
23 vehicle issued by another state until the other state license has
23
24 been surrendered.

1 B. Any applicant who is denied a license under the provisions
1
2 of subsection A of this section shall have the right to an appeal as
2
3 provided in Section 6-211 of this title.
3
4 SECTION 2. AMENDATORY 47 O.S. 2021, Section 6-106, as
4
5 last amended by Section 5, Chapter 11, O.S.L. 2024 (47 O.S. Supp.
5
6 2025, Section 6-106), is amended to read as follows:
6
7 Section 6-106. A. 1. Every application for a driver license
7
8 or identification card shall be made by the applicant upon a form
8
9 furnished by Service Oklahoma.
9
10 2. Every original, renewal, or replacement application for a
10
11 driver license or identification card made by a male applicant who
11
12 is at least sixteen (16) but less than twenty-six (26) years of age
12
13 shall include a statement that by submitting the application, the
13
14 applicant is consenting to registration with the Selective Service
14
15 System. The pertinent information from the application shall be
15
16 forwarded by Service Oklahoma to the Data Management Center of the
16
17 Selective Service System in order to register the applicant as
17
18 required by law with the Selective Service System. Any applicant
18
19 refusing to sign the consent statement shall be denied a driver
19
20 license or identification card.
20
21 3. Except as provided for in subsections G and, H, and I of
21
22 this section, every applicant for a driver license or identification
22
23 card shall provide to Service Oklahoma at the time of application a
23
24 document showing proof of identity. Service Oklahoma shall

1 promulgate rules prescribing forms of identification acceptable for
1
2 an original Oklahoma driver license.
2
3 B. Every applicant for a driver license shall provide the
3
4 following information:
4
5 1. Full name;
5
6 2. Date of birth;
6
7 3. Sex;
7
8 4. Address of principal residence and county of such residence,
8
9 which shall be referenced on the REAL ID Compliant Driver License or
9
10 Identification Card;, and proof of such principal residency, as
10
11 prescribed by rules promulgated by Service Oklahoma, documenting
11
12 provided address;
12
13 5. Current and complete mailing address to be maintained by
13
14 Service Oklahoma for the purpose of giving notice, if necessary, as
14
15 required by Section 2-116 of this title;
15
16 6. Medical information, as determined by the Department of
16
17 Public Safety, which shall assure Service Oklahoma that the person
17
18 is not prohibited from being licensed as provided by paragraph 7 of
18
19 subsection A of Section 6-103 of this title;
19
20 7. Whether the applicant is deaf or hard-of-hearing;
20
21 8. A brief description of the applicant, as determined by the
21
22 Department;
22
23 9. Whether the applicant has previously been licensed, and, if
23
24 so, when and by what state or country, and whether any license has
24

1 ever been suspended or revoked, or whether an application has ever
1
2 been refused, and, if so, the date of and reason for the suspension,
2
3 revocation, or refusal;
3
4 10. Whether the applicant is an alien a noncitizen eligible to
4
5 be considered for licensure and is not prohibited from licensure
5
6 pursuant to paragraph 9 of subsection A of Section 6-103 of this
6
7 title;
7
8 11. Whether the applicant has:
8
9 a. previously been licensed and, if so, when and by what
9
10 state or country, and
10
11 b. held more than one license at the same time during the
11
12 immediately preceding ten (10) years; and
12
13 12. Social Security number.
13
14 No person shall request Service Oklahoma to use the Social Security
14
15 number of that person as the driver license number. Upon renewal or
15
16 replacement of any driver license issued after the effective date of
16
17 this act July 1, 2001, the licensee shall advise Service Oklahoma or
17
18 the licensed operator if the present driver license number of the
18
19 licensee is the Social Security number of the licensee. If the
19
20 driver license number is the Social Security number, Service
20
21 Oklahoma or the licensed operator shall change the driver license
21
22 number to a computer-generated alphanumeric identification.
22
23 C. 1. In addition to the requirements of subsections A and B
23
24 of this section, every applicant for a commercial driver license who

1 is subject to the requirements of 49 C.F.R., Part 391, and is
1
2 applying for an original, renewal, or replacement license, and every
2
3 person who, upon or after May 8, 2012, is currently the holder of a
3
4 commercial driver license and is subject to the requirements of 49
4
5 C.F.R., Part 391, and who does not apply for a renewal or
5
6 replacement license prior to January 30, 2014, shall submit to
6
7 Service Oklahoma and maintain with Service Oklahoma a current
7
8 approved medical examination certificate signed by a licensed
8
9 physician authorized to perform and approve medical examination
9
10 certifications. Service Oklahoma shall adopt rules for maintaining
10
11 medical examination certificates pursuant to the requirements in 49
11
12 C.F.R., Parts 383 and 384. Any commercial driver licensee subject
12
13 to the requirements of this paragraph who fails to maintain on file
13
14 with Service Oklahoma a current, approved medical examination
14
15 certificate shall have the driving privileges of the person
15
16 downgraded to a Class D driver license by Service Oklahoma.
16
17 2. If the applicant is applying for an original commercial
17
18 driver license in Oklahoma or is transferring a commercial driver
18
19 license from another state to Oklahoma, Service Oklahoma shall
19
20 review the driving record of the applicant in other states for the
20
21 immediately preceding ten (10) years, unless the record review has
21
22 already been performed by Service Oklahoma. As a result of the
22
23 review, if it is determined by Service Oklahoma that the applicant
23
24 is subject to a period of disqualification as prescribed by Section

1 6-205.2 of this title which has not yet been imposed, Service
1
2 Oklahoma shall impose the period of disqualification and the
2
3 applicant shall serve the period of disqualification before a
3
4 commercial driver license is issued to the applicant; provided,
4
5 nothing in this paragraph shall be construed to prevent the issuance
5
6 of a Class D driver license to the applicant.
6
7 3. If the applicant has or is applying for a hazardous material
7
8 endorsement, the applicant shall submit to a security threat
8
9 assessment performed by the Transportation Security Administration
9
10 of the Department of Homeland Security as required by and pursuant
10
11 to 49 C.F.R., Part 1572, which shall be used to determine whether
11
12 the applicant is eligible for the endorsement pursuant to federal
12
13 law and regulation.
13
14 4. Service Oklahoma shall notify each commercial driving school
14
15 of the passage of this section, and each commercial driving school
15
16 shall notify prospective students of its school of the hazardous
16
17 material endorsement requirement.
17
18 D. In addition to the requirements of subsections A and B of
18
19 this section, every applicant shall be given an option on the
19
20 application for issuance of a driver license or identification card
20
21 or renewal pursuant to Section 6-115 of this title to provide an
21
22 emergency contact person. The emergency contact information
22
23 requested may include full name, address, and phone number. The
23
24 emergency contact information shall be maintained by Service

1 Oklahoma and shall be used by Service Oklahoma and law enforcement
1
2 for emergency purposes only. A person listed as an emergency
2
3 contact may request to be removed at any time. Any update to a
3
4 change of name, address, or phone number may be made by the
4
5 applicant listing the emergency contact person or by the person
5
6 listed as the emergency contact.
6
7 E. Whenever application is received from a person previously
7
8 licensed in another jurisdiction, Service Oklahoma shall request a
8
9 copy of the driving record from the other jurisdiction and,
9
10 effective September 1, 2005, from all other jurisdictions in which
10
11 the person was licensed within the immediately previous ten (10)
11
12 years. When received, the driving record shall become a part of the
12
13 driving record of the person in this state with the same force and
13
14 effect as though entered on the driver's record in this state in the
14
15 original instance.
15
16 F. Whenever Service Oklahoma receives a request for a driving
16
17 record from another licensing jurisdiction, the record shall be
17
18 forwarded without charge.
18
19 G. A person shall not apply for or possess more than one state-
19
20 issued or territory-issued REAL ID Compliant Driver License or
20
21 Identification Card pursuant to the provisions of Section 6-101 of
21
22 this title. A valid and unexpired Oklahoma driver license shall
22
23 serve as both primary and secondary proofs of identity whenever
23
24 application for a REAL ID Noncompliant Identification Card is

1 submitted to Service Oklahoma. The provisions of subsection B of
1
2 Section 1550.42 of Title 21 of the Oklahoma Statutes shall not apply
2
3 when issuing an identification card pursuant to the provisions of
3
4 this subsection. Service Oklahoma shall promulgate rules necessary
4
5 to implement and administer the provisions of this subsection.
5
6 H. A valid and unexpired U.S. passport shall serve as both
6
7 primary and secondary proofs of identity whenever application for a
7
8 driver license or identification card is submitted to the
8
9 Department. Service Oklahoma shall promulgate rules necessary to
9
10 implement and administer the provisions of this subsection.
10
11 I. As provided in Section 6-103 of this title, any applicant
11
12 who is a noncitizen shall present a valid proof of lawful presence,
12
13 which may serve as a primary proof of identity, whenever application
13
14 or renewal for a driver license or identification card is submitted
14
15 to the Department. Service Oklahoma shall promulgate rules
15
16 necessary to implement and administer the provisions of this
16
17 subsection.
17
18 SECTION 3. NEW LAW A new section of law to be codified
18
19 in the Oklahoma Statutes as Section 6-111.1 of Title 47, unless
19
20 there is created a duplication in numbering, reads as follows:
20
21 A. 1. Any noncitizen applying for an original, renewal, or
21
22 replacement REAL ID Compliant Driver License or Identification Card
22
23 shall be issued a license or card bearing the words "Limited Term".

1 2. On or before July 1, 2027, and annually thereafter, Service
1
2 Oklahoma shall electronically report to the Governor, the President
2
3 Pro Tempore of the Senate, and the Speaker of the House of
3
4 Representatives the number of licenses or cards bearing the words
4
5 "Limited Term" that have been issued in this state.
5
6 B. 1. Any noncitizen applying for an original, renewal, or
6
7 replacement REAL ID Noncompliant Driver License or Identification
7
8 Card shall be issued a license or card bearing the words "Federal
8
9 Limits Apply".
9
10 2. On or before July 1, 2027, and annually thereafter, Service
10
11 Oklahoma shall electronically report to the Governor, the President
11
12 Pro Tempore of the Senate, and the Speaker of the House of
12
13 Representatives the number of licenses or cards bearing the words
13
14 "Federal Limits Apply" that have been issued in this state.
14
15 C. Service Oklahoma shall promulgate rules necessary to
15
16 implement and administer the provisions of this section.
16
17 SECTION 4. AMENDATORY 47 O.S. 2021, Section 6-114, as
17
18 last amended by Section 4, Chapter 171, O.S.L. 2025 (47 O.S. Supp.
18
19 2025, Section 6-114), is amended to read as follows:
19
20 Section 6-114. A. 1. In the event that a driver license is
20
21 lost, destroyed, or requires the updating of any information,
21
22 restriction, or endorsement displayed thereon, the person to whom
22
23 such license was issued may obtain a replacement thereof pursuant to
23
24 the provisions of subsection G of Section 6-101 of this title, and

1 upon payment of the required fee. If the person is an alien a
1
2 noncitizen, the person shall appear before Service Oklahoma or a
2
3 licensed operator and, after furnishing proof of identity as
3
4 required in this section, shall be issued a replacement driver
4
5 license for a period which that does not exceed the lesser of:
5
6 a. the expiration date of the license being replaced, or
6
7 b. the expiration date on the valid documentation
7
8 authorizing the presence of the person in the United
8
9 States, as required by paragraph 9 of subsection A of
9
10 Section 6-103 of this title.
10
11 2. The cost of a replacement license shall be Twenty-five
11
12 Dollars ($25.00), which shall be apportioned and credited by Service
12
13 Oklahoma as follows:
13
14 a. Two Dollars ($2.00) shall be apportioned as provided
14
15 in Section 1104 of this title,
15
16 b. Three Dollars ($3.00) shall be credited to the General
16
17 Revenue Fund of the State Treasury,
17
18 c. Five Dollars ($5.00) shall be credited to the
18
19 Department of Public Safety Computer Imaging System
19
20 Revolving Fund to be used solely for the purpose of
20
21 administering and maintaining the computer imaging
21
22 system of the Department through October 31, 2022.
22
23 Beginning November 1, 2022, Five Dollars ($5.00) shall
23
24 be credited to the Service Oklahoma Computer Imaging

1 System Revolving Fund to be used solely for the
1
2 purpose of administering and maintaining the computer
2
3 imaging system of Service Oklahoma,
3
4 d. Ten Dollars ($10.00) shall be credited to the
4
5 Revolving Fund of the Department of Public Safety
5
6 Revolving Fund through October 31, 2022. Beginning
6
7 November 1, 2022, the Ten Dollars ($10.00) shall be
7
8 credited to the Service Oklahoma Revolving Fund,
8
9 e. Three Dollars ($3.00) shall be credited to the State
9
10 Public Safety Fund created in Section 2-147 of this
10
11 title, and
11
12 f. (1) Two Dollars ($2.00) of the fee authorized by this
12
13 paragraph related to the replacement of a driver
13
14 license by a licensed operator that does not
14
15 process approved applications or renewals for
15
16 REAL ID Compliant Driver Licenses or
16
17 Identification Cards shall be credited, in
17
18 addition to the amount authorized by subparagraph
18
19 e of this paragraph, to the State Public Safety
19
20 Fund created in Section 2-147 of this title, or
20
21 (2) Two Dollars ($2.00) of the fee authorized by this
21
22 paragraph related to the replacement of a driver
22
23 license by a licensed operator that does process
23
24 approved applications or renewals for REAL ID

1 Compliant Driver Licenses or Identification Cards
1
2 shall be retained by the licensed operator
2
3 through June 30, 2023. Beginning July 1, 2023,
3
4 these monies shall be retained by the licensed
4
5 operator pursuant to subsection E of Section
5
6 1141.1 of this title.
6
7 3. Service Oklahoma shall promulgate rules prescribing forms of
7
8 primary and secondary identification acceptable for replacement of
8
9 an Oklahoma driver license; provided, however, a valid and unexpired
9
10 U.S. passport shall be acceptable as both primary and secondary
10
11 identification.
11
12 B. Any person desiring to add or remove an endorsement or
12
13 endorsements or a restriction or restrictions to any existing driver
13
14 license, when authorized by Service Oklahoma, shall obtain a
14
15 replacement license with the endorsement or endorsements or the
15
16 restriction or restrictions change thereon and shall be charged the
16
17 fee for a replacement license as provided in subsection A of this
17
18 section.

19 SECTION 5. AMENDATORY 47 O.S. 2021, Section 6-115, as
19
20 last amended by Section 6, Chapter 330, O.S.L. 2025 (47 O.S. Supp.
20
21 2025, Section 6-115), is amended to read as follows:
21
22 Section 6-115. A. Except as otherwise provided in this
22
23 section, every driver license shall be issued for a period of either
23
24 four (4) years or eight (8) years; provided, if the applicant or

1 licensee is an alien a noncitizen, the license shall be issued for a
1
2 period which that does not exceed the lesser of:
2
3 1. Four (4) years or eight (8) years; or
3
4 2. The expiration date on the valid documentation authorizing
4
5 the presence of the applicant or licensee in the United States, as
5
6 required by paragraph 9 of subsection A of Section 6-103 of this
6
7 title.
7
8 B. Except as otherwise provided in this section, the expiration
8
9 date of an initial license shall be no more than either four (4)
9
10 years or eight (8) years from the last day of the month of issuance
10
11 or no more than either four (4) years or eight (8) years from the
11
12 last day of the birth month of the applicant immediately preceding
12
13 the date of issuance, if requested by the applicant.
13
14 C. Except as otherwise provided in this section, the expiration
14
15 date of a renewal license shall be:
15
16 1. For a renewal during the month of expiration, either four
16
17 (4) years or eight (8) years from the last day of the month of
17
18 expiration of the expiring license or either four (4) years or eight
18
19 (8) years from the last day of the birth month of the licensee
19
20 immediately preceding the expiration date of the expiring license,
20
21 if requested by the licensee; or
21
22 2. For a renewal prior to the month of expiration, as provided
22
23 by rule of Service Oklahoma, either four (4) years or eight (8)
23
24 years from the last day of the month of expiration of the current
24

1 license; provided, no license shall be issued with an expiration
1
2 date of more than five (5) years from the date of renewal on a four
2
3 (4) year four-year license or nine (9) years from the date of
3
4 renewal on an eight (8) year eight-year license.
4
5 D. Notwithstanding the provisions of subsection E of Section
5
6 1550.42 of Title 21 of the Oklahoma Statutes, any Oklahoma driver
6
7 license that is not more than three (3) years past the date of
7
8 expiration provided on the driver license shall be presumed to be a
8
9 valid form of identification for the purposes of renewing an
9
10 Oklahoma driver license.
10
11 E. Except as otherwise provided in this section, every driver
11
12 license shall be renewable by the licensee upon application to
12
13 either Service Oklahoma or a licensed operator, by furnishing the
13
14 current mailing address of the person and payment of the required
14
15 fee, if the person is otherwise eligible for renewal. If the
15
16 licensee is an alien a noncitizen, the licensee shall appear before
16
17 a driver license examiner of Service Oklahoma and shall be issued a
17
18 renewal driver license for a period which that does not exceed the
18
19 lesser of:
19
20 1. Four (4) years or eight (8) years; or
20
21 2. The expiration date on the valid documentation authorizing
21
22 the presence of the applicant or licensee in the United States, as
22
23 required by paragraph 9 of subsection A of Section 6-103 of this
23
24 title.

1 F. All applicants for renewals of driver licenses who have
1
2 proven collision records or apparent physical defects may be
2
3 required to take an examination as specified by Service Oklahoma.
3
4 G. When a person makes application for a driver license, or
4
5 makes application to renew a driver license, and the person has been
5
6 convicted of, or received a deferred judgment for, any offense
6
7 required to register pursuant to the Sex Offenders Registration Act,
7
8 the driver license shall be valid for a period of one (1) year from
8
9 the month of issuance, but may be renewed yearly during the time the
9
10 person is registered on the Sex Offender Registry. Notwithstanding
10
11 any other provision of law, the cost for such license shall be the
11
12 same as for other driver licenses and renewals.
12
13 H. Service Oklahoma shall promulgate rules prescribing forms of
13
14 identification acceptable for the renewal of an Oklahoma driver
14
15 license.
15
16 SECTION 6. This act shall become effective November 1, 2026.
