6 An Act relating to school athletic associations;
6 amending 70 O.S. 2021, Section 27-103, which relates
7 to requirements for school athletic association
7 written policies; adding provision to be included in
8 written policy; repealing 70 O.S. 2021, Section 8-
8 103.2, which relates to participation in certain
9 competitions after certain transfer; providing an
9 effective date; and declaring an emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 70 O.S. 2021, Section 27-103, is
13
14 amended to read as follows:
14
15 Section 27-103. A public school or school district shall not be
15
16 a member of any school athletic association unless that association
16
17 has adopted a written policy that requires the following:
17
18 1. All records of the association to be made accessible
18
19 consistent with the provisions of the Oklahoma Open Records Act;
19
20 2. All meetings of the association to be open and conducted in
20
21 a manner consistent with the provisions of the Oklahoma Open Meeting
21
22 Act, including specifically the notice and agenda, voting, and
22
23 executive session requirements; and

1 3. An annual financial audit and a compliance audit of all

2 funds of the association in accordance with the auditing standards
2
3 set forth in the Oklahoma Public School Audit Law. In addition, the
3
4 association shall have performance audits conducted of the
4
5 operations of the association. A performance audit shall be
5
6 conducted no later than December 31, 2014, and by December 31 every
6
7 five (5) years thereafter; and

8 4. A student who enrolls in a public school or school district
8
9 in which the student is not a resident, as provided by the
9
10 provisions of the Education Open Transfer Act, is allowed to
10
11 participate in interscholastic activities or contests offered by the
11
12 receiving school district upon enrollment.

13 SECTION 2. REPEALER 70 O.S. 2021, Section 8-103.2, is
13
14 hereby repealed.
14
15 SECTION 3. This act shall become effective July 1, 2026.
15
16 SECTION 4. It being immediately necessary for the preservation
16
17 of the public peace, health, or safety, an emergency is hereby
17
18 declared to exist, by reason whereof this act shall take effect and
18
19 be in full force from and after its passage and approval.
