7 An Act relating to initiative and referendum;
7 amending 34 O.S. 2021, Section 25, which relates to
8 time for submission of measures; granting certain
8 discretionary power to Legislature; modifying
9 authority to call certain elections; specifying dates
9 for special election under certain circumstances; and
10 providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 34 O.S. 2021, Section 25, is

15 amended to read as follows:

16 Section 25. Whenever any measure shall be initiated by the
16
17 people in the manner provided by law, or whenever the referendum
17
18 shall be demanded against any measure passed by the Legislature,
18
19 same shall be submitted to the people for their approval or
19
20 rejection at the next regular election; provided, the Legislature or
20
21 the Governor shall have discretionary power, in his discretion, to
21
22 call a special election to vote upon such questions, or to designate
22
23 the mandatory primary election second Tuesday of November in an odd-
23
24 numbered year, or the first Tuesday after the first Monday of

1 November in an even-numbered year, as a special election for such

2 purpose. If the Legislature and the Governor set conflicting dates,
2
3 the special election shall be held on the second Tuesday of November
3
4 in an odd-numbered year, or the first Tuesday after the first Monday
4
5 of November in an even-numbered year.

6 SECTION 2. This act shall become effective November 1, 2025.
