7 An Act relating to aerospace, aircraft, and aviation
7 infrastructure; defining terms; prohibiting use of
8 certain information for fees for certain persons;
8 providing for codification; and providing an
9 effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 550 of Title 3, unless there is
14
15 created a duplication in numbering, reads as follows:

16 A. As used in this section:
16
17 1. "Aircraft" has the same meaning as that provided in Section
17
18 252 of Title 3 of the Oklahoma Statutes, except that the aircraft
18
19 shall have a gross weight of nine thousand (9,000) pounds or less
19
20 and operate under the provisions of 14 C.F.R., Part 91; and
20
21 2. "Automatic dependent surveillance-broadcast" means an
21
22 advanced aviation surveillance technology that combines ground
22
23 infrastructure, aircraft avionics, and an aircraft's positioning
23
24 source to create an accurate surveillance interface between an

1 aircraft and air traffic control. The term consists of two

2 different services:

3 a. ADS-B, which receives data provided by ADS-B Out, as
3
4 well as weather and traffic information from ground
4
5 stations, and
5
6 b. ADS-B Out, which broadcasts an aircraft's Global
6
7 Positioning System location, altitude, ground speed,
7
8 and other data.

9 B. No government entity or private individual or entity shall
9
10 use information broadcasted or collected by an automatic dependent
10
11 surveillance-broadcast system as a means for calculating,
11
12 generating, and collecting fees from owners or operators who operate
12
13 aircraft within this state.

14 SECTION 2. This act shall become effective November 1, 2026.
