7 An Act relating to vaccines; creating the Oklahoma
7 DNA/RNA-Based Vaccine Safety and Sovereignty Act;
8 providing short title; stating purpose and intent of
8 act; defining term; providing certain civil and
9 criminal penalties; authorizing certain enforcement
9 by Attorney General; authorizing certain private
10 cause of action; authorizing certain reward;
10 providing for noncodification; providing for
11 codification; and providing an effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. NEW LAW A new section of law not to be
15
16 codified in the Oklahoma Statutes reads as follows:
16
17 A. This act shall be known and may be cited as the "Oklahoma
17
18 DNA/RNA-Based Vaccine Safety and Sovereignty Act".
18
19 B. The purpose of this act is to protect the health, safety,
19
20 and autonomy of this state by prohibiting the use, sale, and
20
21 distribution of DNA/RNA-based vaccines in humans, animals, and
21
22 agricultural produce within the state, even during declared
22
23 emergencies.

1 C. Recognizing the significant risks associated with these
1
2 technologies, including adverse health effects, insufficient long-
2
3 term safety data, and potential environmental impacts, this
3
4 legislation ensures robust protections regardless of circumstances
4
5 that might otherwise permit regulatory shortcuts or diminished
5
6 oversight during public health emergencies.

7 D. By addressing these concerns and upholding the principles of
7
8 informed consent, transparency, and scientific integrity, this act
8
9 affirms this state's commitment to safeguarding its citizens,
9
10 animals, and agricultural systems from untested or potentially
10
11 hazardous pharmaceutical interventions.
11
12 SECTION 2. NEW LAW A new section of law to be codified
12
13 in the Oklahoma Statutes as Section 9000 of Title 63, unless there
13
14 is created a duplication in numbering, reads as follows:

15 A. For the purposes of this act, "DNA/RNA-based vaccines"
15
16 refers to all products that intend to function by utilizing,
16
17 modifying, or transferring genetic material to induce an immune
17
18 response. DNA/RNA-based vaccines include gene-based vaccines
18
19 developed using messenger ribonucleic acid (mRNA) technology,
19
20 modified messenger ribonucleic acid (modRNA) technology, self-
20
21 amplifying messenger ribonucleic acid (saRNA) technology, or
21
22 deoxyribonucleic acid (DNA) technology. DNA/RNA-based vaccines
22
23 include human gene therapy products that mediate their effects by
23
24 transcription or translation of transferred genetic material or by
24

1 specifically altering human genetic sequences. These products
1
2 include nucleic acids such as plasmids and in vitro transcribed
2
3 ribonucleic acid (RNA); genetically modified microorganisms such as
3
4 viruses, bacteria, and fungi; engineered site-specific nucleases
4
5 used for human genome editing; and ex vivo genetically modified
5
6 human cells.

7 B. No individual, entity, corporation, government agency, or
7
8 organization shall use DNA/RNA-based vaccines or products in this
8
9 state in any form including, but not limited to, by manufacturing,
9
10 distributing, administering, or facilitating the sale of DNA/RNA-
10
11 based vaccines or products in this state, whether for human or
11
12 animal use.

13 C. 1. Any individual or entity, corporation, government
13
14 agency, or organization that violates subsection B of this section
14
15 shall be subject to civil and criminal penalties.
15
16 2. A fine of no less than Fifty Thousand Dollars ($50,000.00)
16
17 per violation shall be imposed for each instance of unauthorized
17
18 production, sale, or administration of DNA/RNA-based vaccines within
18
19 the state, with each act of distribution or administration to a
19
20 separate individual, animal, or agricultural product constituting a
20
21 separate violation.

22 3. Additionally, any person or entity knowingly and willfully
22
23 violating subsection B of this section shall, upon conviction, be
23
24 guilty of a felony punishable by a fine not to exceed Two Hundred

1 Fifty Thousand Dollars ($250,000.00), by imprisonment in the custody
1
2 of the Department of Corrections for a term not to exceed ten (10)
2
3 years, or by both such fine and imprisonment.

4 D. The Attorney General may investigate and prosecute
4
5 violations of this act, bring civil actions to enjoin continued
5
6 offenses, and seek restitution for affected individuals, businesses,
6
7 or agricultural entities.
7
8 E. Any resident of this state who is subjected to the
8
9 administration of DNA/RNA-based vaccines in violation of this act
9
10 may bring a private cause of action against responsible parties to
10
11 seek compensatory and punitive damages, including court costs and
11
12 reasonable attorney fees.
12
13 F. Whistleblowers who report violations shall be protected from
13
14 retaliation and may be eligible for a reward of up to thirty percent
14
15 (30%) of collected fines if their information leads to a successful
15
16 enforcement action.

17 SECTION 3. This act shall become effective November 1, 2026.
