7 An Act relating to the state Medicaid program;
7 directing certain program delivery model; requiring
8 certain transition, contracts, and reimbursement;
8 directing termination of specified contracts;

9 Oklahoma Health Care Authority to seek certain
10 federal approval; directing promulgation of rules;
10 repealing 56 O.S. 2021, Section 4002.1, which relates
11 to the state Medicaid program; repealing 56 O.S.
11 2021, Sections 4002.2, 4002.4, 4002.6, 4002.7, and
12 4002.12, as last amended by Sections 1, 4, 5, 6, and
12 7, Chapter 448, O.S.L. 2024 (56 O.S. Supp. 2024,
13 Sections 4002.2, 4002.4, 4002.6, 4002.7, and
13 4002.12), which relate to the state Medicaid program;
14 repealing 56 O.S. 2021, Section 4002.2, as last

16 Section 4002.5, as last amended by Section 1, Chapter

17 4002.5), which relates to the state Medicaid program;
17 repealing 56 O.S. 2021, Sections 4002.8, 4002.10,
18 4002.11, and 4002.13, as amended by Sections 12, 13,
18 14, and 18, Chapter 395, O.S.L. 2022 (56 O.S. Supp.
19 2024, Sections 4002.8, 4002.10, 4002.11, and
19 4002.13), which relate to the state Medicaid program;
20 repealing 56 O.S. 2021, Section 4002.15, as amended
20 by Section 20, Chapter 395, O.S.L. 2022, and as
21 renumbered by Section 24, Chapter 395, O.S.L. 2022
21 (56 O.S. Supp. 2024, Section 4002.15), which relates
22 to the state Medicaid program; repealing Sections 1,
22 5, 6, 8, 16, 17, and 19, Chapter 395, O.S.L. 2022 (56
23 O.S. Supp. 2024, Sections 4002.1a, 4002.3c, 4002.3d,
23 4002.4a, 4002.12a, 4002.12b, and 4002.14), which
24 relate to the state Medicaid program; repealing

1 Sections 3 and 4, Chapter 395, O.S.L. 2022, as
1 amended by Sections 2 and 3, Chapter 448, O.S.L. 2024
2 (56 O.S. Supp. 2024, Sections 4002.3a and 4002.3b),
2 which relate to the state Medicaid program; providing
3 for codification; and providing an effective date.

6 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

7 SECTION 1. NEW LAW A new section of law to be codified
7
8 in the Oklahoma Statutes as Section 4002 of Title 56, unless there
8
9 is created a duplication in numbering, reads as follows:
9
10 A. Upon receipt of federal approval as described in subsection
10
11 C of this section, the state Medicaid program shall return to a fee-
11
12 for-service delivery model. The Oklahoma Health Care Authority
12
13 shall transition all Medicaid members covered by a contracted entity
13
14 to direct coverage by the Authority, shall enter into such contracts
14
15 with health care providers as are necessary to ensure network
15
16 adequacy as required by federal regulation, and shall directly
16
17 reimburse such providers. Upon completion of such transition and
17
18 execution of contracts, the Authority shall terminate its contracts
18
19 with all contracted entities.

20 B. Nothing in this section shall be construed to prohibit the
20
21 Authority from implementing value-based payment arrangements with
21
22 Medicaid providers through direct contractual agreements.
22
23 C. The Authority shall seek any federal approval necessary to
23
24 implement the provisions of this section.

1 D. The Oklahoma Health Care Authority Board shall promulgate

2 rules to implement the provisions of this section.

3 SECTION 2. REPEALER 56 O.S. 2021, Section 4002.1, is
3
4 hereby repealed.

5 SECTION 3. REPEALER 56 O.S. 2021, Sections 4002.2,
5
6 4002.4, 4002.6, 4002.7, and 4002.12, as last amended by Sections 1,
6
7 4, 5, 6, and 7, Chapter 448, O.S.L. 2024 (56 O.S. Supp. 2024,
7
8 Sections 4002.2, 4002.4, 4002.6, 4002.7, and 4002.12), are hereby
8
9 repealed.

10 SECTION 4. REPEALER 56 O.S. 2021, Section 4002.2, as
10
11 last amended by Section 1, Chapter 206, O.S.L. 2024 (56 O.S. Supp.
11
12 2024, Section 4002.2), is hereby repealed.

13 SECTION 5. REPEALER 56 O.S. 2021, Section 4002.5, as
13
14 last amended by Section 1, Chapter 243, O.S.L. 2023 (56 O.S. Supp.
14
15 2024, Section 4002.5), is hereby repealed.

16 SECTION 6. REPEALER 56 O.S. 2021, Sections 4002.8,
16
17 4002.10, 4002.11, and 4002.13, as amended by Sections 12, 13, 14,
17
18 and 18, Chapter 395, O.S.L. 2022 (56 O.S. Supp. 2024, Sections
18
19 4002.8, 4002.10, 4002.11, and 4002.13), are hereby repealed.

20 SECTION 7. REPEALER 56 O.S. 2021, Section 4002.15, as
20
21 amended by Section 20, Chapter 395, O.S.L. 2022, and as renumbered
21
22 by Section 24, Chapter 395, O.S.L. 2022 (56 O.S. Supp. 2024, Section
22
23 4002.15), is hereby repealed.

1 SECTION 8. REPEALER Sections 1, 5, 6, 8, 16, 17, and 19,

2 Chapter 395, O.S.L. 2022 (56 O.S. Supp. 2024, Sections 4002.1a,
2
3 4002.3c, 4002.3d, 4002.4a, 4002.12a, 4002.12b, and 4002.14), are
3
4 hereby repealed.

5 SECTION 9. REPEALER Sections 3 and 4, Chapter 395,
5
6 O.S.L. 2022, as amended by Sections 2 and 3, Chapter 448, O.S.L.
6
7 2024 (56 O.S. Supp. 2024, Sections 4002.3a and 4002.3b), are hereby
7
8 repealed.

9 SECTION 10. This act shall become effective November 1, 2025.
