7 An Act relating to Oklahoma Employees Insurance and
7 Benefits Act; amending 74 O.S. 2021, Section 1308.3,
8 as amended by Section 1, Chapter 21, O.S.L. 2025 (74
8 O.S. Supp. 2025, Section 1308.3), which relates to
9 basic health plan opt-out options; increasing opt-out
9 amount for certain employees in lieu of flexible
10 benefit allowance; providing an effective date; and
10 declaring an emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 74 O.S. 2021, Section 1308.3, as
14
15 amended by Section 1, Chapter 21, O.S.L. 2025 (74 O.S. Supp. 2025,
15
16 Section 1308.3), is amended to read as follows:
16
17 Section 1308.3. Any active employee eligible to participate or
17
18 who is a participant may opt out of the state's basic plan as
18
19 outlined in Sections 1370 and 1371 of this title, or may opt out of
19
20 the health and dental basic plan options only, and retain the life
20
21 and disability plan benefits, provided that the participant is
21
22 currently covered by a separate health insurance plan or will be
22
23 covered by a separate health insurance plan at or before the
23
24 beginning of the next plan year. Any Beginning November 1, 2011,

1 and ending on June 30, 2026, any active employee eligible to

2 participate or who is a participant opting out of coverage pursuant
2
3 to this section shall provide proof of the separate health insurance
3
4 plan participation and sign an affidavit attesting that the
4
5 participant is currently covered and does not require state-provided
5
6 health insurance each plan year. Any active employee opting out of
6
7 the state's basic plan or the health and dental basic plan options
7
8 pursuant to this section shall receive One Hundred Fifty Dollars
8
9 ($150.00) in lieu of the flexible benefit amount the employee would
9
10 be otherwise eligible to receive. Beginning July 1, 2026, any
10
11 active employee opting out of the state's basic plan or the health
11
12 and dental basic plan options pursuant to this section shall receive
12
13 Five Hundred Dollars ($500.00) monthly in lieu of the flexible
13
14 benefit amount the employee would otherwise be eligible to receive.
14
15 Any savings realized by the state as a result of a participant
15
16 opting out of health insurance plan coverage shall be retained by
16
17 the state.
17
18 SECTION 2. This act shall become effective July 1, 2026.
18
19 SECTION 3. It being immediately necessary for the preservation
19
20 of the public peace, health or safety, an emergency is hereby
20
21 declared to exist, by reason whereof this act shall take effect and
21
22 be in full force from and after its passage and approval.
