7 An Act relating to solar energy devices; defining
7 term; stating permissible locations for installation
8 of solar energy devices; prohibiting certain
8 installation of solar energy devices; providing for
9 codification; and declaring an emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 820.6 of Title 17, unless there
14
15 is created a duplication in numbering, reads as follows:

16 A. For the purposes of this section, "agricultural land"
16
17 includes any land used primarily for farming, ranching, or other
17
18 agricultural purposes as determined by the Oklahoma Department of
18
19 Agriculture, Food, and Forestry.

20 B. Notwithstanding any other provision of law, a solar energy
20
21 device, as defined in Section 820.1 of Title 17 of the Oklahoma
21
22 Statutes, shall only be permitted for installation on the following:

23 1. Single-family residential properties; and
23
24 2. Commercial or industrial properties.

1 C. On or after the effective date of this act, solar energy

2 devices shall not be installed, maintained, or retained on
2
3 agricultural land.

4 SECTION 2. It being immediately necessary for the preservation
4
5 of the public peace, health or safety, an emergency is hereby
5
6 declared to exist, by reason whereof this act shall take effect and
6
7 be in full force from and after its passage and approval.
