7 An Act relating to hospitals; prohibiting certain
7 vaccination requirements and discrimination; amending
8 70 O.S. 2021, Section 1210.189, which relates to
8 prohibited COVID-19-related requirements; removing
9 certain exception; and declaring an emergency.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. NEW LAW A new section of law to be codified
15
16 in the Oklahoma Statutes as Section 1-707c of Title 63, unless there
16
17 is created a duplication in numbering, reads as follows:
17
18 A hospital shall not, as a condition of employment, contract,
18
19 internship, training, residency, or other similar arrangement,
19
20 require any physician, nurse, or other health care provider or any
20
21 health care student, resident, intern, or trainee to be vaccinated
21
22 against COVID-19 or any other disease, and shall not discriminate
22
23 against any such individual due to his or her vaccination status.

1 SECTION 2. AMENDATORY 70 O.S. 2021, Section 1210.189, is

2 amended to read as follows:

3 Section 1210.189. A. A board of education of a public school
3
4 district or a technology center school district, the board of
4
5 regents of an institution within The Oklahoma State System of Higher
5
6 Education, the governing board of a private postsecondary
6
7 educational institution, the Oklahoma State Regents for Higher
7
8 Education, the State Board of Education or the State Board of Career
8
9 and Technology Education shall not:
9
10 1. Require a vaccination against Coronavirus disease 2019
10
11 (COVID-19) as a condition of admittance to or attendance of the
11
12 school or institution;
12
13 2. Require a vaccine passport as a condition of admittance to
13
14 or attendance of the school or institution; or
14
15 3. Implement a mask mandate for students who have not been
15
16 vaccinated against COVID-19.

17 B. As used in this section, "vaccine passport" means
17
18 documentation that an individual has been vaccinated against COVID-
18
19 19.
19
20 C. Nothing in this section shall be construed to apply to any
20
21 public or private healthcare setting.

22 SECTION 3. It being immediately necessary for the preservation
22
23 of the public peace, health or safety, an emergency is hereby
23

1 declared to exist, by reason whereof this act shall take effect and

2 be in full force from and after its passage and approval.
