7   An Act relating to school activities; creating the

7   Oklahoma Athletics and Activities Commission;

8   providing for appointment of members; requiring

8   initial appointments to be made by certain date;

9   providing for terms of members; requiring

9   organizational meeting to be held by certain date;

10  providing for election of chair and vice chair;

10  providing term limit for chair; allowing members to

11  be removed for cause; providing for filling of

11  vacancies; prohibiting members of the Legislature

12  from being appointed while serving and for certain

12  time period thereafter; providing frequency of

13  meetings; allowing special meetings to be called;

13  providing for quorum; providing for travel

14  reimbursement; subjecting the Commission to certain

14  acts; directing the State Department of Education to

15  provide office space; providing duties of the

15  Commission; directing the Commission to supervise and

16  organize certain activities beginning in certain

16  school year; repealing 70 O.S. 2021, Section 8-103.2,

17  which relates to participation in certain

17  competitions after certain transfer; providing for

18  codification; providing an effective date; and

18  declaring an emergency.

21 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
21

22  SECTION 1.      NEW LAW  A new section of law to be codified

22

23 in the Oklahoma Statutes as Section 27-500 of Title 70, unless there
23

24 is created a duplication in numbering, reads as follows:

1   A. There is hereby created the Oklahoma Athletics and

1

2 Activities Commission to provide supervision, coordination, and
2

3 regulation for secondary school activities in this state.
3

4   B. The Commission shall be comprised of:

4

5   1. Three public school district administrators or athletic

5

6 directors employed by districts with an average daily membership
6

7 (ADM) of one thousand five hundred (1,500) students or more,
7

8 appointed by the Governor, the President Pro Tempore of the Senate,
8

9 and the Speaker of the House of Representatives;
9

10  2. Three public school district administrators or athletic

10

11 directors employed by districts with an ADM of less than one
11

12 thousand five hundred (1,500) students, appointed by the Governor,
12

13 the President Pro Tempore of the Senate, and the Speaker of the
13

14 House of Representatives;
14

15  3. Three parents or legal guardians of students enrolled in

15

16 public school districts with an ADM of seven hundred fifty (750)
16

17 students or more, appointed by the Governor, the President Pro
17

18 Tempore of the Senate, and the Speaker of the House of
18

19 Representatives;
19

20  4. Three parents or legal guardians of students enrolled in

20

21 public school districts with an ADM of less than seven hundred fifty
21

22 (750) students, appointed by the Governor, the President Pro Tempore
22

23 of the Senate, and the Speaker of the House of Representatives;

1   5. Three parents or legal guardians of students enrolled in

1

2 private schools in this state with an enrollment of three hundred
2

3 (300) students or more, appointed by the Governor, the President Pro
3

4 Tempore of the Senate, and the Speaker of the House of
4

5 Representatives;
5

6   6. Three parents or legal guardians of students enrolled in

6

7 private schools in this state with an enrollment of fewer than three
7

8 hundred (300) students, appointed by the Governor, the President Pro
8

9 Tempore of the Senate, and the Speaker of the House of
9

10 Representatives; and
10

11  7. The Superintendent of Public Instruction or his or her

11

12 designee.

13  C. 1. Initial appointments shall be made by August 1, 2026.

13

14 The Governor, the President Pro Tempore of the Senate, and the
14

15 Speaker of the House of Representatives shall each appoint one
15

16 member for three (3) years, one member for four (4) years, and one
16

17 member for five (5) years. Members shall serve until a successor is
17

18 appointed.

19  2. The Commission shall have an organizational meeting by

19

20 September 1, 2026, during which members shall elect from its
20

21 membership a chair and vice chair. The Commission shall elect from
21

22 its membership a chair and vice chair by November 30 every two (2)
22

23 years thereafter. No member shall serve more than two consecutive
23

24 terms as chair.

1   3. Members may be removed from the Commission by the appointing

1

2 authority for cause. Vacancies shall be filled by the appointing
2

3 authority for the unexpired term.
3

4   D. No member of the Senate or the House of Representatives may

4

5 be appointed to the Commission while serving as a member of the
5

6 Legislature or for two (2) years following the expiration of the
6

7 term of office.
7

8   E. The Commission shall meet once each month. Special meetings

8

9 may be called by the chair or by a majority of the members of the
9

10 Commission. Ten members of the Commission shall constitute a
10

11 quorum. No business may be transacted at any meeting unless a
11

12 quorum is present in person or through teleconferencing, and every
12

13 act of the Commission shall be approved by a majority of the
13

14 membership of the Commission. Each member of the Commission shall
14

15 receive necessary traveling expenses while in the performance of
15

16 duties as a member pursuant to the State Travel Reimbursement Act.
16

17  F. The Commission shall be subject to the Oklahoma Open Meeting

17

18 Act and the Oklahoma Open Records Act.
18

19  G. The State Department of Education shall provide office space

19

20 for the operation of the Commission.
20

21  SECTION 2.     NEW LAW  A new section of law to be codified

21

22 in the Oklahoma Statutes as Section 27-501 of Title 70, unless there
22

23 is created a duplication in numbering, reads as follows:

1   A. The Oklahoma Athletics and Activities Commission created

1

2 pursuant to Section 1 of this act shall have supervision of the
2

3 secondary school activities in this state. Subject to limitations
3

4 otherwise provided by law, the Commission shall:
4

5   1. Promulgate rules pursuant to the Administrative Procedures

5

6 Act for the operation, supervision, and regulation of secondary
6

7 school activities. The rules shall, at a minimum, address
7

8 eligibility for student participation, usage of athletic facilities,
8

9 student recruitment, a code of conduct, and disciplinary procedures
9

10 for violations of the code of conduct;
10

11  2. Hire and fix the compensation and duties of an Executive

11

12 Director and other personnel required to carry out the duties of the
12

13 Commission;
13

14  3. Have the authority to enter into agreements with private

14

15 schools for their inclusion in secondary school activities
15

16 coordinated by the Commission;
16

17  4. Have the authority to cooperate with and enter into

17

18 agreements with national athletic associations as may be necessary
18

19 to promote, organize, or regulate secondary school activities;
19

20  5. Develop a plan to operate, supervise, and regulate secondary

20

21 school activities for all public and private schools in this state.
21

22 The plan shall be electronically submitted to the Governor, the
22

23 President Pro Tempore of the Senate, and the Speaker of the House of
23

24 Representatives by January 30, 2027;

1   6. Purchase or acquire equipment, materials, supplies, and

1

2 other property, real or personal, as may be necessary for the
2

3 operation of the Commission;
3

4   7. Enter into agreements and contracts as necessary with the

4

5 State Department of Education, boards of education of public school
5

6 districts, and governing boards of private schools;
6

7   8. Set fees for public and private school membership and

7

8 activity participation; and
8

9   9. Enter into cooperative agreements with one or more other

9

10 states for the coordination and administration of programs,
10

11 services, activities, and competitions.
11

12  B. Beginning with the 2027-2028 school year, the Oklahoma

12

13 Athletics and Activities Commission created pursuant to Section 1 of
13

14 this act shall supervise and organize all secondary school
14

15 activities for public and private schools that enter into agreements
15

16 with the Commission including, but not limited to, categorization of
16

17 schools, scheduling of all regular season secondary school activity
17

18 competitions, scheduling of all post-season competitions, hiring and
18

19 training secondary school activity officials, and athletic facility
19

20 usage.

21  SECTION 3.       REPEALER   70 O.S. 2021, Section 8-103.2, is

21

22 hereby repealed.

23  SECTION 4. This act shall become effective July 1, 2026.

1   SECTION 5. It being immediately necessary for the preservation

1

2 of the public peace, health, or safety, an emergency is hereby
2

3 declared to exist, by reason whereof this act shall take effect and
3

4 be in full force from and after its passage and approval.
