7 An Act relating to higher education; affording
7 certain rights to students enrolled in and attending
8 institutions within The Oklahoma State System of
8 Higher Education; directing institutions to establish
9 a Free Campus Committee; providing for membership;
9 providing method for reporting violations of certain
10 rights; directing certain committee to create certain
10 due process plan; requiring plan to include certain
11 components; allowing a Free Campus Committee to
11 request certain investigation; creating a cause of
12 action for certain violation; allowing certain civil
12 suit for certain violation; providing time limitation
13 on causes of action; providing for codification;
13 providing an effective date; and declaring an
14 emergency.

17 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
17
18 SECTION 1. NEW LAW A new section of law to be codified
18
19 in the Oklahoma Statutes as Section 2130 of Title 70, unless there
19
20 is created a duplication in numbering, reads as follows:
20
21 A. A student enrolled in and attending an institution within
21
22 The Oklahoma State System of Higher Education shall be afforded the
22
23 following rights:

1 1. The right to public and free expression of religion, speech,
1
2 and peaceable assembly including, but not limited to:
2
3 a. the right to participate in religious student
3
4 associations free from discrimination pursuant to the
4
5 provisions of Sections 2119 through 2119.4 of Title 70
5
6 of the Oklahoma Statutes,
6
7 b. the right to engage in expressive activity on campus
7
8 pursuant to the provisions of Section 2120 of Title 70
8
9 of the Oklahoma Statutes, and
9
10 c. the right to an unbiased education that does not
10
11 endorse, favor, actively encourage, demean, show
11
12 hostility toward, or intentionally undermine any
12
13 particular religion, nonreligious faith, or religious
13
14 perspective;
14
15 2. The right to an unbiased education that does not endorse,
15
16 favor, or actively encourage socialism, communism, or Marxism and
16
17 that is free from anti-American bias;
17
18 3. The right to an unbiased learning environment that is free
18
19 from the display of flags or propaganda of any organization or
19
20 symbol of socialism, communism, Marxism, or anti-American sentiment;
20
21 4. The right to an education free from indoctrination. For the
21
22 purposes of this section, "indoctrination" means the forced or
22
23 compelled endorsement, adoption, acceptance, or affirmation of any
23
24 belief system, ideology, theory, lifestyle, religion, non-religious

1 faith, religious perspective, or philosophy by any action,
1
2 curriculum, training, or instruction in a program or activity
2
3 offered by an institution of higher education;
3
4 5. The right to be free from any aggressive hostility toward
4
5 political speech or expression in verbal or aggressive physical form
5
6 by way of taking, confiscating, removing, discrediting, or
6
7 belittling any item of clothing that may depict a freedom of
7
8 expression unless the item is obscene, as defined in Section 1024.1
8
9 of Title 21 of the Oklahoma Statutes;
9
10 6. The right to be free from institution of higher education
10
11 faculty lowering or exhibiting grading bias for political beliefs or
11
12 expressing constitutionally protected freedoms as long as such
12
13 beliefs or expression do not directly interfere with or disrupt the
13
14 class and is initiated by the student;
14
15 7. The right to be free from performances or depictions that
15
16 are supported by institution of higher education funding and are
16
17 obscene, as defined in Section 1024.1 of Title 21 of the Oklahoma
17
18 Statutes; and
18
19 8. The right to listen to and engage with guest speakers,
19
20 regardless of the political or ideological beliefs of the speakers.
20
21 B. Each institution within The Oklahoma State System of Higher
21
22 Education shall establish a Free Campus Committee to be composed of
22
23 seven (7) members. Each committee shall be composed of:

1 1. One student who is enrolled full-time in the institution,
1
2 appointed by the institution president or his or her designee;
2
3 2. One member of the institution's administration, appointed by
3
4 the institution president or his or her designee;
4
5 3. One community representative who is not employed by the
5
6 institution, who does not serve on the governing board for the
6
7 institution, and who has not donated to the institution, appointed
7
8 by the Governor;
8
9 4. Two community representatives who are not employed by the
9
10 institution, who are not serving on the governing board for the
10
11 institution, and who have not donated to the institution, appointed
11
12 by the President Pro Tempore of the Senate; and
12
13 5. Two community representatives who are not employed by the
13
14 institution, who are not serving on the governing board for the
14
15 institution, and who have not donated to the institution, appointed
15
16 by the Speaker of the House of Representatives.

17 C. Students enrolled in an institution of higher education and
17
18 faculty employed by an institution of higher education may report
18
19 violations of the rights provided for in subsection A of this
19
20 section to the Free Campus Committee. Reports may be made in a
20
21 manner that protects the identity of the accuser from retribution.
21
22 D. The Free Campus Committee shall create a due process plan
22
23 for students and faculty that includes at a minimum the following:

1 1. Designation of a hotline or email address to submit reports
1
2 of violations of the rights provided for in subsection A of this
2
3 section;
3
4 2. Procedures for investigating and implementing punishment for
4
5 false accusations;
5
6 3. Procedures for reporting to law enforcement suspected
6
7 violations that may constitute criminal activity or reasonably have
7
8 the potential to endanger campus safety;
8
9 4. A requirement that reported violations be investigated by
9
10 the Free Campus Committee in a timely manner and that individuals
10
11 involved in the reported violations be notified of the committee's
11
12 findings; and
12
13 5. A procedure for the Free Campus Committee to hear appeals of
13
14 the committee's findings.
14
15 E. The Free Campus Committee may request that the Attorney
15
16 General investigate an institution of higher education for
16
17 noncompliance with the provisions of this section.
17
18 F. A student aged eighteen (18) years or over or the parent or
18
19 legal guardian of a student under the age of eighteen (18) years
19
20 whose rights under this section have been violated:

21 1. Shall have a cause of action against an institution of
21
22 higher education. The student or the parent or legal guardian of
22
23 the student shall bring suit for a violation of this section no
23
24 later than one (1) year after the day the violation occurs; or

1 2. May bring a civil suit against an institution of higher
1
2 education faculty member in his or her individual capacity for
2
3 willfully violating the provisions of this section. Such faculty
3
4 member shall be liable for civil penalties.
4
5 SECTION 2. This act shall become effective July 1, 2026.
5
6 SECTION 3. It being immediately necessary for the preservation
6
7 of the public peace, health, or safety, an emergency is hereby
7
8 declared to exist, by reason whereof this act shall take effect and
8
9 be in full force from and after its passage and approval.
