7 An Act relating to the Oklahoma Juvenile Code;
7 amending 10A O.S. 2021, Section 1-8-110, which
8 relates to falsification of documents; requiring
8 certain persons who testify falsely to be placed on
9 certain list; authorizing use of list for evidentiary
9 purposes; requiring the Department of Human Services
10 to maintain a publicly accessible list; and providing
10 an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 10A O.S. 2021, Section 1-8-110, is
14
15 amended to read as follows:
15
16 Section 1-8-110. A. Any member of law enforcement, state
16
17 employee, employee of a private employer, or any other individual
17
18 that appears in a deprived child proceeding who knowingly and
18
19 intentionally falsifies any document containing a material fact in
19
20 any case in which a child has been alleged or adjudicated deprived
20
21 that results in the great bodily harm or the death of the child
21
22 shall, upon conviction, be guilty of a felony punishable by a fine
22
23 of One Thousand Dollars ($1,000.00) or by imprisonment in the

1 custody of the Department of Corrections for up to two (2) years or
1
2 by both such fine and imprisonment.

3 B. Any employee of the Department of Human Services or other
3
4 child welfare worker that testifies under oath and provides
4
5 inaccurate, misleading, or false information, whether willfully,
5
6 knowingly, or recklessly, shall have his or her name placed on a
6
7 list that may be used as evidence to evaluate the truthfulness of
7
8 such employee or worker. All parties to a deprivation hearing shall
8
9 be given notice of the list and its members. The Department of
9
10 Human Services shall maintain the list in a publicly accessible
10
11 format on its official website.

12 SECTION 2. This act shall become effective November 1, 2026.
