7   An Act relating to criminal procedure; amending 22

7   O.S. 2021, Section 1141.16, which relates to bail;

8   prohibiting courts from accepting bail from

8   charitable bail organizations; and providing an

9   effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.      AMENDATORY  22 O.S. 2021, Section 1141.16, is

13

14 amended to read as follows:
14

15  Section 1141.16. Unless the offense with which the prisoner is

15

16 charged is shown to be an offense punishable by death or life
16

17 imprisonment under the laws of the state in which it was committed,
17

18 a judge or magistrate in this state may admit the person arrested to
18

19 bail by bond, with sufficient sureties, and in such sum as he deems
19

20 proper, conditioned for his appearance before him at a time
20

21 specified in such bond, and for his surrender, to be arrested upon
21

22 the warrant of the Governor of this state. The court shall not
22

23 accept payment of a defendant's bail if the court has reason to
23

24 believe that a charitable bail organization paid for such bail.

1   SECTION 2. This act shall become effective November 1, 2026.
