7 An Act relating to the Oklahoma Turnpike Authority;
7 amending 69 O.S. 2021, Section 1711, which relates to
8 tolls; prohibiting certain Authority from charging
8 tolls on certain turnpike projects in certain
9 circumstance; allowing certain Authority to charge
9 tolls on certain turnpike projects in certain
10 circumstance; updating statutory language; and
10 providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 69 O.S. 2021, Section 1711, is
14
15 amended to read as follows:
15
16 Section 1711. A. The Oklahoma Turnpike Authority, subject to
16
17 the provisions hereof, is hereby authorized to fix, revise, charge
17
18 and collect tolls for the use of each turnpike project and the
18
19 different parts or sections thereof, except for use by law
19
20 enforcement officers responsible for enforcing the traffic laws and
20
21 the general laws of the state and federal governments on turnpikes,
21
22 who shall be entitled to free use of every such project in the
22
23 performance of official duties connected with such turnpike project,
23
24 and.

1 B. The Authority, subject to the provisions of this section, is
1
2 authorized to contract with any person, partnership, association or
2
3 corporation desiring the use of any part thereof, including the
3
4 right-of-way adjoining the paved portion, for placing thereon
4
5 telephone, telegraph, electric light or power lines, gas stations,
5
6 garages, stores, hotels, restaurants and advertising signs, or for
6
7 any other purpose except for tracks for railroad or railway use, and
7
8 to fix the terms, conditions, rents and rates of charges for such
8
9 use.

10 C. Such tolls, subject to the other restrictions hereof, shall
10
11 be so fixed and adjusted in respect of the aggregate of tolls from
11
12 the turnpike project or projects in connection with which the bonds
12
13 of any issue shall have been issued as to provide a fund sufficient
13
14 with other revenues, if any, to pay (a) the cost of maintaining,
14
15 repairing, and operating such turnpike project or projects, and (b)
15
16 the principal of and the interest of such bonds as the same shall
16
17 become due and payable, and to create reserves for such purposes.
17
18 The tolls and all other revenues derived from the turnpike project
18
19 or projects in connection with which the bonds of any issue shall
19
20 have been issued, except such part thereof as may be necessary to
20
21 pay such cost of maintenance, repair, and operation and to provide
21
22 such reserves therefor as may be provided for in the resolution
22
23 authorizing the issuance of such bonds or in the trust agreement
23
24 securing the same shall be set aside at such regular intervals as

1 may be provided in such resolution or such trust agreement in a

2 sinking fund which is hereby pledged to, and charged with, the
2
3 payment of (a) the interest upon such bonds as such interest shall
3
4 fall due, (b) the principal of such bonds as the same shall fall
4
5 due, (c) the necessary charges of paying agents for paying principal
5
6 and interest, and (d) the redemption price or the purchase price of
6
7 bonds retired by call or purchase as therein provided, which are a
7
8 charge against such fund. The use and disposition of monies to the
8
9 credit of such sinking fund shall be subject to the provisions of
9
10 the resolution authorizing the issuance of such bonds or of such
10
11 trust agreement. Except as may otherwise be provided in such
11
12 resolution or such trust agreement, such sinking fund shall be a
12
13 fund for all such bonds without distinction or priority of one over
13
14 another. The monies in the sinking fund, less such reserve as may
14
15 be provided in such resolution or trust agreement, if not used
15
16 within a reasonable time for the purchase of bonds for cancellation
16
17 as above provided, shall be applied to the redemption of bonds at
17
18 the redemption price then applicable.

19 D. Any person who leases, rents, or acquires control of any gas
19
20 station, garage, store, hotel, or restaurant must have been a
20
21 resident of, or been doing business in, Oklahoma for the past five
21
22 (5) years.

23 E. Notwithstanding anything else herein contained to the
23
24 contrary, the Corporation Commission of the State of Oklahoma shall

1 exercise the jurisdiction now or hereafter vested in it to regulate
1
2 and control the operation of motor carriers of passengers and
2
3 freight, using or desiring to use any turnpike project, in the
3
4 manner and to the extent that it regulates or controls such carriers
4
5 using the highways of the state.

6 F. The Authority shall not discriminate against any group or
6
7 class or individual member thereof in fixing the amount of toll,
7
8 rents, or charge for the use of the turnpike project.
8
9 G. 1. The Authority shall not charge a toll on a turnpike
9
10 project that has had an average annual daily traffic volume of less
10
11 than twenty-five thousand (25,000) vehicles for the five (5) years
11
12 preceding the effective date of this act.

13 2. The Authority shall not charge a toll on a turnpike project
13
14 that has an average annual daily traffic volume of less than twenty-
14
15 five thousand (25,000) vehicles over a period of five (5)
15
16 consecutive years.
16
17 3. If a turnpike project subject to the provisions of
17
18 paragraphs 1 and 2 of this subsection has, for a period of five (5)
18
19 consecutive years, an average annual daily traffic volume of at
19
20 least twenty-five thousand (25,000) vehicles, the Authority may
20
21 reinstate the toll on such turnpike project.
21
22 SECTION 2. This act shall become effective November 1, 2026.
