7   An Act relating to Oklahoma State Bureau of

7   Investigation; creating the Cyber Crime and Fraud

8   Unit; prescribing purpose and duties of the unit;

8   prohibiting provisions from being construed to expand

9   the jurisdiction of the Bureau; authorizing the

9   Director of the Bureau to reassign personnel and

10  resources to carry out certain duties; authorizing

10  the Bureau to promulgate rules; creating the Cyber

11  Crime and Fraud Unit Fund; providing sources of

11  funds; providing for expenditures from fund; making

12  an appropriation to the Cyber Crime and Fraud Unit

12  Fund; providing for codification; providing an

13  effective date; and declaring an emergency.

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

17  SECTION 1.         NEW LAW  A new section of law to be codified

17

18 in the Oklahoma Statutes as Section 150.19c of Title 74, unless
18

19 there is created a duplication in numbering, reads as follows:
19

20  A. There is hereby created within the Oklahoma State Bureau of

20

21 Investigation a Cyber Crime and Fraud Unit. The unit shall operate
21

22 as an internal division of the Bureau and shall exercise only those
22

23 investigative powers and the jurisdiction granted to the Bureau by
23

24 Oklahoma Statutes.

1      B. The purpose of the Cyber Crime and Fraud Unit shall be to

2 enhance the capacity of the Bureau to investigate:
2

3      1. Cyber-enabled criminal activity including intrusions,

3

4 network breaches, ransomware, digital extortion, and online
4

5 exploitation;
5

6      2. Financial fraud and related schemes including cyber-

6

7 facilitated fraud, identity theft, and complex financial deception;
7

8 and
8

9      3. Criminal activity involving digital evidence, consistent

9

10 with the existing statutory authority of the Bureau.
10

11     C. Nothing in this act shall be construed to expand or modify

11

12 the jurisdiction of the Bureau. The unit may only initiate or
12

13 conduct investigations as follows:
13

14     1. Upon request or referral from a district attorney, law

14

15 enforcement agency, or state officer authorized under existing law;
15

16     2. Upon direction of the Governor, consistent with current

16

17 statutory authority; or
17

18     3. As the Bureau is otherwise permitted under existing

18

19 statutes.

20     D. The Cyber Crime and Fraud Unit shall:

20

21     1. Conduct investigations involving cyber-crime, digital

21

22 evidence, and fraud related offenses;
22

23     2. Provide digital forensics, technical assistance, and

23

24 analytical support to Bureau agents and requesting agencies;

1      3. Coordinate with federal, state, tribal, and local partners

2 on cyber and fraud investigations;
2

3      4. Develop and provide training to law enforcement agencies on

3

4 cyber-crime trends, digital evidence handling, and fraud prevention;
4

5 and
5

6      5. Maintain specialized personnel, including agents, analysts,

6

7 forensic examiners, and technical support staff.
7

8      E. The Director of the Bureau may assign personnel, reallocate

8

9 resources, and establish internal procedures necessary to carry out
9

10 the responsibilities of the unit.
10

11     F. The Bureau may promulgate rules to effectuate the provisions

11

12 of this act.

13     SECTION 2.  NEW LAW  A new section of law to be codified

13

14 in the Oklahoma Statutes as Section 150.19d of Title 74, unless
14

15 there is created a duplication in numbering, reads as follows:
15

16     There is hereby created in the State Treasury a revolving fund

16

17 for the Oklahoma State Bureau of Investigation to be designated the
17

18 "Cyber Crime and Fraud Unit Fund". The fund shall be a continuing
18

19 fund, not subject to fiscal year limitations, and shall consist of
19

20 any monies received by the Bureau for deposit in the fund. All
20

21 monies accruing to the credit of such fund are hereby appropriated
21

22 and may be budgeted and expended by the Oklahoma State Bureau of
22

23 Investigation for the purpose of carrying out the duties and
23

24 functions prescribed in Section 1 of this act. Expenditures from

1 such fund shall be made upon warrants issued by the State Treasurer
1

2 against claims filed as prescribed by law with the Director of the
2

3 Office of Management and Enterprise Services for approval and
3

4 payment.
4

5   SECTION 3. There is hereby appropriated to the Oklahoma State

5

6 Bureau of Investigation from any monies not otherwise appropriated
6

7 from the General Revenue Fund of the State Treasury for the fiscal
7

8 year ending June 30, 2026, the sum of Three Million Dollars
8

9 ($3,000,000.00) for deposit in the Cyber Crime and Fraud Unit Fund
9

10 created pursuant to Section 2 of this act.

11  SECTION 4. This act shall become effective July 1, 2026.

11

12  SECTION 5. It being immediately necessary for the preservation

12

13 of the public peace, health or safety, an emergency is hereby
13

14 declared to exist, by reason whereof this act shall take effect and
14

15 be in full force from and after its passage and approval.
