7 An Act relating to ballots; requiring certain
7 information to be printed on ballots with
8 propositions that authorize this state, any political
8 subdivision of this state, or any entity to issue any
9 bond or other instrument of debt; amending 26 O.S.
9 2021, Section 6-113, which relates to ballots for
10 state questions; requiring certain language to be
10 printed on ballots with state questions that
11 authorize this state, any political subdivision of
11 this state, or any entity to issue any bond or other
12 instrument of debt; providing for codification; and
12 providing an effective date.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16 SECTION 1. NEW LAW A new section of law to be codified
16
17 in the Oklahoma Statutes as Section 6-113.1 of Title 26, unless
17
18 there is created a duplication in numbering, reads as follows:
18
19 A. Any proposal that authorizes this state, any political
19
20 subdivision of this state, or any entity to issue any bond or other
20
21 instrument of debt, which is submitted to voters for approval, shall
21
22 be printed in such a manner as to include, above the proposition,
22
23 language containing the following language: "THIS IS A TAX

1 INCREASE." The language shall also include the following

2 information:

3 1. The total debt issued;
3
4 2. The amount of debt issued per household of the voting
4
5 jurisdiction;
5
6 3. The total annual cost of debt repayment;
6
7 4. The annual cost of debt repayment per household of the
7
8 voting jurisdiction; and
8
9 5. If the measure levies a new tax or extends an existing tax.

10 B. The language required in subsection A of this section shall
10
11 be conspicuous as the term is defined in Section 1-201 of Title 12A
11
12 of the Oklahoma Statutes.

13 SECTION 2. AMENDATORY 26 O.S. 2021, Section 6-113, is
13
14 amended to read as follows:
14
15 Section 6-113. Ballots A. Except as provided for in
15
16 subsections B and C of this section, ballots for state questions
16
17 shall be printed in such a manner as to include the number of the
17
18 state question, the ballot title, and the following language,:
18
19 "SHALL THE PROPOSAL BE APPROVED?" followed by the words "FOR THE
19
20 PROPOSAL - YES" and "AGAINST THE PROPOSAL - NO", one above the
20
21 other.

22 B. If the state question authorizes this state, any political
22
23 subdivision of this state, or any entity to issue any bond or other
23

1 instrument of debt, the ballot shall include in the ballot title the
1
2 following information:

3 1. The total debt issued;
3
4 2. The amount of debt issued per household of the voting
4
5 jurisdiction;
5
6 3. The total annual cost of debt repayment;

7 4. The annual cost of debt repayment per household of the
7
8 voting jurisdiction; and
8
9 5. If the measure levies a new tax or extends an existing tax.

10 C. If the state question provides for an increase to any tax
10
11 levy, extends the levy of a tax, or authorizes this state, any
11
12 political subdivision of this state, or any entity to levy a tax,
12
13 the ballot shall include above the ballot title and below the number
13
14 of the state question the following language: "THIS IS A TAX
14
15 INCREASE." The language shall be conspicuous as the term is defined
15
16 in Section 1-201 of Title 12A of the Oklahoma Statutes.

17 SECTION 3. This act shall become effective November 1, 2026.
