7 An Act relating to eminent domain; amending 27 O.S.
7 2021, Section 7, as amended by Section 1, Chapter
8 489, O.S.L. 2025 (27 O.S. Supp. 2025, Section 7),
8 which relates to eminent domain for light, heat, or
9 power by electricity or natural gas; prohibiting use
9 of eminent domain for certain facilities; updating
10 statutory language; and providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 27 O.S. 2021, Section 7, as
14
15 amended by Section 1, Chapter 489, O.S.L. 2025 (27 O.S. Supp. 2025,
15
16 Section 7), is amended to read as follows:

17 Section 7. A. Except as otherwise provided in this section,
17
18 any person, firm, or corporation organized under the laws of this
18
19 state, or authorized to do business in this state, to furnish light,
19
20 heat, or power by electricity or natural gas, or any other person,
20
21 association, or firm engaged in furnishing lights, heat, or power by
21
22 electricity or natural gas shall have and exercise the right of
22
23 eminent domain in the same manner and by like proceedings as
23
24 provided for railroad corporations by laws of this state.

1 B. The power of eminent domain shall not be used for the siting

2 or building of wind energy facilities, solar energy facilities,
2
3 hydroelectric energy facilities, battery storage facilities,
3
4 hydrogen gas facilities, or other renewable energy facilities on
4
5 private property.

6 C. Prior to seeking to exercise eminent domain for an electric
6
7 transmission facility rated greater than three hundred (300)
7
8 kilovolts, any person, firm, or corporation under the purview of
8
9 subsection A of this section must shall have obtained a Certificate
9
10 of Authority from the Corporation Commission.
10
11 D. This section shall not be construed to require any Oklahoma
11
12 retail electric supplier or rural electric cooperative to secure a
12
13 Certificate of Authority for any extension, rebuild, or upgrade to
13
14 an electric transmission facility.

15 SECTION 2. This act shall become effective November 1, 2026.
