7 An Act relating to Medicaid home- and community-based
7 services; requiring the Oklahoma Health Care
8 Authority to seek certain exemption from specified
8 federal regulation; defining term; requiring the
9 Authority to devise certain protections; providing
9 for codification; and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 1018.1 of Title 56, unless there
14
15 is created a duplication in numbering, reads as follows:

16 A. The Oklahoma Health Care Authority shall submit a request to
16
17 the Centers for Medicare & Medicaid Services for an exemption from
17
18 the provisions of 42 C.F.R., Section 441.301(c)(1)(vi) to allow
18
19 providers of Medicaid home- and community-based services in rural
19
20 counties of this state to provide case management and develop the
20
21 required person-centered plan. As used in this subsection, "rural
21
22 counties" means counties with a population of not more than sixty
22
23 thousand (60,000), according to the most recent Federal Decennial
23
24 Census.

1 B. For providers exempted under subsection A of this section,

2 the Authority shall devise conflict of interest protections in
2
3 accordance with 42 C.F.R., Section 441.301(c)(1)(vi), including
3
4 separation of entity and provider functions within provider
4
5 entities.

6 SECTION 2. This act shall become effective November 1, 2026.
