7 An Act relating to health care providers; requiring
7 certain health care providers to provide specified
8 mental health screening instrument during certain
8 patient visits; directing promulgation of certain
9 rules and creation of certain educational materials;
9 providing for codification; and providing an
10 effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 510.2 of Title 59, unless there
15
16 is created a duplication in numbering, reads as follows:
16
17 A. A physician shall provide an evidence-based, validated
17
18 mental health screening instrument as prescribed by the State Board
18
19 of Medical Licensure and Supervision to each patient during or
19
20 before a routine primary care visit at least once annually. This
20
21 requirement shall not apply to physicians who do not practice direct
21
22 client care.

23 B. The Board shall promulgate rules pertaining to the required
23
24 screening instrument and shall create such information and

1 educational materials necessary to implement the provisions of this

2 section. The Board may collaborate with the State Board of
2
3 Osteopathic Examiners and the Oklahoma Board of Nursing to develop
3
4 such rules, information, and educational materials.

6 in the Oklahoma Statutes as Section 519.13 of Title 59, unless there

7 is created a duplication in numbering, reads as follows:

8 A. A physician assistant shall provide an evidence-based,

9 validated mental health screening instrument as prescribed by the
9
10 State Board of Medical Licensure and Supervision to each patient
10
11 during or before a routine primary care visit at least once
11
12 annually. This requirement shall not apply to physician assistants
12
13 who do not practice direct client care.

14 B. The Board shall promulgate rules pertaining to the required
14
15 screening instrument and shall create such information and
15
16 educational materials necessary to implement the provisions of this
16
17 section. The Board may collaborate with the State Board of
17
18 Osteopathic Examiners and the Oklahoma Board of Nursing to develop

23 A. An Advanced Practice Registered Nurse shall provide an

24 evidence-based, validated mental health screening instrument as

1 prescribed by the Oklahoma Board of Nursing to each patient during

2 or before a routine primary care visit at least once annually. This
2
3 requirement shall not apply to Advanced Practice Registered Nurses
3
4 who do not practice direct client care.

5 B. The Board shall promulgate rules pertaining to the required
5
6 screening instrument and shall create such information and
6
7 educational materials necessary to implement the provisions of this
7
8 section. The Board may collaborate with the State Board of Medical
8
9 Licensure and Supervision and the State Board of Osteopathic
9
10 Examiners to develop such rules, information, and educational
10
11 materials.

12 SECTION 4. NEW LAW A new section of law to be codified
12
13 in the Oklahoma Statutes as Section 638.2 of Title 59, unless there
13
14 is created a duplication in numbering, reads as follows:

15 A. An osteopathic physician shall provide an evidence-based,
15
16 validated mental health screening instrument as prescribed by the
16
17 State Board of Osteopathic Examiners to each patient during or
17
18 before a routine primary care visit at least once annually. This
18
19 requirement shall not apply to osteopathic physicians who do not
19
20 practice direct client care.

21 B. The Board shall promulgate rules pertaining to the required
21
22 screening instrument and shall create such information and
22
23 educational materials necessary to implement the provisions of this
23
24 section. The Board may collaborate with the State Board of Medical

1 Licensure and Supervision and the Oklahoma Board of Nursing to

2 develop such rules, information, and educational materials.

3 SECTION 5. This act shall become effective November 1, 2026.
