6   An Act relating to duels; amending 21 O.S. 2021,

6   Section 662, as amended by Section 193, Chapter 486,

7   O.S.L. 2025 (21 O.S. Supp. 2025, Section 662), which

7   relates to penalties for dueling; modifying elements

8   of certain offense; defining term; establishing

8   guidelines for consent as an affirmative defense to

9   assaultive conduct; providing exceptions; providing

9   for codification; and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.      AMENDATORY  21 O.S. 2021, Section 662, as

13

14 amended by Section 193, Chapter 486, O.S.L. 2025 (21 O.S. Supp.
14

15 2025, Section 662), is amended to read as follows:
15

16  Section 662. Any person guilty of fighting any duel with a

16

17 deadly weapon, although no death or wound ensues, shall be guilty of
17

18 a Class C1 felony offense punishable by imprisonment as provided for
18

19 in subsections B through E of Section 20L of this title.

20  SECTION 2.      NEW LAW     A new section of law to be codified

20

21 in the Oklahoma Statutes as Section 663 of Title 21, unless there is
21

22 created a duplication in numbering, reads as follows:
22

23  A. As used in this section, "serious bodily injury" means any

23

24 harm that creates a substantial risk of death or that causes death,

1 serious permanent disfigurement, protracted loss or impairment of
1

2 the function of any bodily member or organ, or prolonged impairment
2

3 of the function of any bodily member or organ.

4   B. The victim's effective consent or the actor's reasonable

4

5 belief that the victim consented to the actor's conduct is an
5

6 affirmative defense to prosecution under Sections 644 and 647 of
6

7 Title 21 of the Oklahoma Statutes if:
7

8   1. The conduct did not threaten or inflict serious bodily

8

9 injury; and
9

10  2. The victim knew the conduct was a risk of:

10

11  a. his or her occupation,

11

12  b. recognized medical treatment, or

12

13  c. a scientific experiment conducted by recognized

13

14                 methods.

14

15  C. The defense to prosecution provided by subsection B of this

15

16 section shall not be available to a defendant who commits an offense
16

17 described by subsection B of this section as a condition of the
17

18 defendant's or the victim's initiation or continued membership in a
18

19 criminal street gang, as defined in subsection F of Section 856 of
19

20 Title 21 of the Oklahoma Statutes.

21  SECTION 3. This act shall become effective November 1, 2026.
