7   An Act relating to economic development; amending

7   Section 8, Chapter 377, O.S.L. 2024 (74 O.S. Supp.

8   2025, Section 5090.1), which relates to the

8   Legislative Evaluation and Development Committee;

9   removing requirement for members to submit to

9   nondisclosure agreements; and declaring an emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.      AMENDATORY  Section 8, Chapter 377, O.S.L.

13

14 2024 (74 O.S. Supp. 2025, Section 5090.1), is amended to read as
14

15 follows:
15

16  Section 5090.1. A. There is hereby created within the

16

17 Legislature the Legislative Evaluation and Development Committee.
17

18 The Legislative Evaluation and Development Committee shall review
18

19 financing for individual incentive packages including, but not
19

20 limited to, packages offering tax incentives, funds for economic
20

21 development, and, when the annual investment exceeds Twenty Million
21

22 Dollars ($20,000,000.00), excluding funding from existing incentives
22

23 for any business, new or existing currently in this state, or when
23

24 one or more of the incentives in the incentive package is not

1 authorized under current law or an amendment by the Legislature is

2 being sought to one or more currently existing incentives included
2

3 in the incentive package. In addition to the required review of
3

4 certain incentive packages as prescribed by this section, the
4

5 Committee may, in its discretion, also review potential economic
5

6 development projects presented by private sector businesses or state
6

7 or other political subdivision authorities which would be financed
7

8 by public funds.

9   B. The Legislative Evaluation and Development Committee shall

9

10 evaluate and propose economic projects provided by the Division on
10

11 Economic Development, Growth, and Expansion within the Oklahoma
11

12 Department of Commerce. The Committee shall consist of:
12

13  1. Four members of the Senate to be appointed by the President

13

14 Pro Tempore of the Senate, one of whom shall be from the minority
14

15 party; and
15

16  2. Four members of the House of the Representatives to be

16

17 appointed by the Speaker of the House of Representatives, one of
17

18 whom shall be from the minority party.
18

19  The President Pro Tempore of the Senate, or his or her designee,

19

20 and the Speaker of the House of Representatives, or his or her
20

21 designee, shall serve as co-chairs for the Committee.
21

22  C. The quorum of the Committee shall consist of at least five

22

23 members. Meetings of the Committee shall be governed by joint rules
23

24 of the Legislature. Members of the Committee may receive

1 reimbursement from the Legislative Service Bureau for actual and
1

2 necessary expenses incurred in connection with their duties as
2

3 members of the Committee in accordance with other provisions of law
3

4 relating to travel reimbursement for members of the Legislature.
4

5 Members serving on this Committee shall submit to nondisclosure
5

6 agreements and adhere to the confidentiality of the material
6

7 discussed in meetings that affects the economic development of this
7

8 state.

9   SECTION 2. It being immediately necessary for the preservation

9

10 of the public peace, health or safety, an emergency is hereby
10

11 declared to exist, by reason whereof this act shall take effect and
11

12 be in full force from and after its passage and approval.
