7 An Act relating to foster care; directing the
7 Department of Human Services to implement certain
8 extension of foster care services; making services
8 voluntary; establishing certain qualifications;
9 directing promulgation of rules; requiring the
9 Department to seek available funding; providing for
10 codification; providing an effective date; and
10 declaring an emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 1-7-112a of Title 10A, unless
15
16 there is created a duplication in numbering, reads as follows:
16
17 A. The Department of Human Services shall implement an
17
18 extension of foster care services to support individuals
18
19 transitioning into adulthood who meet the requirements provided by
19
20 this section. Participation in extended services under this section
20
21 shall be a voluntary election by the qualifying individual.
21
22 Services shall be available to any individual in this state who
22
23 meets the requirements of subsection B of this section and who:

1 1. Was in the custody of the Department at the time of the
1
2 individual's eighteenth birthday but is less than twenty-one (21)
2
3 years of age; or
3
4 2. Achieved legal permanency by guardianship or adoption at
4
5 sixteen (16) years of age or older but less than twenty-one (21)
5
6 years of age and the legal caretakers are no longer able or willing
6
7 to provide care for the individual.

8 B. Any individual described in subsection A of this section may
8
9 receive extended services from the Department under this section if
9
10 the individual is:
10
11 1. Completing secondary education or a program leading to an
11
12 equivalent credential;
12
13 2. Enrolled in an institution that provides postsecondary or
13
14 career or technical education;
14
15 3. Participating in a program or activity designed to promote
15
16 employment or remove barriers to employment;
16
17 4. Employed for at least eighty (80) hours per month; or
17
18 5. Incapable of doing any of the activities described in
18
19 paragraphs 1 through 4 of this subsection due to a medical condition
19
20 including, but not limited to, an intellectual or developmental
20
21 disability, as supported by regularly updated information in the
21
22 individual's permanency plan. In such a case, the individual shall
22
23 be in compliance with a course of treatment as recommended by the
23
24 Department.

1 C. 1. The Director of Human Services shall promulgate rules to

2 implement the provisions of this section.
2
3 2. The Department of Human Services shall seek available
3
4 funding to implement the provisions of this section.
4
5 SECTION 2. This act shall become effective July 1, 2026.
5
6 SECTION 3. It being immediately necessary for the preservation
6
7 of the public peace, health or safety, an emergency is hereby
7
8 declared to exist, by reason whereof this act shall take effect and
8
9 be in full force from and after its passage and approval.
