7 An Act relating to staffing contracts; defining
7 terms; prohibiting certain staffing contracts with
8 temporary agencies for certain facilities; providing
8 for codification; and providing an effective date.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12 SECTION 1. NEW LAW A new section of law to be codified
12
13 in the Oklahoma Statutes as Section 2-7-301.1 of Title 10A, unless
13
14 there is created a duplication in numbering, reads as follows:

15 A. As used in this section:
15
16 1. "Contracting organization" means an organization which
16
17 operates under a written agreement signed between the Office of
17
18 Juvenile Affairs and the organization which allows such organization
18
19 to provide contract workers, rather than full-time direct-hire
19
20 staff, to detention facilities; and
20
21 2. "Temporary agency" means a staffing agency, part-time
21
22 staffing agency, recruiting agency, or other organization that
22
23 provides employees on a temporary basis.

1 B. No group home, post-adjudication treatment facility, or any
1
2 other facility holding youth operated by the Office of Juvenile
2
3 Affairs shall utilize, employ, or enter into an agreement to staff
3
4 such detention facility by utilizing a contracting organization or
4
5 temporary agency that provides full- or part-time team members on
5
6 behalf of the Office on a temporary or contract basis.

7 SECTION 2. NEW LAW A new section of law to be codified
7
8 in the Oklahoma Statutes as Section 452.3 of Title 19, unless there
8
9 is created a duplication in numbering, reads as follows:

10 A. As used in this section:

11 1. "Contracting organization" means an organization which
11
12 operates under a written agreement signed between the county and the
12
13 organization which allows such organization to provide contract
13
14 workers, rather than full-time direct-hire staff, to detention
14
15 facilities; and
15
16 2. "Temporary agency" means a staffing agency, part-time
16
17 staffing agency, recruiting agency, or other organization that
17
18 provides employees on a temporary basis.

19 B. No county that operates a juvenile detention facility shall
19
20 utilize, employ, or enter into an agreement to staff such detention
20
21 facility by utilizing a contracting organization or temporary agency
21
22 that provides full-time team members to the county on a contract
22
23 basis.

2 in the Oklahoma Statutes as Section 530.9 of Title 56, unless there
2
3 is created a duplication in numbering, reads as follows:

4 A. As used in this section:

5 1. "Contracting organization" means an organization which
5
6 operates under a written agreement signed between an adult companion
6
7 home and the organization which allows such organization to provide
7
8 contract workers, rather than full-time direct-hire staff, to the
8
9 adult companion home; and
9
10 2. "Temporary agency" means a staffing agency, part-time
10
11 staffing agency, recruiting agency, or other organization that
11
12 provides employees on a temporary basis.

13 B. No adult companion home certified by the Department of Human
13
14 Services shall utilize, employ, or enter into an agreement to staff
14
15 such detention facility by utilizing a contracting organization or
15
16 temporary agency that provides full- or part-time team members to
16
17 the Department on a contract basis.

18 SECTION 4. This act shall become effective November 1, 2026.
