7 An Act relating to schools; creating the Federal
7 Education Deregulation Task Force to study and make
8 recommendations regarding federal education funding
8 sources and state and local use of federal funds;
9 providing expiration date; providing for membership;
9 requiring appointments by certain date; requiring
10 organizational meeting by certain date; providing for
10 frequency of meetings; providing for election of
11 chair, vice chair, and secretary; specifying quorum;
11 providing for removal of members; providing for staff
12 support; providing for duties of task force;
12 prohibiting compensation or travel reimbursement for
13 members; requiring electronic submission of certain
13 report by certain date; requiring the report to be
14 posted on certain website; providing for
14 codification; providing an effective date; and
15 declaring an emergency.

18 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

19 SECTION 1. NEW LAW A new section of law to be codified
19
20 in the Oklahoma Statutes as Section 1-130 of Title 70, unless there
20
21 is created a duplication in numbering, reads as follows:
21
22 A. There is hereby created until December 1, 2026, the Federal
22
23 Education Deregulation Task Force to study and make recommendations

1 regarding federal education funding sources and state and local use

2 of federal funds.

3 B. The task force shall be comprised of seven (7) members as
3
4 follows:
4
5 1. Three members of the Senate including:
5
6 a. the chair of the Senate Education Committee or his or
6
7 her designee, and
7
8 b. two members appointed by the President Pro Tempore of
8
9 the Senate;
9
10 2. Three members of the House of Representatives including:
10
11 a. the chair of the House Education Oversight Committee
11
12 or his or her designee, and
12
13 b. two members appointed by the Speaker of the House of
13
14 Representatives; and
14
15 3. One member appointed by the Governor, who shall be a
15
16 certified teacher.
16
17 C. Appointments to the task force shall be made within thirty
17
18 (30) days after the effective date of this act. The task force
18
19 shall conduct an organizational meeting no later than forty (40)
19
20 days after the effective date of this act. The task force may meet
20
21 as often as may be required to perform the duties imposed upon it.
21
22 D. The task force shall elect a chair, vice chair, and
22
23 secretary from among its members.

1 1. The chair shall preside over all meetings, assign aspects of
1
2 the task force's work to members, and ensure timely compliance with
2
3 the provisions of this act.
3
4 2. The vice chair shall fulfill the duties of the chair in his
4
5 or her absence.
5
6 3. The secretary shall be responsible for notifying task force
6
7 members of the date, time, and location of task force meetings,
7
8 securing meeting space, keeping meeting attendance records, taking
8
9 minutes of task force meetings, and compiling and disseminating the
9
10 report required by subsection K of this section.
10
11 E. A quorum of the task force shall be required to approve any
11
12 final action of the task force. For purposes of this section, four
12
13 members shall constitute a quorum.
13
14 F. A member of the task force may be removed by a vote of five
14
15 members and replaced by a member appointed by a majority vote of the
15
16 task force.
16
17 G. The State Department of Education and the public school
17
18 districts in this state shall provide staff support for the task
18
19 force.
19
20 H. The task force shall investigate and identify:
20
21 1. a. all federal funding received by public school
21
22 districts in this state, specifying for each district
22
23 the amount of funds, the federal program under which
23

1 the funds were allocated, their prescribed use, and
1
2 any associated funding conditions or requirements,
2
3 b. all federal funding received by the State Department
3
4 of Education, specifying the amount of funds, the
4
5 federal program under which the funds were allocated,
5
6 their prescribed use, and any associated funding
6
7 conditions or requirements,
7
8 c. all funding received from the United States Department
8
9 of Education by any state or local agency or any
9
10 nonprofit organization, specifying for each agency or
10
11 organization the amount of funds, the federal program
11
12 under which the funds were allocated, their prescribed
12
13 use, and any associated funding conditions or
13
14 requirements, and
14
15 d. any and all federal statutory and regulatory
15
16 requirements, policies, interpretations, funding
16
17 conditions and requirements, directives, or guidance
17
18 from the United States Department of Education that is
18
19 applicable to this state.
19
20 2. The information identified pursuant to paragraph 1 of this
20
21 subsection shall include:
21
22 a. the name of the program or grant associated with any
22
23 maintenance of effort agreements, memorandum of
23
24 understanding agreements, contracts, or consent

1 decrees with any federal agency; any associated start
1
2 and completion dates; and corresponding System for
2
3 Award Management grant numbers,
3
4 b. identification of any federal, state, or local funds
4
5 used to implement multi-tiered systems of support as
5
6 required by federal law including third-party
6
7 partnerships, collaboration agreements, contracts, or
7
8 memorandum of understanding agreements, and
8
9 c. identification of any federal, state, or local funds
9
10 including Medicaid funding used to support health care
10
11 services, mental health services, assessments,
11
12 screenings, and child care services in or through
12
13 public school districts in this state.
13
14 I. For each identification made pursuant to subsection H of
14
15 this section, the task force shall consider the following:
15
16 1. Whether and to what extent the identified item has a
16
17 measurable, demonstrated, beneficial impact on the performance of
17
18 students, the high school graduation rate, student success in and
18
19 completion of postsecondary education, and long-term career success;
19
20 2. Whether the identified item prepares students for a high-
20
21 skill industry sector or occupation, a high-wage sector or
21
22 occupation, an in-demand industry sector or occupation, or other
22
23 careers eligible under federal workforce programs such as the
23

1 Workforce Innovation and Opportunity Act or the Carl D. Perkins
1
2 Career and Technical Education Improvement Act of 2006;
2
3 3. How the identified item complies with school district, state
3
4 or local agency, or State Department of Education strategic plans;
4
5 4. Any specific state statutory or judicial authorization
5
6 related to the identified item and any changes in existing state
6
7 policies or procedures that would be necessary if the identified
7
8 item were eliminated at the federal level;
8
9 5. Whether the identified item conflicts with any statutory or
9
10 administrative policies of this state;
10
11 6. The number of federally funded full- and part-time positions
11
12 necessary to carry out the identified item;
12
13 7. A description of all resources and obligations related to
13
14 the identified item;
14
15 8. Whether the identified item should be replaced at the state
15
16 level if it is eliminated at the federal level, taking into
16
17 consideration the costs and benefits of the identified item; and
17
18 9. Any recommended mechanisms for state-level replacement of
18
19 identified items at the federal level.
19
20 J. Members of the task force shall receive no compensation or
20
21 travel reimbursement.
21
22 K. The task force shall electronically submit a report of its
22
23 findings and recommendations by December 1, 2026, to the Governor,
23
24 the President Pro Tempore of the Senate, and the Speaker of the

1 House of Representatives. The report shall be posted on the
1
2 Legislature's website in a manner and location that is easily
2
3 accessible to the public.
3
4 SECTION 2. This act shall become effective July 1, 2026.
4
5 SECTION 3. It being immediately necessary for the preservation
5
6 of the public peace, health, or safety, an emergency is hereby
6
7 declared to exist, by reason whereof this act shall take effect and
7
8 be in full force from and after its passage and approval.
