7 An Act relating to state government; directing state
7 agencies to maintain motor vehicle fleet; amending 74
8 O.S. 2021, Sections 78d, as amended by Section 2,
8 Chapter 351, O.S.L. 2023, 85.5a, and 110.3 (74 O.S.
9 Supp. 2024, Section 78d), which relate to state
9 governmental functions; directing agencies to
10 electronically report certain information to certain
10 officials; conforming language; updating statutory
11 language; updating statutory reference; repealing 74
11 O.S. 2021, Sections 78, as amended by Section 1,
12 Chapter 351, O.S.L. 2023, 78a, 78b, 78c, 78e, 78f,
12 80.1, and 3317 (74 O.S. Supp. 2024, Section 78),
13 which relate to the State Fleet Management Division;
13 providing for codification; providing an effective
14 date; and declaring an emergency.

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
16
17 SECTION 1. NEW LAW A new section of law to be codified
17
18 in the Oklahoma Statutes as Section 80 of Title 74, unless there is
18
19 created a duplication in numbering, reads as follows:
19
20 On and after the effective date of this act, all state agencies
20
21 that own, operate, and utilize motor vehicles in this state shall be
21
22 responsible for the purchase, management, and maintenance of motor
22
23 vehicles for the agency. Each agency shall promulgate rules,
23
24 develop a plan for routine maintenance and inspection, and maintain

1 accurate recordkeeping for all motor vehicles within the fleet for

2 reporting as prescribed by law.

3 SECTION 2. AMENDATORY 74 O.S. 2021, Section 78d, as
3
4 amended by Section 2, Chapter 351, O.S.L. 2023 (74 O.S. Supp. 2024,
4
5 Section 78d), is amended to read as follows:
5
6 Section 78d. The Fleet Management Division Each state agency
6
7 which maintains inventory of motor vehicles shall furnish to the
7
8 Governor, President Pro Tempore of the Senate, and the Speaker of
8
9 the House of Representatives, at the close of each fiscal year a
9
10 statement showing the financial condition of the Division, an
10
11 inventory of all motor vehicles regardless of exemption or oversight
11
12 status, an electronic report providing information on motor vehicle
12
13 fleet inventory, maintenance records, financial data, and such other
13
14 information regarding the state motor vehicle transportation system
14
15 as is necessary for a proper understanding of the operation of such
15
16 system and of the and financial condition of the motor pool
16
17 operations vehicle fleet of the agency.

18 SECTION 3. AMENDATORY 74 O.S. 2021, Section 85.5a, is
18
19 amended to read as follows:
19
20 Section 85.5a. A. Except for the state fleet card, the The
20
21 state purchase card program administered by the Purchasing Division
21
22 is the only card program authorized for use by state agencies.
22
23 B. On a monthly basis the State Purchasing Director and
23
24 institutions of higher education shall provide to the Director of

1 the Office of Management and Enterprise Services (OMES) a complete
1
2 listing in electronic format of all transactions paid by a state
2
3 purchase card. The list shall contain the name of the purchaser and
3
4 purchasing agency, amount of purchase, and all available
4
5 descriptions of items purchased.
5
6 C. Upon receipt of the list described in subsection B of this
6
7 section, the Director of the OMES shall allow the public access to
7
8 the list in searchable format through its website defined in Section
8
9 46 of Title 62 of the Oklahoma Statutes.
9
10 D. The State Purchasing Director may authorize the use of a
10
11 state purchase card for acquisitions within the following
11
12 parameters:
12
13 1. No limit on the amount of the transaction for the following:
13
14 a. purchases from statewide contracts and from contracts
14
15 awarded by the State Purchasing Director for the
15
16 benefit of a state agency,
16
17 b. utilities,
17
18 c. interagency payments,
18
19 d. emergency acquisitions; provided, requirements to
19
20 establish an emergency pursuant to Section 5 85.41A of
20
21 this act title or other applicable statute or rule
21
22 have been met, and
22
23 e. professional services as defined in Section 803 of
23
24 Title 18 of the Oklahoma Statutes; and

1 2. For any other transaction with a state purchase card, the
1
2 transaction shall not exceed the greater of Five Thousand Dollars
2
3 ($5,000.00) or the limit determined by the State Purchasing
3
4 Director, not to exceed the fair and reasonable acquisition
4
5 threshold amount.

6 E. The State Purchasing Director may authorize personnel of the
6
7 Oklahoma Department of Commerce, upon a finding by the Secretary of
7
8 Commerce that such personnel have a legitimate need therefore, to
8
9 utilize a state purchase card for acquisitions for programs,
9
10 functions, or services essential to the mission of the agency while
10
11 traveling on Oklahoma Department of Commerce business in foreign
11
12 locations with transaction limits not to exceed Thirty-five Thousand
12
13 Dollars ($35,000.00). The purchase cardholders are required to sign
13
14 a purchase card agreement prior to becoming a cardholder cardholders
14
15 and to attend purchase card procedure training. The Oklahoma
15
16 Department of Commerce will conduct quarterly internal auditing on
16
17 all purchase card transactions associated with business and travel
17
18 in foreign locations.

19 SECTION 4. AMENDATORY 74 O.S. 2021, Section 110.3, is
19
20 amended to read as follows:
20
21 Section 110.3. A. All state agencies shall maintain inventory
21
22 records of its their motor vehicles. The records shall include:
22
23 1. A detailed description of each vehicle, including its
23
24 original cost;

1 2. The vehicle identification number;

2 3. The license tag number;
2
3 4. The make, model, and year of the vehicle; and
3
4 5. A designation of loaned or leased vehicles and the name of
4
5 the vendor.

6 B. Each state agency regardless of the exceptions granted in
6
7 Section 78 of this title shall provide motor vehicle inventory
7
8 records to the Office of Management and Enterprise Services at such
8
9 times as may be requested by the Fleet Management Division of the
9
10 Office of Management and Enterprise Services.

11 SECTION 5. REPEALER 74 O.S. 2021, Sections 78, as
11
12 amended by Section 1, Chapter 351, O.S.L. 2023, 78a, 78b, 78c, 78e,
12
13 78f, 80.1, and 3317 (74 O.S. Supp. 2024, Section 78), are hereby
13
14 repealed.
14
15 SECTION 6. This act shall become effective July 1, 2025.
15
16 SECTION 7. It being immediately necessary for the preservation
16
17 of the public peace, health or safety, an emergency is hereby
17
18 declared to exist, by reason whereof this act shall take effect and
18
19 be in full force from and after its passage and approval.
