7 An Act relating to the Oklahoma Open Meeting Act;
7 creating the First Amendment Open Meeting Protection
8 Act; providing short title; amending 25 O.S. 2021,
8 Section 312, which relates to recording of open
9 meetings; updating statutory reference; clarifying
9 when recordings may be prohibited; providing for
10 civil action; updating statutory language; providing
10 for noncodification; and declaring an emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law not to be
14
15 codified in the Oklahoma Statutes reads as follows:
15
16 This act shall be known and may be cited as the "First Amendment
16
17 Open Meeting Protection Act".
17
18 SECTION 2. AMENDATORY 25 O.S. 2021, Section 312, is
18
19 amended to read as follows:

20 Section 312. A. The proceedings of a public body shall be kept
20
21 by a person so designated by such public body in the form of written
21
22 minutes which shall be an official summary of the proceedings
22
23 showing clearly those members present and absent, all matters
23
24 considered by the public body, and all actions taken by such public

1 body. The minutes of each meeting shall be open to public

2 inspection and shall reflect the manner and time of notice required
2
3 by this act Section 301 et seq. of this title.

4 B. In the written minutes of an emergency meeting, the nature
4
5 of the emergency and the proceedings occurring at such meeting,
5
6 including reasons for declaring such emergency meeting, shall be
6
7 included.

8 C. Any No public body or its members, officers, or staff, nor
8
9 any law enforcement officer or security personnel, present at a
9
10 public meeting shall prohibit any person attending a public meeting
10
11 may record from recording the proceedings of said the meeting by
11
12 videotape video recording, audiotape audio recording, or by any
12
13 other method; providing provided, however, such recording shall not
13
14 interfere with the conduct of the meeting.
14
15 D. In addition to penalties described in subsection B of
15
16 Section 314 of this title, any person who is unlawfully prohibited
16
17 from recording a public meeting in accordance with this section may
17
18 bring a civil action for monetary damages, if applicable.
18
19 SECTION 3. It being immediately necessary for the preservation
19
20 of the public peace, health or safety, an emergency is hereby
20
21 declared to exist, by reason whereof this act shall take effect and
21
22 be in full force from and after its passage and approval.
