7 An Act relating to vehicle registration; creating
7 certain fee to be imposed on certain vehicles;
8 providing for deposit of certain monies; authorizing
8 Corporation Commission to promulgate certain rules;
9 creating the Uninsured Commercial Vehicle Recovery
9 Reimbursement Fund; stating purpose of fund;
10 directing certain deposits and expenditures;
10 providing for codification; providing an effective
11 date; and declaring an emergency.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. NEW LAW A new section of law to be codified
15
16 in the Oklahoma Statutes as Section 1120.3 of Title 47, unless there
16
17 is created a duplication in numbering, reads as follows:
17
18 A. In addition to taxes and fees imposed by the Corporation
18
19 Commission pursuant to the provisions of Section 1120 of Title 47 of
19
20 the Oklahoma Statutes, the Commission shall impose a fee of One
20
21 Hundred Dollars ($100.00) on all vehicles registered under the
21
22 International Registration Plan that report mileage in this state.
22
23 B. 1. Five percent (5%) of all monies collected through the
23
24 fee imposed in subsection A of this section shall be deposited in

1 the Uninsured Commercial Vehicle Recovery Reimbursement Fund created

2 in Section 2 of this act.

3 2. Ninety-five percent (95%) of all monies collected through
3
4 the fee imposed in subsection A of this section shall be deposited
4
5 in the Rebuilding Oklahoma Access and Driver Safety Fund created in
5
6 Section 1521 of Title 69 of the Oklahoma Statutes.

7 C. The Corporation Commission shall promulgate rules to
7
8 effectuate the provisions of this section.
8
9 SECTION 2. NEW LAW A new section of law to be codified
9
10 in the Oklahoma Statutes as Section 1120.4 of Title 47, unless there
10
11 is created a duplication in numbering, reads as follows:
11
12 There is hereby created in the State Treasury a revolving fund
12
13 for the Corporation Commission to be designated the "Uninsured
13
14 Commercial Vehicle Recovery Reimbursement Fund". The fund shall be
14
15 a continuing fund, not subject to fiscal year limitations, and shall
15
16 consist of all monies directed to be deposited in the fund pursuant
16
17 to Section 1 of this act for the purpose of reimbursing wrecker and
17
18 tower operators who provide nonconsensual tow services to uninsured
18
19 commercial vehicles. All monies accruing to the credit of the fund
19
20 are hereby appropriated and may be budgeted and expended by the
20
21 Commission for the purpose provided in this section. Expenditures
21
22 from the fund shall be made upon warrants issued by the State
22
23 Treasurer against claims filed as prescribed by law with the

1 Director of the Office of Management and Enterprise Services for

2 approval and payment.

3 SECTION 3. This act shall become effective July 1, 2025.

4 SECTION 4. It being immediately necessary for the preservation
4
5 of the public peace, health or safety, an emergency is hereby
5
6 declared to exist, by reason whereof this act shall take effect and
6
7 be in full force from and after its passage and approval.
