17 SECTION 1. AMENDATORY 59 O.S. 2021, Section 858-625, is
17
18 amended to read as follows:
18

7 SECTION 2. AMENDATORY 59 O.S. 2021, Section 1000.5, is
7
8 amended to read as follows:
8
9 Section 1000.5. A. The Construction Industries Board may
9
10 establish a system of fees by rule to be charged for the application
10
11 for licenses, for the issuance and renewal of licenses and permits,
11
12 for administration of examinations, for formal project reviews and
12
13 dishonored checks under the Board's authority. This provision is
13
14 subject to the following limitations:
14
15 1. No schedule of fees may be established or amended by the
15
16 Board except during such times as the Legislature is in session;
16
17 provided, the Board may establish or amend a schedule of fees at a
17
18 time when the Legislature is not in session if the fees or schedule
18
19 of fees has been specifically authorized by the Legislature pursuant
19
20 to paragraph 2 of this subsection. The Board must follow the
20
21 procedures required by Article I of the Administrative Procedures
21
22 Act for adoption of rules in establishing or amending any such
22
23 schedule of fees; and

1 2. The Board shall charge fees only within the following ranges

2 as follows, except as may be otherwise specified in this section or

3 another provision of law.:

17 5. The Board shall charge fees for home inspection industry

1 6. The Board shall charge a fee of Fifty-five Dollars ($55.00)
1
2 for the initial issuance or renewal of a license for building,
2
3 electrical, mechanical, plumbing, or energy code inspectors; and
3
4 7. The Board shall charge a fee of Four Hundred Eighty Dollars
4
5 ($480.00) for an initial poultry house contractor license and Three
5
6 Hundred Twenty Dollars ($320.00) for a renewal poultry house
6
7 contractor license.
7
8 B. The Board shall base its schedule of fees upon the
8
9 reasonable costs of review and inspection services rendered in
9
10 connection with each license, permit, or review, but such fees shall
10
11 be within the ranges specified in paragraph 2 of subsection A of
11
12 this section, except as otherwise specified in this section or as
12
13 provided by law. The Board shall establish a system of training for
13
14 all personnel who render review and inspection services in order to
14
15 assure uniform statewide application of rules. The Board shall
15
16 include the reasonable costs associated with such training in the
16
17 fees provided for in this section.
17
18 C. The Board may exempt by rule any class of licensee or
18
19 permittee from the requirements of the fee schedule if the Board
19
20 determines that the creation of such a schedule for any such class
20
21 would create an unreasonable economic hardship.
21
22 D. All fee changes adopted by the Board shall be reviewed and
22
23 approved as provided in subsection F of Section 308 of Title 75 of
23
24 the Oklahoma Statutes.

1 E. Unless otherwise provided, licenses and permits issued by
1
2 the Construction Industries Board shall be for a one-year period.
2
3 F. When, at the time of application or renewal of any license
3
4 or registration, payment is made by check for fees and the check is
4
5 not paid by the bank on which drawn for any reason, such license or
5
6 registration issued at that time shall be invalid. In all such
6
7 cases, the license or registration shall be subject to the license
7
8 or registration fees and penalties provided in subsection A of this
8
9 section or another provision of law and treated as though no attempt
9
10 to apply for or renew a license or registration had been made. The
10
11 Board may charge and collect from the licensee, registrant, or other
11
12 obligor of fees or fines, a fee for each return by a bank or other
12
13 depository institution of a dishonored check, negotiable order of
13
14 withdrawal, or share draft issued by the licensee, registrant, or
14
15 other obligor.
15
16 SECTION 3. AMENDATORY 59 O.S. 2021, Section 1151.8, is
16
17 amended to read as follows:
17
18 Section 1151.8. A. At the time of making application for a
18
19 roofing contractor registration certificate pursuant to the Roofing
19
20 Contractor Registration Act, the applicant shall pay to the
20
21 registrar a the applicable fee of Seventy-five Dollars ($75.00) set
21
22 forth in Section 1000.5 of this title for the annual registration
22
23 certificate.

1 B. All monies collected by the registrar for roofing contractor
1
2 registration applications, renewals, and other fee assessments shall
2
3 be deposited by the registrar and credited to the Roofing Contractor
3
4 Registration Revolving Fund and such funds shall be used by the
4
5 registrar to implement and administer the provisions of the Roofing
5
6 Contractor Registration Act.
6
7 C. The fee to be submitted with an application for a roofing
7
8 contractor registration may be prorated as set by the provisions of
8
9 the Roofing Contractor Registration Act or rules. Unless prorated
9
10 at the time of initial registration, fees for initial registration
10
11 shall be paid in the amount stated in subsection A of this section
11
12 set forth in Section 1000.5 of this title and such registration
12
13 certificates shall expire each year on the last day of the birth
13
14 month of the qualifying party. Renewals will be prorated as
14
15 provided in Section 1151.3 1151.10 of this title.
15
16 D. A The renewal fee for a roofing contractor registration
16
17 shall be Seventy-five Dollars ($75.00) set forth in Section 1000.5
17
18 of this title for the annual renewal registration certificate.
18
19 SECTION 4. AMENDATORY 59 O.S. 2021, Section 1151.10, as
19
20 amended by Section 3, Chapter 368, O.S.L. 2025 (59 O.S. Supp. 2025,
20
21 Section 1151.10) is amended to read as follows:
21
22 Section 1151.10. A. Within twenty-five (25) calendar days from
22
23 the date of application, the registrar shall either issue or deny
23
24 the roofing contractor registration. No registration shall be

1 issued to a qualifying party until the registrar receives all
1
2 documentation and fees necessary to obtain a registration
2
3 certificate in good standing. The registration certificate issued
3
4 on an original application entitles the person to act as a roofing
4
5 contractor within this state, subject to the limitations of the
5
6 Roofing Contractor Registration Act. Until January 1, 2015, all
6
7 registrations shall expire on June 30 of each year and may be
7
8 renewed from year to year. Beginning no later than January 1, 2015,
8
9 all registrations issued shall be renewed based on staggered
9
10 expiration dates of the last day of the birth month of the
10
11 qualifying party so that all registrations and endorsements shall
11
12 expire on the last day in the birth month of the qualifying party.
12
13 The Construction Industries Board is authorized to prorate
13
14 registration and renewal fees, as described by rule, so that
14
15 beginning January 1, 2015, or thirty (30) days after rules have been
15
16 approved, fees for renewals previously due by June 30, 2015, are
16
17 prorated and converted to be due the last day of the birth month of
17
18 the qualifying party by shortening or lengthening the next renewal
18
19 date by up to six (6) months. Beginning November 1,2014 November 1,
19
20 2014, new initial registrations and endorsements will be issued for
20
21 up to eighteen (18) months and due for renewal the last day of the
21
22 birth month of the qualifying party. After initial proration or
22
23 conversion to birth month, no subsequent registration or endorsement
23
24 shall be issued for longer than one (1) year and all endorsements

1 shall expire on the last day in the birth month of the qualifying
1
2 party. The Construction Industries Board shall implement rules for
2
3 the scheduling of expiration and renewal of registrations and
3
4 endorsements, including the prorating of fees and the identification
4
5 and information of the qualifying party. The commercial or
5
6 residential roofer endorsement shall expire on the expiration date
6
7 of the supporting registration.
7
8 B. An applicant or qualifying party whose registration or
8
9 endorsement is refused or denied by the registrar may obtain a
9
10 hearing before the Committee of Roofing Examiners with written
10
11 notice to the registrar of the grounds for appeal and identification
11
12 of evidence to be presented in support of the application
12
13 requirements and any other information showing the applicant's
13
14 ability and willingness to comply with the requirements of the act,
14
15 and to protect the public health, safety, and welfare. Such appeals
15
16 to the Committee of Roofing Examiners shall be made by the
16
17 qualifying party in writing to the registrar within fourteen (14)
17
18 days from the date of the written notification of denial or refusal
18
19 to register or endorse.
19
20 C. The Construction Industries Board shall issue a commercial
20
21 or residential roofer endorsement to any person who:
21
22 1. Has been certified by the Committee of Roofing Examiners as
22
23 having successfully passed the appropriate examination; and
23

1 2. Has paid the application and endorsement fee and has
1
2 otherwise complied with all of the provisions of the commercial or
2
3 residential roofer endorsement of the Roofing Contractor
3
4 Registration Act. The endorsement fee is hereby established as up
4
5 to Two Hundred Dollars ($200.00) shall be in the amount set forth in
5
6 Section 1000.5 of this title. Renewal of a commercial or
6
7 residential roofer endorsement shall be One Hundred Dollars
7
8 ($100.00) in the amount set forth in Section 1000.5 of this title.
8
9 Endorsements renewed more than thirty (30) days following the
9
10 date of expiration may only be renewed upon application and payment
10
11 of the required fees and payment of late renewal fee in the amount
11
12 of One Hundred Dollars ($100.00).
12
13 No endorsement shall be renewed unless the licensee has
13
14 completed the required hours of continuing education recommended by
14
15 the Committee and set forth by rule.
15
16 No late fee shall be charged to renew a registration or
16
17 endorsement which expired while the applicant was in active military
17
18 service, if application for renewal is made within one (1) year of
18
19 discharge from active duty status.
19
20 SECTION 5. AMENDATORY 59 O.S. 2021, Section 1686.1, is
20
21 amended to read as follows:
21
22 Section 1686.1. A. The Construction Industries Board is hereby
22
23 authorized to establish a license category for contractors who
23
24 solely perform poultry house premise wiring for environmentally
24

1 controlled poultry house systems, and the insured poultry house
1
2 wiring to connect the premise wiring, and who do not perform any
2
3 wiring for a structure or electrical facility that is not directly
3
4 involved in the operation of the environmentally controlled poultry
4
5 house wiring system. In addition to other statutory authority, the
5
6 Construction Industries Board shall have the power to exercise all
6
7 incidental powers and duties necessary to effectuate the provisions
7
8 of the poultry house contractor license, conduct investigations
8
9 involving compliance with the licensing requirements, and enforce
9
10 the licensing provisions of this section. However, the Construction
10
11 Industries Board is not authorized to conduct an electrical code
11
12 inspection of an environmentally controlled poultry house premise
12
13 wiring system for purposes of compliance with electrical code
13
14 installation standards established for the Electrical License Act or
14
15 to issue administrative citations or fines concerning electrical
15
16 code installation standards at an environmentally controlled poultry
16
17 house.
17
18 1. With a valid poultry house contractor license, no further
18
19 registration or license is required under this act the Electrical
19
20 License Act in order to solely perform poultry house wiring for
20
21 environmentally controlled poultry houses. This license allows
21
22 contracting only for wiring of environmentally controlled poultry
22
23 house systems and is not intended to disallow or exclude unlimited
23
24 electrical contractors from performing poultry house wiring work

1 under an unlimited electrical contractor license without a poultry
1
2 house contractor license.
2
3 2. Experience under the poultry house contractor license shall
3
4 not be considered qualifying electrical experience for purposes of
4
5 experience requirements for application of any other electrical
5
6 license category pursuant to the Electrical License Act.
6
7 3. The Board may rely upon proof of a valid construction
7
8 license or registration issued by another state to expedite the
8
9 processing of the required information for a poultry house
9
10 contractor license; provided, the insurance and workers'
10
11 compensation requirements demonstrate compliance with the required
11
12 coverage for work performed in this state.
12
13 4. All licenses shall be nontransferable, and it shall be a
13
14 misdemeanor for any business entity holding a poultry house
14
15 contractor license under the provisions of the Electrical License
15
16 Act to loan or allow the use of such license by any other person,
16
17 firm, or corporation, except as specifically provided in the
17
18 Electrical License Act or to engage in poultry house contractor
18
19 license work without a valid license pursuant to this act the
19
20 Electrical License Act.
20
21 B. A nonrefundable fee in the amount of Three Hundred Dollars
21
22 ($300.00) set forth in Section 1000.5 of this title for the annual
22
23 poultry house contractor license shall be paid at the time of
23
24 license application to the Construction Industries Board. The

1 annual license shall expire one (1) year from the date of issuance.

2 A poultry house contractor license shall be issued for one (1) year,
2
3 at which time it may be renewed upon meeting the requirements of
3
4 this section, making application, and paying the nonrefundable
4
5 license renewal fee in the amount of Two Hundred Dollars ($200.00)
5
6 set forth in Section 1000.5 of this title.
6
7 C. The Construction Industries Board shall, upon proper
7
8 application and payment of fee, license and issue a certificate of
8
9 poultry house contractor license to any person who furnishes
9
10 satisfactory proof to the Board that the applicant:
10
11 1. Is eighteen (18) years of age or over;
11
12 2. Is the party performing, overseeing, or otherwise
12
13 responsible for the poultry house contractor work performed and who
13
14 meets all requirements of this act the Electrical License Act and
14
15 resulting rules required to obtain such license; and
15
16 3. Has provided all necessary information and documentation
16
17 required under this act the Electrical License Act, the resulting
17
18 rules, and as requested by the Board.
18
19 D. The Construction Industries Board shall require the
19
20 following for a poultry house contractor license:
20
21 1. The applicant's full legal name, physical address, mailing
21
22 address, business name, telephone number of business and applicant,
22
23 address and place of incorporation, if any, and address of legal
23
24 registered service agent in this state;

1 2. Proof of lawful presence in the United States for the
1
2 applicant and all employees and laborers working under the applicant
2
3 in this state who will be involved in wiring a poultry house for
3
4 environmentally controlled poultry houses;
4
5 3. A listing of the names and social security numbers of all
5
6 employees and laborers working in this state who will be involved in
6
7 wiring a poultry house for environmentally controlled poultry
7
8 houses. The social security number information shall remain with
8
9 the Board as confidential and privileged except for necessary
9
10 disclosures to state agencies to verify compliance with requirements
10
11 of this act the Electrical License Act or upon request by law
11
12 enforcement;
12
13 4. The business entity's federal tax ID number or the
13
14 employer's or owner's social security number. The and the
14
15 employer's account number assigned by the Employment Security
15
16 Commission. The social security number information shall remain
16
17 with the Board as confidential and privileged except for necessary
17
18 disclosures to state agencies to verify compliance with requirements
18
19 of this act the Electrical License Act or upon request by law
19
20 enforcement;
20
21 5. A letter of good standing from the Secretary of State in the
21
22 state the contractor is domiciled and other documentation of valid
22
23 license or registration from the domicile state licensing or
23
24 registration board, commission, or agency;

1 6. Disclosure of resident or nonresident contractor status, and
1
2 state of residence and domicile;
2
3 7. A copy of the applicant's certificate of liability insurance
3
4 shall be filed with the application and shall be not less than Five
4
5 Hundred Thousand Dollars ($500,000.00). Any insurance company
5
6 issuing a liability policy to an applicant pursuant to the
6
7 provisions of the poultry house contractor license under this act
7
8 the Electrical License Act shall be required to notify the
8
9 Construction Industries Board in the event such liability policy is
9
10 cancelled canceled for any reason or lapses for nonpayment of
10
11 premiums. All licenses granted under this act the Electrical
11
12 License Act shall be suspended on the date of the policy
12
13 cancellation. The Board must receive proof of insurance prior to
13
14 reinstating the license;
14
15 8. The applicant shall submit proof Proof of satisfactory
15
16 workers' compensation coverage under the Administrative Workers'
16
17 Compensation Act or an affidavit of exemption or self-insurance as
17
18 authorized pursuant to the Administrative Workers' Compensation Act;
18
19 9. Disclosure of any felony convictions; and
19
20 10. Applicants for poultry house contractor license shall
20
21 provide such additional Additional documents, statements, or other
21
22 information as may be deemed appropriate or necessary and required
22
23 by the Board.

1 E. The Construction Industries Board shall refuse to license
1
2 any person if the Board determines:
2
3 1. The application contains false, misleading, or incomplete
3
4 information;
4
5 2. The applicant or any member of the business entity fails or
5
6 refuses to provide any information requested by the Board;
6
7 3. The applicant fails or refuses to pay the required fees;
7
8 4. The applicant or owner or officer or managing member of the
8
9 legal entity is ineligible for license due to a suspended or revoked
9
10 license or registration in this state;
10
11 5. The nonresident applicant has a revoked or suspended
11
12 registration or license required by law for contractors in another
12
13 state; or
13
14 6. The applicant or legal entity has failed or refuses to
14
15 submit any taxes due in this state.
15
16 F. The Board shall suspend the poultry house contractor license
16
17 when the licensee fails to:
17
18 1. Maintain liability insurance coverage;
18
19 2. Maintain satisfactory workers' compensation coverage under
19
20 the Administrative Workers' Compensation Act or provide an affidavit
20
21 of exemption or self-insurance as authorized pursuant to the
21
22 Administrative Workers' Compensation Act;
22
23 3. Comply with provisions of the Electrical License Act or any
23
24 rule or order issued pursuant thereto;

1 4. Perform normal business obligations without justifiable
1
2 cause;
2
3 5. Notify the Board of a change in name, address, legal
3
4 business entity, legal service agent, adverse finding by a licensing
4
5 entity in this state or another state or adjudication by a court of
5
6 competent jurisdiction for any act or omission that is a violation
6
7 of the Electrical License Act;
7
8 6. Maintain a registration or license as required by law in
8
9 another state while licensed in this state as a nonresident
9
10 contractor; or
10
11 7. File and pay all taxes of the contractor or legal entity
11
12 when due in this state.
12
13 SECTION 6. This act shall become effective July 1, 2028.
