9 modifying certain apportionment; creating the
9 Municipal Improvements for Roads and Bridges Fund;
10 providing for distribution of certain monies for
10 certain purposes; directing promulgation of rules by
11 the Transportation Commission; updating statutory
11 references; providing for codification; providing an
12 effective date; and declaring an emergency.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
15
16 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1104, as
16
17 last amended by Section 1, Chapter 442, O.S.L. 2024 (47 O.S. Supp.
17
18 2024, Section 1104), is amended to read as follows:
18
19 Section 1104. A. Unless otherwise provided by law, all fees,
19
20 taxes, and penalties collected or received pursuant to the Oklahoma
20
21 Vehicle License and Registration Act or Section 1-101 et seq. of
21
22 this title shall be apportioned and distributed monthly by the
22
23 Oklahoma Tax Commission in accordance with this section. Service
23
24 Oklahoma shall provide to the Oklahoma Tax Commission monthly

1 reports of motor vehicle collection information, including, but not
1
2 limited to, motor vehicle monthly apportionment information,
2
3 refunds, canceled vouchers, waste tire collections, organ donor
3
4 program amounts, driver license records, prorate amounts, and sales
4
5 tax amounts. The reports shall be delivered electronically pursuant
5
6 to the current calendar year apportionment disbursement schedule
6
7 provided to Service Oklahoma by the Oklahoma Tax Commission on or
7
8 before December 1st annually.
8
9 One percent (1%) of fees collected shall be apportioned to the
9
10 Licensed Operator Performance Fund created in Section 3-106 of this
10
11 title, in accordance with the applicable metrics determined by
11
12 Service Oklahoma.
12
13 B. 1. The following percentages of the monies referred to in
13
14 subsection A of this section shall be apportioned to the various
14
15 school districts in accordance with paragraph 2 of this subsection:
15
16 a. from October 1, 2000, until June 30, 2001, thirty-five
16
17 and forty-six one-hundredths percent (35.46%),
17
18 b. for the year beginning July 1, 2001, and ending June
18
19 30, 2002, thirty-five and ninety-one one-hundredths
19
20 percent (35.91%),
20
21 c. for the year beginning July 1, 2002, through the year
21
22 ending on June 30, 2015, thirty-six and twenty one-
22
23 hundredths percent (36.20%),

1 d. for the year beginning July 1, 2015, through the year
1
2 ending on June 30, 2019, thirty-six and twenty one-
2
3 hundredths percent (36.20%), but in no event shall the
3
4 amount apportioned in any fiscal year pursuant to this
4
5 subparagraph exceed the total amount apportioned for
5
6 the fiscal year ending on June 30, 2015. Any amounts
6
7 in excess of such limitation shall be placed to the
7
8 credit of the General Revenue Fund, and
8
9 e. for the year beginning July 1, 2019, and all
9
10 subsequent years, thirty-six and twenty one-hundredths
10
11 percent (36.20%), but in no event shall the amount
11
12 apportioned in any fiscal year pursuant to this
12
13 subparagraph exceed the total amount apportioned for
13
14 the fiscal year ending on June 30, 2015. Any amounts
14
15 in excess of such limitation shall be placed to the
15
16 credit of the Rebuilding Oklahoma Access and Driver
16
17 Safety Municipal Improvements for Roads and Bridges
17
18 Fund created in Section 1521 2 of Title 69 of the
18
19 Oklahoma Statutes this act.
19
20 2. The monies apportioned pursuant to subparagraphs a through e
20
21 of paragraph 1 of this subsection shall be apportioned to the
21
22 various school districts so that each district shall receive an
22
23 amount based upon the proportion that each district's average daily
23
24 attendance bears to the total average daily attendance of those
24

1 districts entitled to receive funds pursuant to this section as
1
2 certified by the State Department of Education.
2
3 Each district's allocation of funds shall be remitted to the
3
4 county treasurer of the county wherein the administrative
4
5 headquarters of the district are located.
5
6 No district shall be eligible for the funds herein provided
6
7 unless the district makes an ad valorem tax levy of fifteen (15)
7
8 mills and maintains nine (9) years of instruction and pursuant to
8
9 the rules of the State Board of Education, is authorized to maintain
9
10 ten (10) years of instruction.
10
11 C. The following percentages of the monies referred to in
11
12 subsection A of this section shall be remitted to the State
12
13 Treasurer to be credited to the General Revenue Fund of the State
13
14 Treasury:
14
15 1. From October 1, 2000, until June 30, 2001, forty-five and
15
16 ninety-seven one-hundredths percent (45.97%);
16
17 2. For the year beginning July 1, 2001, and ending June 30,
17
18 2002, forty-five and twenty-nine one-hundredths percent (45.29%);
18
19 3. For the year beginning July 1, 2002, and for the subsequent
19
20 fiscal years ending June 30, 2007, forty-four and eighty-four one-
20
21 hundredths percent (44.84%);
21
22 4. For the year beginning July 1, 2007, and ending June 30,
22
23 2008, thirty-nine and eighty-four one-hundredths percent (39.84%);

1 5. For the year beginning July 1, 2008, and ending June 30,

2 2009, thirty-four and eighty-four one-hundredths percent (34.84%);

3 6. For the period beginning July 1, 2009, and ending December

6 7. For the period beginning January 1, 2013, and ending June

7 30, 2013, twenty-nine and thirty-four one-hundredths percent

8 (29.34%);

9 8. For the year beginning July 1, 2013, and ending June 30,

10 2014, twenty-six and eighty-four one-hundredths percent (26.84%);

12 9. For the year beginning July 1, 2014, through the year ending
12
13 June 30, 2019, twenty-four and eighty-four one-hundredths percent

14 (24.84%).

15 D. The following percentages of the monies referred to in
15
16 subsection A of this section shall be remitted to the State
16
17 Treasurer to be credited to the State Transportation Fund:
17
18 1. From October 1, 2000, until June 30, 2001, thirty one-
18
19 hundredths percent (0.30%);
19
20 2. For the year beginning July 1, 2001, through the year ending
20
21 on June 30, 2015, thirty-one one-hundredths percent (0.31%);
21
22 3. For the year beginning July 1, 2015, through the year ending
22
23 on June 30, 2019, thirty-one one-hundredths percent (0.31%), but in
23
24 no event shall the amount apportioned in any fiscal year pursuant to

1 this paragraph exceed the total amount apportioned for the fiscal
1
2 year ending on June 30, 2015. Any amounts in excess of such
2
3 limitation shall be placed to the credit of the General Revenue
3
4 Fund; and
4
5 4. For the year beginning July 1, 2019, and all subsequent
5
6 years, thirty-one one-hundredths percent (0.31%), but in no event
6
7 shall the amount apportioned in any fiscal year pursuant to this
7
8 paragraph exceed the total amount apportioned for the fiscal year
8
9 ending on June 30, 2015. Any amounts in excess of such limitation
9
10 shall be placed to the credit of the Rebuilding Oklahoma Access and
10
11 Driver Safety Municipal Improvements for Roads and Bridges Fund
11
12 created in Section 1521 2 of Title 69 of the Oklahoma Statutes this
12
13 act.
13
14 E. 1. The following percentages of the monies referred to in
14
15 subsection A of this section shall be apportioned to the various
15
16 counties as set forth in paragraph 2 of this subsection:
16
17 a. from October 1, 2000, until June 30, 2001, seven and
17
18 nine one-hundredths percent (7.09%),
18
19 b. for the year beginning July 1, 2001, and ending June
19
20 30, 2002, seven and eighteen one-hundredths percent
20
21 (7.18%),
21
22 c. for the year beginning July 1, 2002, through the year
22
23 ending on June 30, 2015, seven and twenty-four one-
23
24 hundredths percent (7.24%),

1 d. for the year beginning July 1, 2015, through the year
1
2 ending on June 30, 2019, seven and twenty-four one-
2
3 hundredths percent (7.24%), but in no event shall the
3
4 amount apportioned in any fiscal year pursuant to this
4
5 subparagraph exceed the total amount apportioned for
5
6 the fiscal year ending on June 30, 2015. Any amounts
6
7 in excess of such limitation shall be placed to the
7
8 credit of the General Revenue Fund, and
8
9 e. for the year beginning July 1, 2019, and all
9
10 subsequent years, seven and twenty-four one-hundredths
10
11 percent (7.24%), but in no event shall the amount
11
12 apportioned in fiscal years 2019 through 2024 pursuant
12
13 to this subparagraph exceed the total amount
13
14 apportioned for the fiscal year ending on June 30,
14
15 2015, and in no event shall the amount apportioned in
15
16 fiscal year 2026 and subsequent fiscal years exceed
16
17 the amount apportioned for the fiscal year ending on
17
18 June 30, 2025. Any amounts in excess of such
18
19 limitation shall be placed to the credit of the
19
20 Rebuilding Oklahoma Access and Driver Safety Municipal
20
21 Improvements for Roads and Bridges Fund created in
21
22 Section 1521 2 of Title 69 of the Oklahoma Statutes
22
23 this act.

1 2. The monies apportioned pursuant to subparagraphs a through e
1
2 of paragraph 1 of this subsection shall be apportioned as follows:
2
3 forty percent (40%) of such sum shall be distributed to the various
3
4 counties in that proportion which the county road mileage of each
4
5 county bears to the entire state road mileage as certified by the
5
6 Transportation Commission and the remaining sixty percent (60%) of
6
7 such sum shall be distributed to the various counties on the basis
7
8 which the population and area of each county bears to the total
8
9 population and area of the state. The population shall be as shown
9
10 by the last Federal Decennial Census or the most recent annual
10
11 estimate provided by the United States Bureau of the Census. The
11
12 funds shall be used for the purpose of constructing and maintaining
12
13 county highways; provided, however, the county treasurer may deposit
13
14 so much of the funds in the sinking fund as may be necessary for the
14
15 retirement of interest and annual accrual of indebtedness created by
15
16 the issuance of county or township bonds for road purposes. Such
16
17 deposits to the sinking fund shall not exceed forty percent (40%) of
17
18 the funds allocated to a county pursuant to this paragraph.
18
19 F. 1. The following percentages of the monies referred to in
19
20 subsection A of this section shall be remitted to the county
20
21 treasurers of the respective counties and by them deposited in a
21
22 separate special revenue fund to be used by the county commissioners
22
23 in accordance with paragraph 2 of this subsection:

1 a. from October 1, 2000, until June 30, 2001, two and
1
2 fifty-three one-hundredths percent (2.53%),
2
3 b. for the year beginning July 1, 2001, and ending June
3
4 30, 2002, two and fifty-six one-hundredths percent
4
5 (2.56%),
5
6 c. for the year beginning July 1, 2002, through the year
6
7 ending on June 30, 2015, two and fifty-nine one-
7
8 hundredths percent (2.59%),
8
9 d. for the year beginning July 1, 2015, through the year
9
10 ending on June 30, 2019, two and fifty-nine one-
10
11 hundredths percent (2.59%), but in no event shall the
11
12 amount apportioned in any fiscal year pursuant to this
12
13 subparagraph exceed the total amount apportioned for
13
14 the fiscal year ending on June 30, 2015. Any amounts
14
15 in excess of such limitation shall be placed to the
15
16 credit of the General Revenue Fund, and
16
17 e. for the year beginning July 1, 2019, and all
17
18 subsequent years, two and fifty-nine one-hundredths
18
19 percent (2.59%), but in no event shall the amount
19
20 apportioned in fiscal years 2019 through 2024 pursuant
20
21 to this subparagraph exceed the total amount
21
22 apportioned for the fiscal year ending on June 30,
22
23 2015, and in no event shall the amount apportioned in
23
24 fiscal year 2026 and subsequent fiscal years exceed
24

1 the amount apportioned for the fiscal year ending on
1
2 June 30, 2025. Any amounts in excess of such
2
3 limitation shall be placed to the credit of the
3
4 Rebuilding Oklahoma Access and Driver Safety Municipal
4
5 Improvements for Roads and Bridges Fund created in
5
6 Section 1521 2 of Title 69 of the Oklahoma Statutes
6
7 this act.
7
8 2. The monies apportioned pursuant to subparagraphs a through e
8
9 of paragraph 1 of this subsection shall be used for the primary
9
10 purpose of matching federal funds for the construction of federal
10
11 aid projects on county roads, or constructing and maintaining county
11
12 or township highways and permanent bridges of such counties. The
12
13 distribution of monies apportioned by this paragraph shall be made
13
14 upon the basis of the current formula based upon road mileage, area
14
15 and population as related to county road improvement and maintenance
15
16 costs. Provided, however, the Department of Transportation may
16
17 update the formula factors from time to time as necessary to account
17
18 for changing conditions.
18
19 G. 1. The following percentages of the monies referred to in
19
20 subsection A of this section shall be transmitted by the Tax
20
21 Commission to the various counties as set forth in paragraph 2 of
21
22 this subsection:
22
23 a. from October 1, 2000, until June 30, 2001, three and
23
24 fifty-five one-hundredths percent (3.55%),

1 b. for the year beginning July 1, 2001, and ending June
1
2 30, 2002, three and fifty-nine one-hundredths percent
2
3 (3.59%),
3
4 c. for the year beginning July 1, 2002, through the year
4
5 ending on June 30, 2015, three and sixty-two one-
5
6 hundredths percent (3.62%),
6
7 d. for the year beginning July 1, 2015, through the year
7
8 ending on June 30, 2019, three and sixty-two one-
8
9 hundredths percent (3.62%), but in no event shall the
9
10 amount apportioned in any fiscal year pursuant to this
10
11 subparagraph exceed the total amount apportioned for
11
12 the fiscal year ending on June 30, 2015. Any amounts
12
13 in excess of such limitation shall be placed to the
13
14 credit of the General Revenue Fund, and
14
15 e. for the year beginning July 1, 2019, and all
15
16 subsequent years, three and sixty-two one-hundredths
16
17 percent (3.62%), but in no event shall the amount
17
18 apportioned in fiscal years 2019 through 2024 pursuant
18
19 to this subparagraph exceed the total amount
19
20 apportioned for the fiscal year ending on June 30,
20
21 2015, and in no event shall the amount apportioned in
21
22 fiscal year 2026 and subsequent fiscal years exceed
22
23 the amount apportioned for the fiscal year ending on
23
24 June 30, 2025. Any amounts in excess of such

1 limitation shall be placed to the credit of the

2 Rebuilding Oklahoma Access and Driver Safety Municipal
2
3 Improvements for Roads and Bridges Fund created in
3
4 Section 1521 2 of Title 69 of the Oklahoma Statutes
4
5 this act.
5
6 2. The monies apportioned pursuant to subparagraphs a through e
6
7 of paragraph 1 of this subsection shall be transmitted to the
7
8 various counties on the basis of a formula to be developed by the
8
9 Department of Transportation. Such formula shall be similar to that
9
10 currently used for the distribution of the County Bridge Program
10
11 funds Improvements for Roads and Bridges Fund, but also taking into
11
12 consideration the effect of terrain and traffic volume as related to
12
13 county road improvement and maintenance costs. Provided, however,
13
14 the Department of Transportation may update the formula factors from
14
15 time to time as necessary to account for changing conditions. The
15
16 funds shall be transmitted to the various county treasurers to be
16
17 deposited in the county highway fund of their respective counties.
17
18 H. 1. The following percentages of the monies referred to in
18
19 subsection A of this section shall be apportioned to the various
19
20 counties as set forth in paragraph 2 of this subsection:
20
21 a. from October 1, 2000, until June 30, 2001, eighty-one
21
22 one-hundredths percent (0.81%),
22
23 b. for the year beginning July 1, 2001, and ending June
23
24 30, 2002, eighty-two one-hundredths percent (0.82%),

1 c. for the year beginning July 1, 2002, through the year
1
2 ending on June 30, 2015, eighty-three one-hundredths
2
3 percent (0.83%),
3
4 d. for the year beginning July 1, 2015, through the year
4
5 ending on June 30, 2019, eighty-three one-hundredths
5
6 percent (0.83%), but in no event shall the amount
6
7 apportioned in any fiscal year pursuant to this
7
8 subparagraph exceed the total amount apportioned for
8
9 the fiscal year ending on June 30, 2015. Any amounts
9
10 in excess of such limitation shall be placed to the
10
11 credit of the General Revenue Fund, and
11
12 e. for the year beginning July 1, 2019, and all
12
13 subsequent years, eighty-three one-hundredths percent
13
14 (0.83%), but in no event shall the amount apportioned
14
15 in any fiscal year pursuant to this subparagraph
15
16 exceed the total amount apportioned for the fiscal
16
17 year ending on June 30, 2015. Any amounts in excess
17
18 of such limitation shall be placed to the credit of
18
19 the Rebuilding Oklahoma Access and Driver Safety
19
20 Municipal Improvements for Roads and Bridges Fund
20
21 created in Section 1521 2 of Title 69 of the Oklahoma
21
22 Statutes this act.
22
23 2. The monies apportioned pursuant to subparagraphs a through e
23
24 of paragraph 1 of this subsection shall be apportioned to the

1 various counties based upon the proportion that each county's
1
2 population bears to the total state population.
2
3 Each county's allocation of funds shall be remitted to the
3
4 various county treasurers to be deposited in the general fund of the
4
5 county and used for the support of county government.
5
6 I. 1. The following percentages of the monies referred to in
6
7 subsection A of this section shall be apportioned to the various
7
8 cities and incorporated towns as set forth in paragraph 2 of this
8
9 subsection:
9
10 a. from October 1, 2000, until June 30, 2001, three and
10
11 four one-hundredths percent (3.04%),
11
12 b. for the year beginning July 1, 2001, and ending June
12
13 30, 2002, three and eight one-hundredths percent
13
14 (3.08%),
14
15 c. for the year beginning July 1, 2002, through the year
15
16 ending on June 30, 2015, three and ten one-hundredths
16
17 percent (3.10%),
17
18 d. for the year beginning July 1, 2015, through the year
18
19 ending on June 30, 2019, three and ten one-hundredths
19
20 percent (3.10%), but in no event shall the amount
20
21 apportioned in any fiscal year pursuant to this
21
22 subparagraph exceed the total amount apportioned for
22
23 the fiscal year ending on June 30, 2015. Any amounts
23

1 in excess of such limitation shall be placed to the
1
2 credit of the General Revenue Fund, and
2
3 e. for the year beginning July 1, 2019, and all
3
4 subsequent years, three and ten one-hundredths percent
4
5 (3.10%), but in no event shall the amount apportioned
5
6 in any fiscal year pursuant to this subparagraph
6
7 exceed the total amount apportioned for the fiscal
7
8 year ending on June 30, 2015. Any amounts in excess
8
9 of such limitation shall be placed to the credit of
9
10 the Rebuilding Oklahoma Access and Driver Safety
10
11 Municipal Improvements for Roads and Bridges Fund
11
12 created in Section 1521 of Title 69 of the Oklahoma
12
13 Statutes 2 of this act.
13
14 2. The monies apportioned pursuant to subparagraphs a through e
14
15 of paragraph 1 of this subsection shall be apportioned to the
15
16 various cities and incorporated towns based upon the proportion that
16
17 each city or incorporated town's population bears to the total
17
18 population of all cities and incorporated towns in the state. Such
18
19 funds shall be remitted to the various county treasurers for
19
20 allocation to the various cities and incorporated towns. All such
20
21 funds shall be used for the construction, maintenance, repair,
21
22 improvement, and lighting of streets and alleys. Provided, however,
22
23 the governing board of any city or town may, with the approval of
23
24 the county excise board, transfer any surplus funds to the general
24

1 revenue fund of such city or town whenever an emergency requires
1
2 such a transfer.

3 J. The following percentages of the monies referred to in
3
4 subsection A of this section shall be remitted to the State
4
5 Treasurer to be credited to the Oklahoma Law Enforcement Retirement
5
6 Fund:
6
7 1. From October 1, 2000, until June 30, 2001, one and twenty-
7
8 two one-hundredths percent (1.22%);
8
9 2. For the year beginning July 1, 2001, and ending June 30,
9
10 2002, one and twenty-three one-hundredths percent (1.23%); and
10
11 3. For the year beginning July 1, 2002, and all subsequent
11
12 years, one and twenty-four one-hundredths percent (1.24%).
12
13 K. Three one-hundredths of one percent (3/100 of 1%) (.03%) of
13
14 the monies referred to in subsection A of this section shall be
14
15 remitted to the State Treasurer to be credited to the Wildlife
15
16 Conservation Fund. Seventy-five percent (75%) of the funds shall be
16
17 used for fish habitat restoration and twenty-five percent (25%) of
17
18 the funds shall be used in the fish hatchery system for fish
18
19 production.
19
20 L. 1. For the year beginning July 1, 2007, and ending June 30,
20
21 2008, five percent (5%) of monies referred to in subsection A of
21
22 this section shall be remitted to the State Treasurer to be credited
22
23 to the County Improvements for Roads and Bridges Fund as created in
23
24 Section 507 of Title 69 of the Oklahoma Statutes.

1 2. For the year beginning July 1, 2008, and ending June 30,
1
2 2009, ten percent (10%) of monies referred to in subsection A of
2
3 this section shall be remitted to the State Treasurer to be credited
3
4 to the County Improvements for Roads and Bridges Fund as created in
4
5 Section 507 of Title 69 of the Oklahoma Statutes.
5
6 3. For the period beginning July 1, 2009, and ending December
6
7 31, 2012, fifteen percent (15%) of monies referred to in subsection
7
8 A of this section shall be remitted to the State Treasurer to be
8
9 credited to the County Improvements for Roads and Bridges Fund as
9
10 created in Section 507 of Title 69 of the Oklahoma Statutes.
10
11 4. For the period beginning January 1, 2013, and ending June
11
12 30, 2013, fifteen and fifty one-hundredths percent (15.50%) of
12
13 monies referred to in subsection A of this section shall be remitted
13
14 to the State Treasurer to be credited to the County Improvements for
14
15 Roads and Bridges Fund as created in Section 507 of Title 69 of the
15
16 Oklahoma Statutes.
16
17 5. For the year beginning July 1, 2013, and ending June 30,
17
18 2014, eighteen percent (18%) of monies referred to in subsection A
18
19 of this section shall be remitted to the State Treasurer to be
19
20 credited to the County Improvements for Roads and Bridges Fund as
20
21 created in Section 507 of Title 69 of the Oklahoma Statutes.
21
22 6. For the year beginning July 1, 2014, twenty percent (20%) of
22
23 monies referred to in subsection A of this section shall be remitted
23
24 to the State Treasurer to be credited to the County Improvements for
24

1 Roads and Bridges Fund as created in Section 507 of Title 69 of the
1
2 Oklahoma Statutes.

3 7. For the year beginning July 1, 2015, through the year ending
3
4 on June 30, 2019, twenty percent (20%) of monies referred to in
4
5 subsection A of this section shall be remitted to the State
5
6 Treasurer to be credited to the County Improvements for Roads and
6
7 Bridges Fund as created in Section 507 of Title 69 of the Oklahoma
7
8 Statutes, but in no event shall the total amount apportioned in any
8
9 fiscal year pursuant to this paragraph exceed One Hundred Twenty
9
10 Million Dollars ($120,000,000.00). Any amounts in excess of One
10
11 Hundred Twenty Million Dollars ($120,000,000.00) shall be placed to
11

13 8. a. Except as provided in subparagraph b of this
13
14 paragraph, for the year beginning July 1, 2019, and
14
15 all subsequent years, twenty percent (20%) of monies
15
16 referred to in subsection A of this section shall be
16
17 remitted to the State Treasurer to be credited to the
17
18 County Improvements for Roads and Bridges Fund as
18
19 created in Section 507 of Title 69 of the Oklahoma
19
20 Statutes, but in no event shall the total amount
20
21 apportioned in any fiscal year pursuant to this
21
22 paragraph exceed the fiscal year limitations provided
22
23 in subparagraph c of this paragraph. Any amounts in
23
24 excess of the fiscal year limitations provided in

1 subparagraph c of this paragraph shall be placed to
1
2 the credit of the Rebuilding Oklahoma Access and
2
3 Driver Safety Municipal Improvements for Roads and
3
4 Bridges Fund created in Section 1521 2 of Title 69 of
4
5 the Oklahoma Statutes this act,
5
6 b. (1) for the fiscal year beginning July 1, 2021,
6
7 through the fiscal year ending June 30, 2026, the
7
8 Oklahoma Tax Commission shall remit twenty-five
8
9 percent (25%) of the monthly allocation,
9
10 otherwise scheduled to be credited to the County
10
11 Improvements for Roads and Bridges Fund, to the
11
12 various counties of the state. The Commission
12
13 shall distribute such funds monthly to each
13
14 county treasurer as follows:
14
15 (a) one-third (1/3) of such funds shall be
15
16 distributed to the various counties in the
16
17 proportion which the area of each county
17
18 bears to the total area of the state,
18
19 (b) one-third (1/3) of such funds shall be
19
20 distributed to the various counties in the
20
21 proportion which the certified county road
21
22 miles of each county bear to the total sum
22
23 of county road miles in the state, and
23

1 (c) one-third (1/3) of such funds shall be

2 distributed to the various counties in the
2
3 proportion which the total replacement cost
3
4 for obsolete or deficient bridges according
4
5 to the most recent Department of
5
6 Transportation yearly Bridge Summary Report
6
7 for County Bridges for each county bears to
7
8 the total amount of such cost for all such
8
9 county bridges in the state, and
9
10 (2) for the fiscal year beginning July 1, 2026, and
10
11 all subsequent fiscal years thereafter, the
11
12 Oklahoma Tax Commission shall remit twenty-five
12
13 percent (25%) of the monthly allocation,

14 otherwise scheduled to be credited to the County
14
15 Improvements for Roads and Bridges Fund, to the
15

10 the total sum of county bridges in the state
10
11 according to such report.
11
12 Each county treasurer shall deposit such funds to the
12
13 county's county highway fund and such funds shall be used
13
14 for maintenance and operations. In no event shall the
14
15 total amount apportioned in any fiscal year pursuant to the
15
16 provisions of subparagraphs a and b of this paragraph
16
17 exceed the fiscal year limitations provided in subparagraph
17
18 c of this paragraph, and
18
19 c. the total amount apportioned each fiscal year pursuant
19
20 to this paragraph shall be limited as follows:
20
21 (1) for fiscal years 2020
21
22 through 2022 $120,000,000.00,
22
23 (2) for fiscal year 2023 $125,000,000.00,
23
24 (3) for fiscal year 2024 $130,000,000.00,

2 (5) for fiscal year 2026 $140,000,000.00,

7 M. Twenty-four and eighty-four one-hundredths percent (24.84%)
7
8 of the monies referred to in subsection A of this section shall be
8
9 remitted to the State Treasurer to be credited to the Rebuilding
9
10 Oklahoma Access and Driver Safety Fund created in Section 1521 of
10
11 Title 69 of the Oklahoma Statutes.
11
12 N. Monies allocated to counties by this section may be
12
13 estimated by the county excise board in the budget for the county as
13
14 anticipated revenue to the extent of ninety percent (90%) of the
14
15 previous year's income from such source; provided, not more than
15
16 fifteen percent (15%) can be encumbered during any month.
16
17 O. Notwithstanding any other provisions of this section, for
17
18 the fiscal year beginning July 1, 2003, the first One Hundred
18
19 Thousand Dollars ($100,000.00) of the monies collected or received
19
20 by the Tax Commission pursuant to the registration of motorcycles
20
21 and mopeds in this state shall be placed to the credit of the
21
22 Oklahoma Tax Commission Revolving Fund.

1 SECTION 2. NEW LAW A new section of law to be codified
1
2 in the Oklahoma Statutes as Section 508 of Title 69, unless there is
2
3 created a duplication in numbering, reads as follows:
3
4 A. There is hereby created in the State Treasury a revolving
4
5 fund to be known as the "Municipal Improvements for Roads and
5
6 Bridges Fund". The fund shall be a continuing fund, not subject to
6
7 fiscal year limitations, and shall consist of all appropriations and
7
8 transfers made by the Legislature and the apportionments made
8
9 pursuant to Section 1104 of Title 47 of the Oklahoma Statutes. All
9
10 monies accruing to the credit of the fund are hereby appropriated
10
11 and may be budgeted and expended beginning with the fiscal year
11
12 ending June 30, 2026, and each fiscal year thereafter pursuant to
12
13 subsection B of this section. Expenditures from the fund shall be
13
14 made upon warrants issued by the State Treasurer against claims
14
15 filed as prescribed by law with the Director of the Office of
15
16 Management and Enterprise Services for approval and payment.
16
17 B. The funds apportioned pursuant to Section 1104 of Title 47
17
18 of the Oklahoma Statutes shall be distributed in equal amounts to
18
19 the various Transportation Commission districts. The funds shall be
19
20 used for the sole purpose of construction or reconstruction of
20
21 municipal roads or bridges within municipalities that are of the
21
22 highest priority as defined by the Transportation Commission.
22
23 Municipalities may accumulate annual funding for a period of up to
23
24 five (5) years for a specific project, with such funding to be held

1 by the Transportation Commission to the credit of the municipal
1
2 project. The Transportation Commission shall promulgate rules for
2
3 the administration of the process and the development of criteria
3
4 for determining the level of priority for projects and include such
4
5 projects in a five-year construction plan that will be updated
5
6 annually. Projects in the five-year construction plan shall be
6
7 contracted as provided by law and awarded by the Transportation
7
8 Commission.
8
9 C. The fund shall be invested in any instruments that are
9
10 authorized by law for investments by the State Treasurer and the
10
11 interest earned by any investment of monies from the fund shall be
11
12 credited to the fund which shall earn the same, if there is any
12
13 unexpended balance of such fund to which to credit the interest.
13
14 The interest credited pursuant to this subsection shall be expended
14
15 pursuant to this section.
15
16 SECTION 3. This act shall become effective July 1, 2025.
16
17 SECTION 4. It being immediately necessary for the preservation
17
18 of the public peace, health or safety, an emergency is hereby
18
19 declared to exist, by reason whereof this act shall take effect and
19
20 be in full force from and after its passage and approval.
