7 An Act relating to the Protection from Domestic Abuse
7 Act; amending 22 O.S. 2021, Section 60.1, as last
8 amended by Section 14, Chapter 452, O.S.L. 2024 (22
8 O.S. Supp. 2025, Section 60.1), which relates to
9 definitions; defining term; updating statutory
9 reference; updating statutory language; and providing
10 an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
13
14 SECTION 1. AMENDATORY 22 O.S. 2021, Section 60.1, as
14
15 last amended by Section 14, Chapter 452, O.S.L. 2024 (22 O.S. Supp.
15
16 2025, Section 60.1), is amended to read as follows:
16
17 Section 60.1. As used in the Protection from Domestic Abuse Act
17
18 and in the Domestic Abuse Reporting Act, Sections 40.5 through 40.7
18
19 of this title, and Section 150.12B of Title 74 of the Oklahoma
19
20 Statutes:
20
21 1. "Coercive control" means unreasonably engaging in any of the
21
22 following:
22
23 a. intentionally isolating a family or household member
23
24 from friends, relatives, or other sources of support,

1 b. depriving a family or household member of basic
1
2 necessities,
2
3 c. controlling, regulating, or monitoring a family or
3
4 household member's movements, communications, daily
4
5 behavior, finances, economic resources, or access to
5
6 services, which includes stalking or cyberstalking,
6
7 d. compelling a family or household member by force,
7
8 threat, or intimidation including, but not limited to,
8
9 threats based on actual or suspected immigration
9
10 status, engaging in conduct from which such family or
10
11 household member has a right to abstain, or abstaining
11
12 from conduct that such family or household member has
12
13 a right to pursue,
13
14 e. committing or threatening to commit cruelty to an
14
15 animal that intimidates a family or household member,
15
16 f. forced sex acts or threats of a sexual nature
16
17 including, but not limited to, threatened acts of
17
18 sexual conduct or threats to release sexual images,
18
19 g. making demands on a family or household member which
19
20 limit free will and lead to compliance, or
20
21 h. willfully aiding another in suicide or attempting
21
22 suicide as described in Sections 813 through 815 of
22
23 Title 21 of the Oklahoma Statutes;

1 2. "Dating relationship" means intimate association, primarily
1
2 characterized by affectionate or sexual involvement. For purposes
2
3 of this act section and Section 644 of Title 21 of the Oklahoma
3
4 Statutes, a casual acquaintance or ordinary fraternization between
4
5 persons in a business or social context shall not constitute a
5
6 dating relationship;
6
7 2. 3. "Domestic abuse" means any act of physical harm or the
7
8 threat of imminent physical harm which is committed by an adult,
8
9 emancipated minor, or minor child thirteen (13) years of age or
9
10 older against another adult, emancipated minor or minor child who is
10
11 currently or was previously an intimate partner or family or
11
12 household member;
12
13 3. 4. "Family or household members" means:
13
14 a. parents, including grandparents, stepparents, adoptive
14
15 parents and foster parents,
15
16 b. children, including grandchildren, stepchildren,
16
17 adopted children and foster children,
17
18 c. persons otherwise related by blood or marriage living
18
19 in the same household,
19
20 d. persons otherwise related by blood or marriage, or
20
21 e. persons not related by blood or marriage living in the
21
22 same household;

23 4. 5. "Foreign protective order" means any valid order of
23
24 protection issued by a court of another state or a tribal court;

1 5. 6. "Harassment" means a knowing and willful course or
1
2 pattern of conduct by a family or household member or an individual
2
3 who is or has been involved in a dating relationship with the
3
4 person, directed at a specific person which seriously alarms or
4
5 annoys the person, and which serves no legitimate purpose. The
5
6 course of conduct must be such as would cause a reasonable person to
6
7 suffer substantial emotional distress and must actually cause
7
8 substantial distress to the person. "Harassment" Harrassment shall
8
9 include, but not be limited to, harassing or obscene telephone calls
9
10 in violation of Section 1172 of Title 21 of the Oklahoma Statutes
10
11 and fear of death or bodily injury;

12 6. 7. "Intimate partner" means:
12
13 a. current or former spouses,
13
14 b. persons who are or were in a dating relationship,
14
15 c. persons who are the biological parents of the same
15
16 child, regardless of their marital status or whether
16
17 they have lived together at any time, and
17
18 d. persons who currently or formerly lived together in an
18
19 intimate way, primarily characterized by affectionate
19
20 or sexual involvement. A sexual relationship may be
20
21 an indicator that a person is an intimate partner, but
21
22 is never a necessary condition;

23 7. 8. "Living in the same household" means:

1 a. persons who regularly reside in the same single-
1
2 dwelling unit,
2
3 b. persons who resided in the same single-dwelling unit
3
4 within the past year, or
4
5 c. persons who have individual lease agreements whereby
5
6 each person has his or her own private bedroom and
6
7 shares the common areas;
7
8 8. 9. "Mutual protective order" means a final protective order
8
9 or orders issued to both a plaintiff who has filed a petition for a
9
10 protective order and a defendant included as the defendant in the
10
11 plaintiff's petition restraining the parties from committing
11
12 domestic violence, stalking, harassment or rape against each other.
12
13 If both parties allege domestic abuse, violence, stalking,
13
14 harassment or rape against each other, the parties shall do so by
14
15 separate petition pursuant to Section 60.4 of this title;
15
16 9. 10. "Rape" means rape and rape by instrumentation in
16
17 violation of Sections 1111 and 1111.1 of Title 21 of the Oklahoma
17
18 Statutes;
18
19 10. 11. "Stalking" means the willful, malicious, and repeated
19
20 following or harassment of a person by an adult, emancipated minor,
20
21 or minor thirteen (13) years of age or older, in a manner that would
21
22 cause a reasonable person to feel frightened, intimidated,
22
23 threatened, harassed, or molested and actually causes the person
23
24 being followed or harassed to feel terrorized, frightened,

1 intimidated, threatened, harassed, or molested. Stalking also means
1
2 a course of conduct composed of a series of two or more separate
2
3 acts over a period of time, however short, evidencing a continuity
3
4 of purpose or unconsented contact with a person that is initiated or
4
5 continued without the consent of the individual or in disregard of
5
6 the expressed desire of the individual that the contact be avoided
6
7 or discontinued. Unconsented contact or course of conduct includes,
7
8 but is not limited to:
8
9 a. maintaining a visual or physical proximity to the
9
10 individual,
10
11 b. approaching or confronting that individual in a public
11
12 place or on private property,
12
13 c. appearing at the workplace of the individual or
13
14 contacting the employer or coworkers of the
14
15 individual,
15
16 d. appearing at the residence of the individual or
16
17 contacting the neighbors of the individual,
17
18 e. entering onto or remaining on property owned, leased
18
19 or occupied by the individual,
19
20 f. contacting the individual by telephone, text message,
20
21 electronic message, electronic mail, or other means of
21
22 electronic communication or causing the telephone or
22
23 electronic device of the individual or the telephone
23
24 or electronic device of any other person to ring or

1 generate notifications repeatedly or continuously,
1
2 regardless of whether a conversation ensues,
2
3 g. photographing, videotaping, audiotaping, or, through
3
4 any other electronic means, monitoring or recording
4
5 the activities of the individual. This subparagraph
5
6 applies regardless of where the act occurs,
6
7 h. sending any physical or electronic material or
7
8 contacting the individual by any means, including any
8
9 message, comment, or other content posted on any
9
10 Internet site or web application,
10
11 i. sending to a family member or member of the household
11
12 of the individual, or any current or former employer
12
13 of the individual, or any current or former coworker
13
14 of the individual, or any friend of the individual,
14
15 any physical or electronic material or contacting such
15
16 person by any means, including any message, comment,
16
17 or other content posted on any Internet site or web
17
18 application, for the purpose of obtaining information
18
19 about, disseminating information about, or
19
20 communicating with the individual,
20
21 j. placing an object on, or delivering an object to,
21
22 property owned, leased or occupied by the individual,
22
23 k. delivering an object to a family member or member of
23
24 the household of the individual, or an employer,

1 coworker, or friend of the individual, or placing an
1
2 object on, or delivering an object to, property owned,
2
3 leased, or occupied by such a person with the intent
3
4 that the object be delivered to the individual, or
4
5 l. causing a person to engage in any of the acts
5
6 described in subparagraphs a through k of this
6
7 paragraph; and
7
8 11. 12. "Victim support person" means a person affiliated with
8
9 a domestic violence, sexual assault or adult human sex trafficking
9
10 program, certified by the Attorney General or operating under a
10
11 tribal government, who provides support and assistance for a person
11
12 who files a petition under the Protection from Domestic Abuse Act.

13 SECTION 2. This act shall become effective November 1, 2026.
