7 An Act relating to child custody; creating the
7 Oklahoma Time Taken, Time Back Act; providing short
8 title; requiring court to order certain additional
8 visitation in certain circumstance; providing
9 requirements for certain additional visitation;
9 construing provision; providing for codification; and
10 providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 155 of Title 43, unless there is
15
16 created a duplication in numbering, reads as follows:
16
17 A. This act shall be known and may be cited as the "Oklahoma
17
18 Time Taken, Time Back Act".
18
19 B. A court shall, unless a party shows good cause as to why an
19
20 order should not be issued, order additional periods of visitation
20
21 or custody access to compensate for a denial of court-ordered
21
22 visitation or custody access that resulted from:

23 1. An investigation conducted by the Department of Human
23
24 Services;

1 2. A protective order or restraining order; or

2 3. An investigation conducted by any investigative agency,
2
3 provided that such investigation or order did not result in a
3
4 finding of abuse or neglect.

5 C. Additional periods of visitation or custody access ordered
5
6 pursuant to the provisions of this section:
6
7 1. Shall be of the same type and duration as the visitation or
7
8 custody access that was denied;
8
9 2. May include weekend, holiday, or summer visitation or
9
10 custody access; and
10
11 3. Shall occur within two (2) years of the date the court-
11
12 ordered visitation or custody access was denied.

13 D. A person denied visitation or custody access shall be
13
14 entitled to select the time of the additional visitation or custody
14
15 access, subject to the requirements of subsection C of this section.
15
16 E. Nothing in subsection B of this section shall be construed
16
17 to create a cause of action against the Department of Human Services
17
18 or waive sovereign immunity from suit or liability.

19 SECTION 2. This act shall become effective November 1, 2026.
