7 An Act relating to foreign ownership of land;
7 defining terms; prohibiting foreign principals from
8 renting, leasing, or having a controlling interest in
8 data centers; requiring foreign principals to divest
9 from any data center currently rented, leased, or
9 controlled; invalidating certain agreements;
10 requiring the Attorney General to commence an action
10 in certain circumstances; requiring district courts
11 to make certain order in certain circumstances;
11 providing for codification; and providing an
12 effective date.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16 SECTION 1. NEW LAW A new section of law to be codified
16
17 in the Oklahoma Statutes as Section 128.5 of Title 60, unless there
17
18 is created a duplication in numbering, reads as follows:

19 A. As used in this section:
19
20 1. "Data center" means a facility whose primary services are
20
21 the storage, management, and processing of digital data and that is
21
22 used to house:
22
23 a. computer and network systems, including associated
23
24 components such as servers, network equipment and

1 appliances, and telecommunications and data storage

2 systems,
2
3 b. systems for monitoring and managing infrastructure
3
4 performance,
4
5 c. equipment used for the transformation, transmission,
5
6 distribution, or management of at least one (1)
6
7 megawatt of capacity of electrical power and cooling,
7
8 including substations, uninterruptible power supply
8
9 systems, all electrical plant equipment, and
9
10 associated air handlers,
10
11 d. Internet-related equipment and services,
11
12 e. data communications connections,
12
13 f. environmental controls,
13
14 g. fire protection systems, and
14
15 h. security systems and services;
15
16 2. "Foreign adversary" means any country designated by the
16
17 United States Secretary of State as hostile or a Country of
17
18 Particular Concern (CPC); and
18
19 3. "Foreign principal" means:
19
20 a. the government or any official of the government of a
20
21 foreign adversary,
21
22 b. a political party or member of a political party or
22
23 any subdivision of a political party of a foreign
23
24 adversary,

1 c. a partnership, association, corporation, organization,

2 or other combination of persons organized under the
2
3 laws of or having its principal place of business in a
3
4 foreign adversary, or a subsidiary of such entity, or
4
5 owned or controlled wholly or in part by any person,
5
6 entity, or collection of persons or entities of a
6
7 foreign adversary,
7
8 d. any person who is domiciled in a foreign adversary and
8
9 is not a citizen or lawful permanent resident of the
9
10 United States, or
10
11 e. any person, entity, or collection of persons or
11
12 entities described in subparagraphs a through d of
12
13 this paragraph having a controlling interest in a
13
14 partnership, association, corporation, organization,
14
15 trust, or any other legal entity or subsidiary formed
15
16 for the purpose of owning real property.

17 B. A foreign principal from a foreign adversary may not
17
18 directly or indirectly rent or lease or otherwise hold a controlling
18
19 interest in a data center, as defined in subsection A of this
19
20 section, in this state.
20
21 C. A foreign principal that directly or indirectly rents or
21
22 leases a data center, as defined in subsection A of this section, in
22
23 this state shall divest itself of any rental agreement, lease
23

1 agreement, or controlling interest in the data center within one
1
2 hundred eighty (180) days of the effective date of this act.

3 D. Any current rental agreements, lease agreements, or other
3
4 legal agreements in conflict with the provisions of this act shall
4
5 be deemed invalid from the date of adoption unless otherwise
5
6 provided.
6
7 E. The responsibility for determining whether an entity is
7
8 subject to the provisions of this section rests solely with the
8
9 foreign entity, the Attorney General, and no other individual or
9
10 entity. An individual or entity who is not a foreign entity shall
10
11 not be required to determine or inquire whether another person or
11
12 entity is or may be subject to this section, and shall bear no civil
12
13 or criminal liability under the provisions of this section.
13
14 F. If a foreign principal from a foreign adversary does not
14
15 divest the real property as required by this section, the Attorney
15
16 General shall commence an action in district court within the
16
17 jurisdiction of the real property.
17
18 G. If a data center is held in violation of the provisions of
18
19 this section, the district court shall order the foreign principal
19
20 to divest itself of any rental agreement, lease agreement, or
20
21 controlling interest in the data center.

22 SECTION 2. This act shall become effective November 1, 2026.
