7 An Act relating to cities and towns; prohibiting
7 political subdivisions from spending public funds to
8 pay nonprofit organizations to pay defendants' bail;
8 providing for injunctive relief; providing for award
9 of attorney fees and costs; providing for
9 codification; and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 27-117.2 of Title 11, unless
14
15 there is created a duplication in numbering, reads as follows:

16 A. A political subdivision may not spend public funds to pay a
16
17 nonprofit organization that accepts and uses donations from the
17
18 public to deposit money with a court in the amount of a defendant's
18
19 bail bond.

20 B. If a political subdivision engages in an activity prohibited
20
21 by subsection A of this section, a taxpayer or resident of the
21
22 political subdivision is entitled to appropriate injunctive relief
22
23 to prevent further activity prohibited by subsection A of this

1 section and further payment of public funds related to that

2 activity.

3 C. A party that prevails in an action under subsection B of
3
4 this section is entitled to recover the party's reasonable attorney
4
5 fees and court costs.

6 SECTION 2. This act shall become effective November 1, 2026.
