7 An Act relating to firearms; amending 21 O.S. 2021,
7 Section 1289.9, which relates to carrying weapons
8 under influence of alcohol; authorizing certain carry
8 or use; and providing an effective date.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1289.9, is
12
13 amended to read as follows:

15 CARRYING WEAPONS UNDER INFLUENCE OF ALCOHOL
15
16 It shall be unlawful for any person to carry or use shotguns,
16
17 rifles, or pistols in any circumstances while under the influence of
17
18 beer, intoxicating liquors or any hallucinogenic, or any unlawful or
18
19 unprescribed drug, and it whose blood or breath alcohol
19
20 concentration is more than eight one-hundredths (0.08) at the time
20
21 of testing such person's blood or breath alcohol concentration. It
21
22 shall be unlawful for any person to carry or use shotguns, rifles,
22
23 or pistols when under the influence of any drug prescribed by a
23
24 licensed physician if the aftereffects of such consumption affect

1 mental, emotional, or physical processes to a degree that would

2 result in abnormal behavior. Any person convicted of a violation of
2
3 the provisions of this section shall be punished as provided in
3
4 Section 1289.15 of this title.

5 Any person convicted of a violation of the provisions of this
5
6 section after having been issued a handgun license pursuant to the
6
7 provisions of the Oklahoma Self-Defense Act shall have the license
7
8 suspended for a term of six (6) months and shall be subject to an
8
9 administrative fine of Fifty Dollars ($50.00), upon a hearing and
9
10 determination by the Oklahoma State Bureau of Investigation that the
10
11 person is in violation of the provisions of this section.
11
12 SECTION 2. This act shall become effective November 1, 2026.
