7 An Act relating to schools; stating legislative
7 intent; directing the State Department of Education,
8 in certain consultation, to make certain
8 determination regarding instruction on firearm
9 safety; providing for study of relevant data and risk
9 factors; requiring public school districts and public
10 charter schools to annually provide certain
10 instruction beginning in certain school year;
11 requiring curriculum or program of instruction to
11 meet certain criteria; allowing the Department to
12 approve certain curriculum or program and related
12 materials if it bears certain brand or affiliation;
13 providing preferred methods of instruction; providing
13 for noncodification; providing for codification;
14 providing an effective date; and declaring an
14 emergency.

17 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

18 SECTION 1. NEW LAW A new section of law not to be
18
19 codified in the Oklahoma Statutes reads as follows:
19
20 It is the intent of the Legislature to:
20
21 1. Protect children in this state from the accidental discharge
21
22 of firearms by providing age-appropriate firearm education and
22
23 instruction; and

1 2. Empower the Department of Wildlife Conservation to work with

2 the State Department of Education to create and approve age-
2
3 appropriate firearm safety courses.

4 SECTION 2. NEW LAW A new section of law to be codified
4
5 in the Oklahoma Statutes as Section 11-103.6q of Title 70, unless
5
6 there is created a duplication in numbering, reads as follows:
6
7 A. The State Department of Education, in consultation with the
7
8 Department of Wildlife Conservation, shall determine the earliest
8
9 grade in which it is appropriate for students to begin receiving
9
10 instruction on firearm safety. To make the determination, the State
10
11 Department of Education and the Department of Wildlife Conservation
11
12 shall study relevant data and risk factors including, but not
12
13 limited to, the earliest age at which:
13
14 1. Incidents of injury involving firearms are reported; and
14
15 2. Children are susceptible to harm from unsecured firearms to
15
16 which they are able to gain access.

17 B. Beginning with the 2026-2027 school year, each public school
17
18 district and public charter school shall annually provide students
18
19 with age-appropriate and grade-appropriate instruction on firearm
19
20 safety. The curriculum or program of instruction shall:

21 1. Be approved by the State Department of Education;
21
22 2. Begin in the earliest appropriate grade as determined by the
22
23 State Department of Education and the Department of Wildlife
23
24 Conservation and continue through the twelfth grade;

1 3. Include instruction on the following:

2 a. the steps to take if a student finds an unsecured
2
3 firearm including, but not limited to, the importance
3
4 of:
4
5 (1) avoiding injury if the student finds an unsecured
5
6 firearm,
6
7 (2) never touching a firearm if the student finds an
7
8 unsecured firearm, and
8
9 (3) immediately notifying an adult of the location of
9
10 the unsecured firearm,
10
11 b. school safety relating to firearms, and
11
12 c. the proper handling and safe storage of firearms; and
12
13 4. Include neutral viewpoints on all included topics including,
13
14 but not limited to, the prevention of accidental firearm injury.

15 C. The State Department of Education may approve a curriculum
15
16 or program of instruction for the education of students on firearm
16
17 safety if such curriculum or program of instruction and related
17
18 instructional materials bear a brand or stated organizational
18
19 affiliation including, but not limited to, a brand issued by this
19
20 state or any of its agencies.

21 D. The State Department of Education shall use the following
21
22 preferred methods of instruction in determining the curriculum or
22
23 program of instruction to be used to educate students on firearm
23
24 safety:

1 1. The viewing of a video produced by the Department of
1
2 Wildlife Conservation or a Department-approved source;
2
3 2. The review of online resources and materials; and
3
4 3. An alternative curriculum, which may include an off-campus
4
5 firearm safety course approved by the Department of Wildlife
5
6 Conservation and may be provided in conjunction with a live-fire
6
7 exercise or sporting event. If such a curriculum is provided in
7
8 conjunction with a live-fire exercise or sporting event, the public
8
9 school district shall obtain prior written consent from the
9
10 participating student's parent or legal guardian.

11 SECTION 3. This act shall become effective July 1, 2026.
11
12 SECTION 4. It being immediately necessary for the preservation
12
13 of the public peace, health, or safety, an emergency is hereby
13
14 declared to exist, by reason whereof this act shall take effect and
14
15 be in full force from and after its passage and approval.
