8 4-112), which relates to voter registration
9 applications; updating statutory language; defining
9 terms; requiring persons registering to vote to
10 provide documentary proof of citizenship; requiring
10 the Secretary of the State Election Board to include
11 certain information on registration applications;
11 prohibiting registration as a verified voter without
12 verification of citizenship; requiring election board
12 officials to verify citizenship of applicants;
13 requiring election board officials to notify
13 applicants in certain circumstances; authorizing the
14 Secretary of the State Election Board to enter
14 certain agreements; requiring the Secretary of the

22 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

1 SECTION 1. AMENDATORY 26 O.S. 2021, Section 4-112, as
1
2 amended by Section 18, Chapter 282, O.S.L. 2022 (26 O.S. Supp. 2025,
2
3 Section 4-112), is amended to read as follows:
3
4 Section 4-112. A. The Secretary of the State Election Board
4
5 shall devise and distribute a registration application form to be
5
6 used for registering voters. Such registration application shall
6
7 contain the following information:
7
8 1. The applicant's full name and date of birth, county and
8
9 place of residence, and mailing address pursuant to the provisions
9
10 of subsection G of this section;
10
11 2. A space or section to designate a political party recognized
11
12 by the laws of the State of Oklahoma this state with which the
12
13 applicant chooses to be affiliated;
13
14 3. The Oklahoma driver license or identification card number if
14
15 the applicant has been issued a current and valid driver license or
15
16 identification card by Service Oklahoma, or if the applicant does
16
17 not have a valid Oklahoma driver license or identification card, the
17
18 last four digits of the voter's Social Security number;
18
19 4. An oath of the eligibility of the applicant to become a
19
20 registered voter; and
20
21 5. Such other information as may be deemed necessary by the
21
22 Secretary to identify such applicant and to ascertain his or her
22
23 eligibility.

1 B. A voter registration application shall be signed by the
1
2 applicant in writing. The applicant shall personally subscribe his
2
3 or her name to or make his or her mark on the application, and no
3
4 agent, representative or employee of the applicant may sign or mark
4
5 on the applicant's behalf. The signature or mark must be the
5
6 original, handwritten signature, autograph or mark of the applicant.
6
7 No facsimile, reproduction, typewritten or other substitute
7
8 signature, autograph or mark will be valid. Notwithstanding any law
8
9 to the contrary, the Secretary of the State Election Board shall
9
10 prescribe procedures to authorize any person incapable of personally
10
11 making a mark to complete a voter registration application with
11
12 assistance of an official of any voter registration agency or
12
13 licensed operator specified in Sections 4-109.2 and 4-109.3 of this
13
14 title. Provided, for applications submitted electronically, in lieu
14
15 of the signature requirements set forth in this subsection, the
15
16 applicant shall consent to the use of his or her driver license or
16
17 identification card signature as provided in Section 4-109.4 of this
17
18 title.
18
19 C. Persons who do not indicate a recognized political party or
19
20 political organization on their registration application shall be
20
21 designated as Independents.
21
22 D. Any person may apply in writing to the Secretary of the
22
23 State Election Board for permission to print, copy or otherwise
23
24 prepare and distribute the registration applications designed by the

1 Secretary of the State Election Board. The Secretary may revoke any
1
2 such permission at any time.

3 E. All registration applications shall be distributed to the
3
4 public at no charge.
4
5 F. The Secretary also shall prescribe procedures to accept and
5
6 use the National Mail Voter Registration Form, or its successor, as
6
7 required by the National Voter Registration Act of 1993. Provided,
7
8 to be accepted as a valid voter registration application, the form
8
9 shall include the applicant's original, handwritten signature,
9
10 autograph or mark as described in subsection B of this section.
10
11 G. Applicants for voter registration or for change of voter
11
12 registration in any way shall provide a residence address and, if
12
13 different from the residence address, a mailing address. A
13
14 residence address shall include the street address of the residence,
14
15 including a full house number, street name or number, apartment or
15
16 suite number, if applicable, and zip code. If a street address is
16
17 not available for the residence, applicants shall provide such
17
18 information as the Secretary of the State Election Board deems
18
19 necessary for voter registration purposes. A post office box may
19
20 not be given as a residence address. A mailing address, which shall
20
21 include the city and zip code, may be the actual emergency
21
22 notification or 911 9-1-1 address on file in the local community, a
22
23 rural route and box number, a post office box number or a street
23
24 address.

1 H. A full or partial Social Security number or driver license
1
2 number in a voter registration record or a voter registration
2
3 application shall not be considered a public record and shall be
3
4 kept confidential by the State Election Board and each county
4
5 election board.
5
6 SECTION 2. NEW LAW A new section of law to be codified
6
7 in the Oklahoma Statutes as Section 4-112.1 of Title 26, unless
7
8 there is created a duplication in numbering, reads as follows:
8
9 A. As used in this section:
9
10 1. "Documentary proof of citizenship" means:
10
11 a. a legible photocopy of the applicant's birth
11
12 certificate issued by a United States state or
12
13 territory, or the District of Columbia, that verifies
13
14 citizenship; provided, that if a person has changed
14
15 his or her name since birth, that person shall provide
15
16 legal documentation of the name change in accordance
16
17 with state law,
17
18 b. a legible photocopy of pertinent pages of the
18
19 applicant's United States passport identifying the
19
20 applicant and the applicant's passport number or
20
21 presentation to an election board official of the
21
22 applicant's United States passport,
22
23 c. the applicant's United States naturalization documents
23
24 or the number of the certificate of naturalization.

1 If only the number of the certificate of
1
2 naturalization is provided, the applicant shall not be
2
3 classified as a verified voter until the number of the
3
4 certificate of naturalization is verified with United
4
5 States Citizenship and Immigration Services by an
5
6 election board official, pursuant to 8 U.S.C., Section
6
7 1373(c),
7
8 d. other documents or methods of proof of citizenship
8
9 that are established pursuant to the Immigration
9
10 Reform and Control Act of 1986 or the Immigration and
10
11 Nationality Act,
11
12 e. the applicant's Bureau of Indian Affairs card number,
12
13 tribal treaty card number, or tribal enrollment
13
14 number, or
14
15 f. for citizens born abroad, a certificate or report of
15
16 birth or consular report of birth abroad issued by the
16
17 United States Department of State;
17
18 2. "Federal contests" means the contests for the offices of
18
19 United States Representative, United States Senator, and President
19
20 of the United States;
20
21 3. "Federal-only voter" means a voter registered using the
21
22 National Mail Voter Registration Form in this state, whose United
22
23 States citizenship status has not been verified by an election board
23

1 official in this state, is only eligible to vote in federal races,
1
2 and shall not include any verified voter;
2
3 4. "National Mail Voter Registration Form" means the voter
3
4 registration application form created and maintained by the United
4
5 States Election Assistance Commission pursuant to 52 U.S.C., Section
5
6 20508(a)(2); and
6
7 5. "Verified voter" means a registered voter in this state
7
8 whose United States citizenship has been verified by an election
8
9 board official in this state.
9
10 B. Every person who applies to register to vote in this state,
10
11 regardless of method, shall provide an election board official with
11
12 documentary proof of citizenship.
12
13 C. The Secretary of the State Election Board shall update this
13
14 state's voter registration form to:
14
15 1. Include a space or box where the applicant is required to
15
16 enter the identification number printed on the applicant's driver
16
17 license or identification card issued by Service Oklahoma or to
17
18 indicate if the applicant has never been issued a driver license or
18
19 identification card in this state;
19
20 2. Include a statement instructing the applicant that if the
20
21 applicant fails to provide the identification number described in
21
22 paragraph 1 of this subsection, the applicant must provide an
22
23 election board official with another form of documentary proof of
23
24 citizenship or the application will be rejected;

1 3. Include a full explanation of the registration process and a
1
2 clear indication that the applicant must be verified as a United
2
3 States citizen prior to being registered; and
3
4 4. Require the applicant to sign affirming that:
4
5 a. the information the applicant has provided in the
5
6 application is accurate,
6
7 b. the documentary proof of citizenship the applicant has
7
8 provided in connection with such application is, to
8
9 the best of his or her knowledge, sufficient for an
9
10 election board official to verify the applicant's
10
11 United States citizenship, and
11
12 c. the applicant will provide additional documentation or
12
13 information to an election board official as necessary
13
14 to verify the applicant's United States citizenship.
14
15 D. No applicant shall be registered to vote in this state as a
15
16 verified voter unless and until an election board official verifies
16
17 that the applicant is a citizen of the United States, provided that:
17
18 1. For applicants submitting the National Mail Voter
18
19 Registration Form, if an election board official is unable to verify
19
20 that an applicant is a citizen of the United States but the
20
21 applicant otherwise satisfies all applicable legal requirements to
21
22 register to vote in this state, the election board official shall
22
23 register and classify the applicant as a federal-only voter;

1 2. If an election board official verifies an applicant is not a
1
2 citizen of the United States, the election board official shall
2
3 reject the application. The election board official shall forward
3
4 the applicant's information and supporting documentation to the
4
5 appropriate law enforcement agency and prosecutorial authority; and
5
6 3. The voter registration records maintained for registered
6
7 voters shall clearly and accurately indicate each voter's current
7
8 classification as a verified voter or federal-only voter. Verified
8
9 voters shall not be required to resubmit documentary proof of
9
10 citizenship during subsequent updates to their voter registration.
10
11 E. An election board official shall register federal-only
11
12 voters in a manner that designates each voter's registration as
12
13 federal-only.
13
14 SECTION 3. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 4-112.2 of Title 26, unless
15
16 there is created a duplication in numbering, reads as follows:
16
17 A. When processing a voter registration application, an
17
18 election board official shall use all available resources to verify
18
19 the applicant is a citizen of the United States, including relevant
19
20 information from the following records:
20
21 1. Service Oklahoma's electronic database;
21
22 2. The Social Security Administration database;
22
23 3. The United States Citizenship and Immigration Services
23
24 Systematic Alien Verification for Entitlements program;

1 4. A national association for public health statistics and
1
2 information systems electronic verification of vital events system
2
3 (or similar state database); and
3
4 5. Any other federal, state, or political subdivision database
4
5 and any other database relating to voter registration to which an
5
6 election board official has or is granted access.
6
7 B. After processing a voter registration application, an
7
8 election board official shall notify the applicant in writing:
8
9 1. If the applicant was rejected because he or she was verified
9
10 as not being a citizen of the United States; or
10
11 2. If, for an applicant submitting the National Mail Voter
11
12 Registration Form who could not be verified as a citizen of the
12
13 United States, the applicant is registered to vote as a federal-only
13
14 voter and the process for submitting documentary proof of
14
15 citizenship to an election board official to become classified as a
15
16 verified voter.
16
17 C. To the extent allowed under applicable law, the Secretary of
17
18 the State Election Board shall enter into agreements with the
18
19 entities described in subsection A of this section to allow election
19
20 board officials in this state to request and obtain records or
20
21 information relating to an applicant's citizenship status. The
21
22 Secretary shall have the discretion to enter agreements with other
22
23 entities than those described in subsection A of this section to
23
24 carry out the provisions of this act.

1 D. The Secretary of the State Election Board shall promulgate
1
2 rules to implement the provisions and requirements of this act
2
3 within one hundred eighty (180) days of it becoming effective.
3
4 E. Federal-only voters may only vote by physical appearance at
4
5 an appropriate polling place. Federal-only voters shall follow the
5
6 same procedures and rules when marking and casting their ballots
6
7 that are applicable to in-person voting at their respective polling
7
8 place except as otherwise provided in subsection F of this section.
8
9 A federal-only voter is only qualified to vote in federal contests.
9
10 Votes cast in elections that are not federal contests shall not be
10
11 counted unless the federal-only voter provides documentary proof of
11
12 citizenship to an election board official within the time limit
12
13 provided in subsection F of this section.
13
14 F. A federal-only voter, pursuant to Section 7-116.1 of Title
14
15 26 of the Oklahoma Statutes, shall use a provisional ballot to vote.
15
16 Provisional voting materials shall clearly reflect that the reason
16
17 for voting provisionally is that the voter is classified as a
17
18 federal-only voter.
18
19 1. At any time prior to 1:00 p.m. on the Friday following an
19
20 election, a federal-only voter shall have the opportunity to provide
20
21 an election board official with documentary proof of citizenship.
21
22 If a federal-only voter is verified to be a United States citizen,
22
23 all votes cast on that voter's ballot shall be counted and an
23

1 election board official shall update the voter's registration record
1
2 as a verified voter.
2
3 2. No later than 5:00 p.m. on the Monday following an election,
3
4 the State Election Board shall send written notice to every federal-
4
5 only voter who submitted a ballot in that election informing the
5
6 voter of the disposition of his or her ballot and any updates to his
6
7 or her voter registration record.
7
8 G. The Secretary of the State Election Board shall design,
8
9 prepare, and distribute a standardized written notice form that
9
10 shall be provided to each federal-only voter who appears to vote.
10
11 The notice shall inform the voter that:
11
12 1. An election board official was unable to verify the voter as
12
13 a citizen of the United States;
13
14 2. The voter is only qualified to vote in federal contests;
14
15 3. If the voter wishes for his or her full ballot to be
15
16 counted, he or she must provide documentary proof of citizenship to
16
17 an election board official at any time prior to 1:00 p.m. on the
17
18 Friday following the election; and
18
19 4. If the voter takes no action, or if his or her documentary
19
20 proof of citizenship cannot be verified, only votes cast in federal
20
21 contests will be counted.

22 SECTION 4. NEW LAW A new section of law to be codified
22
23 in the Oklahoma Statutes as Section 4-112.3 of Title 26, unless
23
24 there is created a duplication in numbering, reads as follows:

1 A. Any records, documents, or correspondence relating to the
1
2 verification of citizenship by an election board official, and any
2
3 changes made to voter registration records as a result, shall be
3
4 considered voter list maintenance records and shall be retained for
4
5 a period of twenty-four (24) months after the day of the election.
5
6 B. Any records, documents, or correspondence pertaining to the
6
7 verification of a voter's citizenship status shall be included in
7
8 that voter's corresponding voter registration record for the
8
9 duration of that voter's status as a registered voter in this state.
9
10 C. If a federal agency described in subsection A of Section 3
10
11 of this act terminates access to citizenship data by an election
11
12 board official, the Attorney General shall seek redress in a court
12
13 of law.
13
14 D. 1. It shall be unlawful for any election official to
14
15 knowingly and intentionally cause an individual who has not been
15
16 verified as a citizen of the United States to be classified as a
16
17 verified voter. Violations of this provision shall be punishable as
17
18 a felony.
18
19 2. It shall be unlawful for any election official to knowingly
19
20 and intentionally cause an individual who has been determined to not
20
21 be a citizen of the United States to be registered to vote.
21
22 Violations of this provision shall be punishable as a felony.
22
23 3. It shall be unlawful for any person who is not a citizen of
23
24 the United States to knowingly and intentionally apply to register

1 to vote. Violations of this provision shall be punishable as a
1
2 felony.
2
3 4. It shall be unlawful for any person to knowingly and
3
4 intentionally count, tabulate, or otherwise cause to be counted,
4
5 votes cast in any race other than a federal contest by a federal-
5
6 only voter unless that voter has been verified as a citizen of the
6
7 United States pursuant to paragraph 1 of Section 3 of this act.
7
8 Violations of this provision shall be punishable as a felony.
8
9 SECTION 5. It being immediately necessary for the preservation
9
10 of the public peace, health or safety, an emergency is hereby
10
11 declared to exist, by reason whereof this act shall take effect and
11
12 be in full force from and after its passage and approval.
