7   An Act relating to firearms; prohibiting courts from

7   abridging a person's right to possess a firearm;

8   requiring return of seized firearms; providing an

8   exception; providing for codification; and providing

9   an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.      NEW LAW  A new section of law to be codified

13

14 in the Oklahoma Statutes as Section 1290.28 of Title 21, unless
14

15 there is created a duplication in numbering, reads as follows:
15

16  A court shall not abridge a person's right to purchase, possess,

16

17 concealed carry, or open carry a firearm in this state. No court
17

18 shall require a firearm seized due to a misdemeanor arrest or
18

19 conviction to be forfeited or destroyed. Seized firearms shall be
19

20 returned after a misdemeanor case is resolved, unless the firearm
20

21 was used during the commission of the misdemeanor.

22  SECTION 2. This act shall become effective November 1, 2026.
