7       An Act relating to health benefit plans; defining

7       terms; requiring certain health benefit plans to

8       provide coverage for certain cooling system;

8       exempting certain coverage from certain limits;

9       providing for codification; and declaring an

9       emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13      SECTION 1.  NEW LAW  A new section of law to be codified

13

14 in the Oklahoma Statutes as Section 6060a of Title 36, unless there
14

15 is created a duplication in numbering, reads as follows:

16      A. As used in this section:

16

17      1. "Cooling system" means a cooling cap, hypothermia cap, cold

17

18 cap, physical cooling treatment, or any other therapeutic device
18

19 used to cool the scalp, hands, or feet of an individual to prevent
19

20 or reduce side effects of chemotherapy including, but not limited
20

21 to, hair loss, polyneuropathy, or palmar-plantar erythrodysesthesia;

22 and

23      2. "Health benefit plan" means the same as defined in Section

23

24 6060.4 of Title 36 of the Oklahoma Statutes.

1   B. All health benefit plans shall provide coverage cooling

1

2 systems used in connection with chemotherapy treatment.
2

3   C. Coverage under this section shall not be subject to any

3

4 annual deductibles, co-payments, or coinsurance limits as
4

5 established for all covered benefits under the health benefit plan.
5

6   D. If application of this section would result in health

6

7 savings account ineligibility under Section 223 of the Internal
7

8 Revenue Code of 1986, as amended, the provisions of this section
8

9 shall only apply to health savings accounts with qualified high
9

10 deductible health plans with respect to the deductible of such a
10

11 plan after the enrollee has satisfied the minimum deductible.
11

12 Provided, however, the provisions of this section shall apply to
12

13 items or services that are preventive care pursuant to Section
13

14 223(c)(2)(C) of the Internal Revenue Code of 1986, as amended,
14

15 regardless of whether the minimum deductible has been satisfied.
15

16  SECTION 2. It being immediately necessary for the preservation

16

17 of the public peace, health or safety, an emergency is hereby
17

18 declared to exist, by reason whereof this act shall take effect and
18

19 be in full force from and after its passage and approval.
