9   An Act relating to turnpikes; amending 69 O.S. 2021,

9   Section 1711, which relates to tolls for turnpikes;

10  defining term; exempting residents of Oklahoma from

10  certain tolls; allowing for promulgation of rules;

11  updating statutory language; providing an effective

11  date; and declaring an emergency.

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
16

17  SECTION 1.      AMENDATORY  69 O.S. 2021, Section 1711, is

17

18 amended to read as follows:
18

19  Section 1711. A. 1. As used in this subsection, "residents of

19

20 this state" shall mean individuals holding a valid Oklahoma driver
20

21 license or permit to operate a motor vehicle issued by Service
21

22 Oklahoma.
22

23  2. The Oklahoma Turnpike Authority, subject to the provisions

23

24 hereof, is hereby authorized to fix, revise, charge, and collect

1 tolls for the use of each turnpike project and the different parts
1

2 or sections thereof, except for use by the following persons who
2

3 shall be entitled to free use of every such project:
3

4        a. law enforcement officers responsible for enforcing the

4

5                  traffic laws and the general laws of the state and

5

6                  federal governments on turnpikes, who shall be

6

7                  entitled to free use of every such project in the

7

8                  performance of official duties connected with such

8

9                  turnpike project, and

9

10       b. residents of this state.

11  B. The Authority, subject to the provisions of this section, is

11

12 authorized to contract with any person, partnership, association, or
12

13 corporation desiring the use of any part thereof, including the
13

14 right-of-way adjoining the paved portion, for placing thereon
14

15 telephone, telegraph, electric light or power lines, gas stations,
15

16 garages, stores, hotels, restaurants, and advertising signs, or for
16

17 any other purpose except for tracks for railroad or railway use, and
17

18 to fix the terms, conditions, rents, and rates of charges for such
18

19 use.
19

20  C. Such tolls, subject to the other restrictions hereof, shall

20

21 be so fixed and adjusted in respect of the aggregate of tolls from
21

22 the turnpike project or projects in connection with which the bonds
22

23 of any issue shall have been issued as to provide a fund sufficient
23

24 with other revenues, if any, to pay (a) the cost of maintaining,

 1 repairing, and operating such turnpike project or projects, and (b)
 1

 2 the principal of and the interest of such bonds as the same shall
 2

 3 become due and payable, and to create reserves for such purposes.
 3

 4 The tolls and all other revenues derived from the turnpike project
 4

 5 or projects in connection with which the bonds of any issue shall
 5

 6 have been issued, except such part thereof as may be necessary to
 6

 7 pay such cost of maintenance, repair, and operation and to provide
 7

 8 such reserves therefor as may be provided for in the resolution
 8

 9 authorizing the issuance of such bonds or in the trust agreement
 9

10 securing the same shall be set aside at such regular intervals as
10

11 may be provided in such resolution or such trust agreement in a
11

12 sinking fund which is hereby pledged to, and charged with, the
12

13 payment of (a) the interest upon such bonds as such interest shall
13

14 fall due, (b) the principal of such bonds as the same shall fall
14

15 due, (c) the necessary charges of paying agents for paying principal
15

16 and interest, and (d) the redemption price or the purchase price of
16

17 bonds retired by call or purchase as therein provided, which are a
17

18 charge against such fund. The use and disposition of monies to the
18

19 credit of such sinking fund shall be subject to the provisions of
19

20 the resolution authorizing the issuance of such bonds or of such
20

21 trust agreement. Except as may otherwise be provided in such
21

22 resolution or such trust agreement, such sinking fund shall be a
22

23 fund for all such bonds without distinction or priority of one over
23

24 another. The monies in the sinking fund, less such reserve as may

1 be provided in such resolution or trust agreement, if not used

2 within a reasonable time for the purchase of bonds for cancellation
2

3 as above provided, shall be applied to the redemption of bonds at
3

4 the redemption price then applicable.
4

5   D. Any person who leases, rents, or acquires control of any gas

5

6 station, garage, store, hotel, or restaurant must have been a
6

7 resident of, or been doing business in, Oklahoma for the past five
7

8 (5) years.
8

9   E. Notwithstanding anything else herein contained to the

9

10 contrary, the Corporation Commission of the State of Oklahoma shall
10

11 exercise the jurisdiction now or hereafter vested in it to regulate
11

12 and control the operation of motor carriers of passengers and
12

13 freight, using or desiring to use any turnpike project, in the
13

14 manner and to the extent that it regulates or controls such carriers
14

15 using the highways of the state.
15

16  F. The Authority shall not discriminate against any group or

16

17 class or individual member thereof in fixing the amount of toll,
17

18 rents, or charge for the use of the turnpike project.
18

19  G. The Authority shall promulgate any rules necessary to

19

20 implement the provisions of this section.
20

21  SECTION 2. This act shall become effective July 1, 2026.

21

22  SECTION 3. It being immediately necessary for the preservation

22

23 of the public peace, health or safety, an emergency is hereby
23

24

1 declared to exist, by reason whereof this act shall take effect and
1

2 be in full force from and after its passage and approval.
