7 An Act relating to long-term care; requiring assisted
7 living centers to conspicuously post certain assisted
8 living center bill of rights; enumerating certain
8 rights; providing for codification; and providing an
9 effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 1-896 of Title 63, unless there
14
15 is created a duplication in numbering, reads as follows:
15
16 A. Each assisted living center shall post an assisted living
16
17 center bill of rights as described in subsection B of this section
17
18 in a prominent place in the center.
18
19 B. The assisted living center bill of rights shall provide that
19
20 an assisted living center, or its staff as applicable, has the right
20
21 to:
21
22 1. Be shown consideration and respect that recognizes the
22
23 dignity and individuality of staff members and the facility;

1 2. Terminate a resident's contract for just cause as provided
1
2 by rules promulgated under the Continuum of Care and Assisted Living
2
3 Act after a written thirty-day notice;
3
4 3. Terminate a resident's contract immediately, if the assisted
4
5 living center finds that termination is necessary due to the
5
6 resident's immediate health needs or necessary for the physical
6
7 safety of the resident or other residents;
7
8 4. Present grievances, file complaints, or provide information
8
9 to state agencies or other persons without threat of reprisal or
9
10 retaliation;

11 5. Refuse to perform services for the resident or the
11
12 resident's family other than those contracted for by the resident
12
13 and the assisted living center;
13
14 6. Contract with service providers or organizations in the
14
15 community to achieve the highest level of independence, autonomy,
15
16 interaction, and services to residents;
16
17 7. Access, obtain, or request any relevant information or
17
18 records of a consumer referred to the assisted living center to
18
19 assess for appropriate placement, which shall remain confidential as
19
20 provided by law;
20
21 8. Refuse a consumer referred to the assisted living center if
21
22 the referral is inappropriate;

23 9. Refuse to provide any information to third-party providers;
23
24 10. Maintain an environment free of weapons and drugs;

1 11. Be made aware of a resident's history, including self-
1
2 abuse, violent behavior, alcoholism, or drug abuse; and
2
3 12. Be made aware if a resident has contracted, arranged, or is
3
4 being provided with a companion caregiver or any other provider of
4
5 personal services in the resident's personal apartment.
5
6 SECTION 2. This act shall become effective November 1, 2026.
