7 An Act relating to the state Medicaid program;
7 creating the Healthy Moms, Healthy Babies Act;
8 providing short title; requiring coverage and
8 reimbursement of specified services; requiring
9 certain reimbursement methodology; describing covered
9 services; providing certain coverage conditions;
10 requiring the Oklahoma Health Care Authority to seek
10 certain federal authority; directing promulgation of
11 rules; providing for codification; and providing an
11 effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. NEW LAW A new section of law to be codified
15
16 in the Oklahoma Statutes as Section 5029.2 of Title 63, unless there
16
17 is created a duplication in numbering, reads as follows:
17
18 A. This section shall be known and may be cited as the "Healthy
18
19 Moms, Healthy Babies Act".
19
20 B. The state Medicaid program shall provide coverage and
20
21 reimbursement for depression screening of a pregnant woman.
21
22 C. 1. The state Medicaid program shall provide coverage and
22
23 reimbursement for prenatal, delivery, and postpartum services. Such
23
24 services shall be reimbursed separately and shall not be reimbursed

1 through a global payment or an all-inclusive payment methodology for
1
2 maternity services.

3 2. Prenatal, delivery, and postpartum services shall include,
3
4 but not be limited to:
4
5 a. office visits,
5
6 b. laboratory fees,
6
7 c. physician-ordered testing,
7
8 d. blood work,
8
9 e. remote monitoring,
9
10 f. fetal nonstress tests, and
10
11 g. continuous glucose monitors or other services for
11
12 gestational diabetes when medically necessary.
12
13 D. The state Medicaid program shall make presumptive
13
14 eligibility determinations for pregnant women who are applying for
14
15 the program to improve access to prenatal care and allow prenatal
15
16 care to be delivered immediately while waiting for a full
16
17 application to be processed.

18 E. 1. The state Medicaid program shall provide coverage and
18
19 reimbursement for self-measurement blood pressure monitoring
19
20 services for pregnant women and postpartum women.

21 2. Self-measurement blood pressure monitoring services shall
21
22 include:
22
23 a. validated blood pressure monitoring devices, such as a
23
24 blood pressure cuff and replacement cuffs, as

1 medically necessary, to diagnose or treat

2 hypertension,
2
3 b. patient education and training on the setup and use of
3
4 a self-measurement blood pressure measurement device
4
5 that is validated for clinical accuracy, device
5
6 calibration, and the procedure for obtaining self-
6
7 measurement readings, and
7
8 c. collection of data reports by the patient or caregiver
8
9 for submission to a health care provider to
9
10 communicate blood pressure readings and create or
10
11 modify treatment plans.

12 F. 1. The state Medicaid program shall provide coverage and
12
13 reimbursement for medically necessary remote ultrasound procedures
13
14 utilizing established Current Procedural Terminology codes for
14
15 remote ultrasound procedures when the patient is in a residence or
15
16 other off-site location from the health care provider of the patient
16
17 and the same standard of care is met.

18 2. A remote ultrasound procedure shall be reimbursable when the
18
19 health care provider uses digital technology that:
19
20 a. collects medical and other forms of health data from a
20
21 patient and electronically transmits the information
21
22 securely to a health care provider in a different
22
23 location for interpretation and recommendation,

1 b. is compliant with the Health Insurance Portability and
1
2 Accountability Act of 1996, 42 U.S.C., Section 1320d
2
3 et seq., and
3
4 c. is approved by the United States Food and Drug
4
5 Administration.

6 G. The state Medicaid program shall provide coverage and
6
7 reimbursement for doulas and community health workers for home
7
8 visitation related to prenatal care and postpartum care.
8
9 H. 1. The Oklahoma Health Care Authority shall apply for any
9
10 federal waiver, Medicaid state plan amendments, or other authority
10
11 necessary to implement this section.
11
12 2. The Oklahoma Health Care Authority Board shall promulgate
12
13 rules to implement this section.
13
14 SECTION 2. This act shall become effective November 1, 2026.
