7   An Act relating to counties; defining term; requiring

7   certain notification to board of county

8   commissioners; requiring publication of certain

8   notice; requiring certain public meetings; providing

9   for certain meeting of board of county commissioners;

9   requiring certain vote take place after certain

10  comment period; providing for codification; and

10  declaring an emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14  SECTION 1.      NEW LAW  A new section of law to be codified

14

15 in the Oklahoma Statutes as Section 865.71 of Title 19, unless there
15

16 is created a duplication in numbering, reads as follows:
16

17  A. As used in this section, "data center" means any facility

17

18 that primarily contains electronic equipment used to process, store,
18

19 and transmit digital information and uses environmental control
19

20 equipment to maintain the proper conditions for the operation of
20

21 electronic equipment.

22  B. On and after the effective date of this act, any individual

22

23 or company intending to construct a data center in unincorporated
23

24 county land of this state shall:

1   1. Notify the board of county commissioners of the county where

2 such data center is intended to be located by the submission of a
2

3 notice of intent, which shall be read aloud and entered into the
3

4 minutes of the next meeting of the board. Such notice shall clearly
4

5 state the name of the individual or company intending to construct a
5

6 data center, the proposed location within the county, and plans
6

7 relating to such data center. A copy of such notice shall be
7

8 published by such individual or company in a newspaper of general
8

9 circulation within the county weekly for at least three (3)
9

10 consecutive weeks following the reading of such notice; and

11  2. In coordination with the board of county commissioners,

11

12 schedule at least three public meetings, with at least two (2) weeks
12

13 between each meeting, to take place at a convenient location within
13

14 the county near the location where the individual or company intends
14

15 to construct a data center. Notice of such meetings shall be
15

16 published by such individual or company in a newspaper of general
16

17 circulation within the county daily for at least two (2) days
17

18 preceding such meeting. At such meetings, such individual or
18

19 company shall present the plans relating to such data center and
19

20 answer any questions from the board of county commissioners or
20

21 members of the public who attend such meeting.

22  C. The board of county commissioners, after certifying that the

22

23 provisions of subsection B of this section have been followed, shall
23

24 schedule a meeting to approve or disapprove the construction of a

1 data center. Notice for such meeting shall be given by publication
1

2 in a newspaper of general circulation within the county for at least
2

3 three (3) consecutive weeks preceding the meeting. Such meeting
3

4 shall allow for the individual or company intending to construct the
4

5 data center to present the plans relating to such data center and
5

6 any additional information requested by the board of county
6

7 commissioners, as well as allow for public comment from members of
7

8 the public who attend such meeting. Such presentation and public
8

9 comment shall happen prior to the vote to approve or disapprove the
9

10 construction of a data center. No vote shall take place until all
10

11 members of the public who wish to comment have had the chance to
11

12 express such comment.

13  SECTION 2. It being immediately necessary for the preservation

13

14 of the public peace, health or safety, an emergency is hereby
14

15 declared to exist, by reason whereof this act shall take effect and
15

16 be in full force from and after its passage and approval.
