9 An Act relating to crimes and punishments; creating
9 the Railroad Safety Act; providing short title;
10 defining terms; prohibiting certain activities;
10 stating penalty for violations; providing for
11 codification; and declaring an emergency.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16 SECTION 1. NEW LAW A new section of law to be codified
16
17 in the Oklahoma Statutes as Section 1907 of Title 21, unless there
17
18 is created a duplication in numbering, reads as follows:
18
19 A. This act shall be known and may be cited as the "Railroad
19
20 Safety Act".
20
21 B. As used in this act:
21
22 1. "Deadly or dangerous weapon" includes all weapons listed in
22
23 Section 1287 of Title 21 of the Oklahoma Statutes, and any other
23
24 weapon capable of inflicting serious bodily injury, except for a

1 weapon carried for lawful self-defense as provided in the Oklahoma
1
2 Self-Defense Act;

3 2. "Passenger" means any person served by the railroad company;
3
4 3. "Railroad company" means any individuals, businesses, or
4
5 governmental entities providing transport to passengers or cargo by
5
6 train;
6
7 4. "Station" means a train station, stop, platform, or depot or
7
8 any facility operated, leased by, or operated on behalf of a
8
9 railroad company. This term shall include the parking lots or
9
10 parking areas adjacent to a station and a reasonable area
10
11 immediately adjacent to the rails on which a train operated by a
11
12 railroad company is currently traveling or any designated stop along
12
13 the route traveled by a train operated by a railroad company; and
13
14 5. "Train" means a steam engine, diesel, electric, or other
14
15 motor, with or without cars coupled with such engine, operated upon
15
16 rails.

17 C. 1. No person shall by force or violence, or threat of force
17
18 or violence, seize or exercise control of any train. Any person
18
19 violating this subsection shall, upon conviction, be guilty of a
19
20 Class B1 felony offense punishable by a fine not more than Twenty
20
21 Thousand Dollars ($20,000.00), or by imprisonment in the custody of
21
22 the Department of Corrections for not more than twenty (20) years,
22
23 or by both such fine and imprisonment.

1 2. No person shall intimidate, threaten, assault, or batter any
1
2 engineer, conductor, attendant, guard, or passenger of any train
2
3 with intent to violate paragraph 1 of this subsection. Any person
3
4 violating this paragraph shall, upon conviction, be guilty of a
4
5 Class B4 felony offense punishable by a fine not more than Five
5
6 Thousand Dollars ($5,000.00), or by imprisonment in the custody of
6
7 the Department of Corrections for not more than ten (10) years, or
7
8 by both such fine and imprisonment.

9 3. Any person violating paragraphs 1 and 2 of this subsection
9
10 using a dangerous or deadly weapon shall, upon conviction, be guilty
10
11 of a Class B1 felony offense punishable by a fine not more than
11
12 Twenty Thousand Dollars ($20,000.00), or by imprisonment in the
12
13 custody of the Department of Corrections for not more than twenty
13
14 (20) years, or by both such fine and imprisonment.

15 4. It shall be unlawful for any person to discharge any firearm
15
16 into or within any train, station, or other transportation facility,
16
17 unless such action is determined to have been in defensive force
17
18 resulting from reasonable fear of imminent peril of death or great
18
19 bodily harm to oneself or another. Such person shall, upon
19
20 conviction, be guilty of a Class B4 felony offense punishable by a
20
21 fine not more than Five Thousand Dollars ($5,000.00), or by
21
22 imprisonment in the custody of the Department of Corrections for not
22
23 more than five (5) years, or by both such fine and imprisonment.

1 SECTION 2. It being immediately necessary for the preservation
1
2 of the public peace, health or safety, an emergency is hereby
2
3 declared to exist, by reason whereof this act shall take effect and
3
4 be in full force from and after its passage and approval.
