10 the Oklahoma Firefighters Pension and Retirement
10 System; modifying definitions; increasing computation
11 of certain benefits; providing for effective dates of
11 certain increase; updating statutory language;
12 updating statutory reference; amending 62 O.S. 2021,
12 Section 3103, as last amended by Section 1, Chapter

17 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
17
18 SECTION 1. AMENDATORY 11 O.S. 2021, Section 49-100.1, as
18
19 last amended by Section 1, Chapter 142, O.S.L. 2025 (11 O.S. Supp.
19
20 2025, Section 49-100.1), is amended to read as follows:
20
21 Section 49-100.1. As used in this article:
21
22 1. "System" means the Oklahoma Firefighters Pension and
22
23 Retirement System and all predecessor municipal firefighters pension
23
24 and retirement systems;

1 2. "Article" means Article 49 of this title;

2 3. "State Board" means the Oklahoma Firefighters Pension and
2
3 Retirement Board;

4 4. "Local board" means the local firefighters pension and
4
5 retirement boards;
5
6 5. "Fund" means the Oklahoma Firefighters Pension and
6
7 Retirement Fund;
7
8 6. "Member" means all eligible firefighters of a participating
8
9 municipality or a fire protection district who perform the essential
9
10 functions of fire suppression, prevention, and life safety duties in
10
11 a fire department. The term "member" member shall include, but not
11
12 be limited to, the person serving as fire chief of any participating
12
13 municipality, provided that a person serving as fire chief of a
13
14 participating municipality shall meet the age, agility, physical,
14
15 and other eligibility requirements required by law at the time said
15
16 such person becomes a member of the System. Effective July 1, 1987,
16
17 a member does not include a "leased employee" leased employee. The
17
18 term "leased employee" means any person (other, other than an
18
19 employee of the recipient) recipient, who pursuant to an agreement
19
20 between the recipient and any other person ("leasing organization"),
20
21 referred to as a leasing organization, has performed services for
21
22 the recipient (or or for the recipient and related persons
22
23 determined in accordance with Section 414(n)(6) of the Internal
23
24 Revenue Code of 1986, as amended) amended, on a substantially full-

1 time basis for a period of at least one (1) year, and such services
1
2 are performed under primary direction or control by the recipient.
2
3 Contributions or benefits provided to a leased employee by the
3
4 leasing organization which are attributable to services performed
4
5 for the recipient employer shall be treated as provided by the
5
6 recipient employer. A leased employee shall not be considered an
6
7 employee of the recipient if the requirements of the safe harbor
7
8 provisions of Section 414(n)(5) of the Internal Revenue Code of
8
9 1986, as amended, are satisfied. Effective July 1, 1999, any
9
10 individual who agrees with the participating municipality that the
10
11 individual's services are to be performed as a leased employee or an
11
12 independent contractor shall not be a member regardless of any
12
13 classification as a common law employee by the Internal Revenue
13
14 Service or any other governmental agency, or any court of competent
14
15 jurisdiction;
15
16 7. "Normal retirement date" means the date at which the member
16
17 is eligible to receive the unreduced payments of the member's
17
18 accrued retirement benefit. Such date shall be the first day
18
19 following the date the member completes twenty (20) years of
19
20 credited service. If the member's employment continues past the
20
21 normal retirement date of the member, the actual retirement date of
21
22 the member shall be the first day following the date the member
22
23 terminates employment with more than twenty (20) years of credited
23
24 service;

1 8. "Credited service" means the period of service used to
1
2 determine the eligibility for and the amount of benefits payable to
2
3 a member. Credited service shall consist of the period during which
3
4 the member participated in the System or the predecessor municipal
4
5 systems as an active employee in an eligible membership
5
6 classification, plus any service prior to the establishment of the
6
7 predecessor municipal systems which was credited under the
7
8 predecessor municipal systems; provided, however, "credited service"
8
9 credited service for members from a fire protection district shall
9
10 not begin accruing before July 1, 1982;
10
11 9. "Participating municipality" means a municipality, county
11
12 fire department organized pursuant to subsection D of Section 351 of
12
13 Title 19 of the Oklahoma Statutes, or fire protection district which
13
14 is making contributions to the System on behalf of its firefighters.
14
15 All participating municipalities shall appoint a fire chief who
15
16 shall supervise and administer the fire department;
16
17 10. "Disability" means the complete inability of the
17
18 firefighter to perform any and every duty of the firefighter's
18
19 regular occupation; provided further, that once benefits have been
19
20 paid for twenty-four (24) months the provisions of Section 49-110 of
20
21 this title shall apply to the firefighter;
21
22 11. "Executive Director" means the managing officer of the
22
23 System employed by the State Board;

1 12. "Eligible employer" means any municipality with a municipal
1
2 fire department, any county fire department organized pursuant to
2
3 subsection D of Section 351 of Title 19 of the Oklahoma Statutes, or
3
4 any fire protection district with an organized fire department;
4
5 13. "Entry date" means the date as of which an eligible
5
6 employer joins the System. The first entry date pursuant to this
6
7 article shall be January 1, 1981;
7
8 14. "Final average salary" means the average paid gross salary
8
9 of the firefighter for normally scheduled hours over the highest
9
10 salaried thirty (30) consecutive months of the last sixty (60)
10
11 months of credited service. Gross salary shall not include payment
11
12 for accumulated sick or annual leave upon termination of employment,
12
13 any uniform allowances, or any other compensation for reimbursement
13
14 of out-of-pocket expenses. Only salary on which the required
14
15 contributions have been made may be used in computing the final
15
16 average salary. Effective January 1, 1988, gross salary shall
16
17 include any amount of elective salary reduction under Section 125 of
17
18 the Internal Revenue Code of 1986, as amended. Gross salary shall
18
19 include any amount of elective salary reduction under Section 457 of
19
20 the Internal Revenue Code of 1986, as amended, and any amount of
20
21 nonelective salary reduction under Section 414(h) of the Internal
21
22 Revenue Code of 1986, as amended. Effective July 1, 1998, for
22
23 purposes of determining a member's compensation, any contribution by
23
24 the member to reduce the member's regular cash remuneration under

1 Section 132(f)(4) of the Internal Revenue Code of 1986, as amended,
1
2 shall be treated as if the member did not make such an election.
2
3 Only salary on which required contributions have been made may be
3
4 used in computing final average salary.
4
5 In addition to other applicable limitations, and notwithstanding
5
6 any other provision to the contrary, for plan years beginning on or
6
7 after July 1, 2002, the annual gross salary of each "Noneligible
7
8 Member" Noneligible Member taken into account under the System shall
8
9 not exceed the Economic Growth and Tax Relief Reconciliation Act of
9
10 2001 ("EGTRRA") annual salary limit. The EGTRRA annual salary limit
10
11 is Two Hundred Thousand Dollars ($200,000.00), as adjusted by the
11
12 Commissioner United States Secretary of the Treasury for increases
12
13 in the cost of living in accordance with Section 401(a)(17)(B) of
13
14 the Internal Revenue Code of 1986, as amended. The annual salary
14
15 limit in effect for a calendar year applies to any period, not
15
16 exceeding twelve (12) months a twelve-month determination period,
16
17 over which salary is determined ("determination period") beginning
17
18 in such calendar year. If a determination period consists of fewer
18
19 than twelve (12) months, the EGTRRA salary limit will be multiplied
19
20 by a fraction, the numerator of which is the number of months in the
20
21 determination period, and the denominator of which is twelve (12).
21
22 For purposes of this subsection, a "Noneligible Member" is any
22
23 member who first became a member during a plan year commencing on or
23
24 after July 1, 1996.

1 For plan years beginning on or after July 1, 2002, any reference
1
2 to the annual salary limit under Section 401(a)(17) of the Internal
2
3 Revenue Code of 1986, as amended, shall mean the EGTRRA salary limit
3
4 set forth in this subsection.
4
5 Effective June 9, 2010, gross salary shall also include gross
5
6 salary, as described above provided in this paragraph, for services,
6
7 but paid by the later of two and one-half (2 1/2) months after a
7
8 firefighter's severance from employment or the end of the calendar
8
9 year that includes the date the firefighter terminated employment,
9
10 if it is a payment that, absent a severance from employment, would
10
11 have been paid to the firefighter while the firefighter continued in
11
12 employment with the participating municipality.
12
13 Effective June 9, 2010, any payments not described above
13
14 provided for in this paragraph shall not be considered gross salary
14
15 if paid after severance from employment, even if they are paid by
15
16 the later of two and one-half (2 1/2) months after the date of
16
17 severance from employment or the end of the calendar year that
17
18 includes the date of severance from employment, except payments to
18
19 an individual who does not currently perform services for the
19
20 participating municipality by reason of qualified military service
20
21 within the meaning of Section 414(u)(5) of the Internal Revenue Code
21
22 of 1986, as amended, to the extent these payments do not exceed the
22
23 amounts the individual would have received if the individual had
23
24

1 continued to perform services for the participating municipality
1
2 rather than entering qualified military service.
2
3 Effective June 9, 2010, back pay, within the meaning of Section
3
4 1.415(c)-2(g)(8) of the Income Tax Regulations, shall be treated as
4
5 gross salary for the year to which the back pay relates to the
5
6 extent the back pay represents wages and compensation that would
6
7 otherwise be included in this definition.
7
8 Effective for years beginning after December 31, 2008, gross
8
9 salary shall also include differential wage payments under Section
9
10 414(u)(12) of the Internal Revenue Code of 1986, as amended;
10
11 15. "Accrued retirement benefit" means, for benefits computed
11
12 prior to the effective date of this act, two and one-half percent (2
12
13 1/2%) of the firefighter's final average salary multiplied by the
13
14 member's years of credited service not to exceed thirty (30) years.
14
15 For a member who entered the System on or after November 1,
15
16 2013, and who retires on or after the effective date of this act,
16
17 accrued retirement benefits shall mean:
17
18 a. for such member who retires and terminates employment
18
19 at least one (1) year after the effective date of this
19
20 act and has at least twenty-five (25) years of
20
21 credited service, three percent (3%) of the member's
21
22 final average salary multiplied by the member's years
22
23 of credited service, not to exceed thirty (30) years,
23

1 b. for such member who retires and terminates employment
1
2 at least two (2) years after the effective date of
2
3 this act and has at least twenty (20) years of
3
4 credited service, three percent (3%) of the member's
4
5 final average salary multiplied by the member's years
5
6 of credited service, not to exceed thirty (30) years,
6
7 c. for such member who retires and terminates employment
7
8 at least five (5) years after the effective date of
8
9 this act, three percent (3%) of the member's final
9
10 average salary multiplied by the member's years of
10
11 credited service, not to exceed thirty (30) years, and
11
12 d. for such member who retires and terminates employment
12
13 on or after the effective date of this act, but does
13
14 not have the minimum years of credited service to
14
15 qualify for the benefit outlined in subparagraphs a
15
16 and b of this paragraph, or retires and terminates
16
17 employment prior to the date outlined in subparagraph
17
18 c of this paragraph, two and one-half percent (2 1/2%)
18
19 of the member's final average salary multiplied by the
19
20 member's years of credited service, not to exceed
20
21 thirty (30) years;
21
22 16. "Beneficiary" means a member's surviving spouse or any
22
23 surviving children, including biological and adopted children, at
23
24 the time of the member's death. The surviving spouse must have been

1 married to the firefighter for the thirty (30) continuous months
1
2 preceding the firefighter's death; provided, a surviving spouse of a
2
3 member who died while in, or as a consequence of, the performance of
3
4 the member's duty for a participating municipality, shall not be
4
5 subject to the marriage limitation for survivor benefits. A
5
6 surviving child of a member shall be a beneficiary until reaching
6
7 eighteen (18) years of age or twenty-two (22) years of age if the
7
8 child is enrolled full time full-time and regularly attending a
8
9 public or private school or any institution of higher education.
9
10 Any child adopted by a member after the member's retirement shall be
10
11 a beneficiary only if the child is adopted by the member for the
11
12 thirty (30) continuous months preceding the member's death. Any
12
13 child who is adopted by a member after the member's retirement and
13
14 such member dies accidentally or as a consequence of the performance
14
15 of the member's duty as a firefighter shall not be subject to the
15
16 thirty-month adoption requirement. This definition of beneficiary
16
17 shall be in addition to any other requirement set forth in this
17
18 article;
18
19 17. "Contributions" means payments remitted to the System
19
20 pursuant to Section 49-122 or subsection A of Section 49-138 of this
20
21 title. Contributions shall not include payments made to repurchase
21
22 credited service pursuant to Section 49-117.1 of this title,
22
23 payments made to transfer credited service from another retirement
23
24 system pursuant to subsection A of Section 49-117.2 or Section 49-
24

1 117.3 of this title, or payments made to purchase prior military
1
2 service credit pursuant to subsection E of Section 49-138 of this
2
3 title;
3
4 18. "Accumulated contributions" means the sum of all
4
5 contributions made by a member to the System and includes both
5
6 contributions deducted from the compensation of a member and
6
7 contributions of a member picked up and paid by the participating
7
8 municipality of the member. Accumulated contributions shall not
8
9 include any interest on the contributions of the member, interest on
9
10 any amount contributed by the municipality or state, and any amount
10
11 contributed by the municipality or state; and
11
12 19. "Limitation year" means the year used in applying the
12
13 limitations of Section 415 of the Internal Revenue Code of 1986, as
13
14 amended, which year shall be the calendar year.
14
15 SECTION 2. AMENDATORY 11 O.S. 2021, Section 49-109, as
15
16 amended by Section 4, Chapter 151, O.S.L. 2023 (11 O.S. Supp. 2025,
16
17 Section 49-109), is amended to read as follows:
17
18 Section 49-109. A. 1. Whenever any firefighter serving in any
18
19 capacity in a regularly constituted fire department of a
19
20 municipality shall become so physically or mentally disabled while
20
21 in, or in consequence of, the performance of the firefighter's duty
21
22 as to prevent the effective performance of the firefighter's duties,
22
23 the State Oklahoma Firefighters Pension and Retirement Board may,
23
24 upon the firefighter's written request, or without such request if
24

1 the State Board deems it for the good of the department, retire the
1
2 firefighter from active service, and if so retired, shall direct
2
3 that the firefighter be paid from the Oklahoma Firefighters Pension
3
4 and Retirement System a monthly pension equal to, for benefits
4
5 computed prior to the effective date of this act, the greater of:
5
6 1. Fifty
6
7 a. fifty percent (50%) of the average monthly salary
7
8 which was paid to the firefighter during the last
8
9 thirty (30) months of the firefighter's service;, or
9
10 2. Two
10
11 b. two and one-half percent (2 1/2%) of the firefighter's
11
12 final average salary multiplied by the member's years
12
13 of credited service, not to exceed thirty (30) years,
13
14 provided such firefighter has completed twenty (20) or
14
15 more years of credited service.
15
16 2. For a member who entered the System on or after November 1,
16
17 2013, benefits computed on or after the effective date of this act,
17
18 the greater of:
18
19 a. three percent (3%) of the member's final average
19
20 salary multiplied by twenty (20) years,
20
21 notwithstanding the years of actual credited service,
21
22 or
22
23 b. three percent (3%) of the member's final average
23
24 salary multiplied by the years of credited service of
24

1 the member, not to exceed thirty (30) years, if the
1
2 officer has more than twenty (20) years of credited
2
3 service.
3
4 B. If the disability ceases within two (2) years from the date
4
5 of the firefighter's disability retirement and before the
5
6 firefighter's normal retirement date, the formerly disabled person
6
7 shall be restored to active service at the salary attached to the
7
8 rank the firefighter held at the time of the firefighter's
8
9 disability retirement provided the firefighter is capable of
9
10 performing the duties of a firefighter. Whenever such disability
10
11 shall cease, such disability pension provided pursuant to paragraph
11
12 1 or 2 of subsection A of this section shall cease. If a
12
13 firefighter participates in the Oklahoma Firefighters Deferred
13
14 Option Plan pursuant to Section 49-106.1 of this title, the
14
15 firefighter's disability pension provided pursuant to this
15
16 subsection shall be reduced to account for the firefighter's
16
17 participation in the Oklahoma Firefighters Deferred Option Plan.
17
18 C. Whenever any firefighter, who has served in any capacity in
18
19 a regularly constituted fire department of a municipality of the
19
20 state, and who has served less than the firefighter's normal
20
21 retirement date, shall become so physically or mentally disabled
21
22 from causes not arising in the line of duty as to prevent the
22
23 effective performance of the firefighter's duties, the firefighter
23
24 shall be entitled to a pension during the continuance of such

1 disability based upon the firefighter's service period, which shall
1
2 be fifty percent (50%) of the average monthly salary which was paid
2
3 to the firefighter during the last sixty (60) months of the
3
4 firefighter's service.
4
5 D. No firefighter shall accrue additional service time while
5
6 receiving a disability pension; provided further, that nothing
6
7 herein contained shall affect the eligibility of any firefighter to
7
8 apply for and receive a retirement pension after the firefighter's
8
9 normal retirement date; provided further, that no firefighter shall
9
10 receive retirement benefits from the System during the time the
10
11 firefighter is receiving disability benefits from the System. Any
11
12 member or beneficiary eligible to receive a monthly benefit pursuant
12
13 to this section may make an election to waive all or a portion of
13
14 monthly benefits.
14
15 E. If the requirements of Section 49-106.5 of this title are
15
16 satisfied, a member who, by reason of disability, is separated from
16
17 service as a public safety officer with the member's participating
17
18 municipality, may elect to have payment made directly to the
18
19 provider for qualified health insurance premiums by deduction from
19
20 his or her monthly disability benefit, after December 31, 2006, in
20
21 accordance with Section 402(l) of the Internal Revenue Code of 1986,
21
22 as amended. For distributions made after December 29, 2022, the
22
23 election provided for under Section 402(l) of the Internal Revenue
23
24 Code of 1986, as amended, may be made whether payment of the

1 premiums is made directly to the provider of the accident or health
1
2 plan or qualified long-term care insurance contract by deduction
2
3 from a distribution from the System or is made to the member.
3
4 SECTION 3. AMENDATORY 62 O.S. 2021, Section 3103, as
4
5 last amended by Section 1, Chapter 357, O.S.L. 2024 (62 O.S. Supp.
5
6 2025, Section 3103), is amended to read as follows:
6
7 Section 3103. As used in the Oklahoma Pension Legislation
7
8 Actuarial Analysis Act:
8
9 1. "Amendment" means any amendment, including a substitute
9
10 bill, made to a retirement bill by any committee of the House or
10
11 Senate, any conference committee of the House or Senate, or by the
11
12 House or Senate;
12
13 2. "RB number" means that number preceded by the letters "RB"
13
14 assigned to a retirement bill by the respective staffs of the
14
15 Oklahoma State Senate and the Oklahoma House of Representatives when
15
16 the respective staff office prepares a retirement bill for a member
16
17 of the Legislature;
17
18 3. "Legislative Actuary" means the firm or entity that enters
18
19 into a contract with the Legislative Service Bureau pursuant to
19
20 Section 452.15 of Title 74 of the Oklahoma Statutes to provide the
20
21 actuarial services and other duties provided for in the Oklahoma
21
22 Pension Legislation Actuarial Analysis Act;
22
23 4. "Nonfiscal amendment" means an amendment to a retirement
23
24 bill having a fiscal impact, which amendment does not change any

1 factor of an actuarial investigation specified in subsection A of
1
2 Section 3109 of this title;
2
3 5. "Nonfiscal retirement bill" means a retirement bill:
3
4 a. which does not affect the cost or funding factors of a
4
5 retirement system,
5
6 b. which affects such factors only in a manner which does
6
7 not:
7
8 (1) grant a benefit increase under the retirement
8
9 system affected by the bill,
9
10 (2) create an actuarial accrued liability for or
10
11 increase the actuarial accrued liability of the
11
12 retirement system affected by the bill, or
12
13 (3) increase the normal cost of the retirement system
13
14 affected by the bill,
14
15 c. which authorizes the purchase by an active member of
15
16 the retirement system, at the actuarial cost for the
16
17 purchase as computed pursuant to the statute in effect
17
18 on the effective date of the measure allowing such
18
19 purchase, of years of service for purposes of reaching
19
20 a normal retirement date in the applicable retirement
20
21 system, but which cannot be used in order to compute
21
22 the number of years of service for purposes of
22
23 computing the retirement benefit for the member,
23
24

1 d. which provides for the computation of a service-
1
2 connected disability retirement benefit for members of
2
3 the Oklahoma Law Enforcement Retirement System
3
4 pursuant to Section 2-305 of Title 47 of the Oklahoma
4
5 Statutes if the members were unable to complete twenty
5
6 (20) years of service as a result of the disability,
6
7 e. which requires membership in the defined benefit plan
7
8 authorized by Section 901 et seq. of Title 74 of the
8
9 Oklahoma Statutes for persons whose first elected or
9
10 appointed service occurs on or after November 1, 2018,
10
11 if such persons had any prior service in the Oklahoma
11
12 Public Employees Retirement System prior to November
12
13 1, 2015,
13
14 f. which provides for a one-time increase in retirement
14
15 benefits if the increase in retirement benefits is not
15
16 a permanent increase in the gross annual retirement
16
17 benefit payable to a member or beneficiary, occurs
17
18 only once pursuant to a single statutory
18
19 authorization, and does not exceed:
19
20 (1) the lesser of two percent (2%) of the gross
20
21 annual retirement benefit of the member or One
21
22 Thousand Dollars ($1,000.00) and requires that
22
23 the benefit may only be provided if the funded
23
24 ratio of the affected retirement system would not
24

1 be less than sixty percent (60%) but not greater
1
2 than eighty percent (80%) after the benefit
2
3 increase is paid,
3
4 (2) the lesser of two percent (2%) of the gross
4
5 annual retirement benefit of the member or One
5
6 Thousand Two Hundred Dollars ($1,200.00) and
6
7 requires that the benefit may only be provided if
7
8 the funded ratio of the affected retirement
8
9 system would be greater than eighty percent (80%)
9
10 but not greater than one hundred percent (100%)
10
11 after the benefit increase is paid,
11
12 (3) the lesser of two percent (2%) of the gross
12
13 annual retirement benefit of the member or One
13
14 Thousand Four Hundred Dollars ($1,400.00) and
14
15 requires that the benefit may only be provided if
15
16 the funded ratio of the affected retirement
16
17 system would be greater than one hundred percent
17
18 (100%) after the benefit increase is paid, or
18
19 (4) the greater of two percent (2%) of the gross
19
20 annual retirement benefit of the volunteer
20
21 firefighter or One Hundred Dollars ($100.00) for
21
22 persons who retired from the Oklahoma
22
23 Firefighters Pension and Retirement System as
23
24 volunteer firefighters and who did not retire
24

3 As used in this subparagraph, "funded ratio" means the

4 figure derived by dividing the actuarial value of

5 assets of the applicable retirement system by the
5
6 actuarial accrued liability of the applicable
6
7 retirement system,

8 g. which modifies the disability pension standard for
8
9 police officers who are members of the Oklahoma Police
9
10 Pension and Retirement System as provided by Section
10
11 50-115 of Title 11 of the Oklahoma Statutes,
11
12 h. which provides a cost-of-living benefit increase
12
13 pursuant to the provisions of:

14 (1) Section 49-143.7 of Title 11 of the Oklahoma
14
15 Statutes,
15
16 (2) Section 50-136.9 of Title 11 of the Oklahoma
16
17 Statutes,
17
18 (3) Section 1104K of Title 20 of the Oklahoma
18
19 Statutes,
19
20 (4) Section 2-305.12 of Title 47 of the Oklahoma
20
21 Statutes,
21
22 (5) Section 17-116.22 of Title 70 of the Oklahoma

23 Statutes, or

3 i. which modifies the computation of the line-of-duty
3
4 disability benefit pursuant to Sections 50-101 and 50-
4
5 115 of Title 11 of the Oklahoma Statutes,
5
6 j. which allows the purchase of military prior service
6
7 credit pursuant to the provisions of this act section
7
8 and Section 49-138 of Title 11 of the Oklahoma
8
9 Statutes,
9
10 k. which increases the computation factor used to
10
11 calculate the accrued retirement benefit and normal
11
12 disability benefit pursuant to Section Sections 49-109
12
13 and 50-101 of Title 11 of the Oklahoma Statutes,
13
14 l. which increases the municipal contribution, employee
14
15 contribution, or both for members of the Oklahoma
15
16 Police Pension and Retirement System pursuant to
16
17 Sections 50-109 and 50-110 of Title 11 of the Oklahoma
17
18 Statutes, or
18
19 m. which modifies the computation of a retirement annuity
19
20 pursuant to Section Sections 49-100.1 and 50-111.1 of
20
21 Title 11 of the Oklahoma Statutes.

22 A nonfiscal retirement bill shall include any retirement bill that
22
23 has as its sole purpose the appropriation or distribution or
23
24 redistribution of monies in some manner to a retirement system for

1 purposes of reducing the unfunded liability of such system or the
1
2 earmarking of a portion of the revenue from a tax to a retirement
2
3 system or increasing the percentage of the revenue earmarked from a
3
4 tax to a retirement system;
4
5 6. "Reduction-in-cost amendment" means an amendment to a
5
6 retirement bill having a fiscal impact which reduces the cost of the
6
7 bill as such cost is determined by the actuarial investigation for
7
8 the bill prepared pursuant to Section 3109 of this title;
8
9 7. "Retirement bill" means any bill or joint resolution
9
10 introduced or any bill or joint resolution amended by a member of
10
11 the Legislature which creates or amends any law directly affecting a
11
12 retirement system. A retirement bill shall not mean a bill or
12
13 resolution that impacts the revenue of any state tax in which a
13
14 portion of the revenue generated from such tax is earmarked for the
14
15 benefit of a retirement system;
15
16 8. "Retirement bill having a fiscal impact" means any
16
17 retirement bill creating or establishing a retirement system and any
17
18 other retirement bill other than a nonfiscal retirement bill; and
18
19 9. "Retirement system" means the Teachers' Retirement System of
19
20 Oklahoma, the Oklahoma Public Employees Retirement System, the
20
21 Uniform Retirement System for Justices and Judges, the Oklahoma
21
22 Firefighters Pension and Retirement System, the Oklahoma Police
22
23 Pension and Retirement System, the Oklahoma Law Enforcement

1 Retirement System, or a retirement system established after January
1
2 1, 2006.

3 SECTION 4. Section 3 of this act shall become effective June 1,
3
4 2026.
4
5 SECTION 5. Sections 1 and 2 of this act shall become effective
5
6 July 1, 2026.

7 SECTION 6. It being immediately necessary for the preservation
7
8 of the public peace, health or safety, an emergency is hereby
8
9 declared to exist, by reason whereof this act shall take effect and
9
10 be in full force from and after its passage and approval.
