7 An Act relating to crimes and punishments; amending
7 21 O.S. 2021, Section 589, which relates to false
8 reporting; modifying elements of misdemeanor offense;
8 creating felony offense; specifying punishments for
9 certain offenses; updating statutory language; and
9 providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 21 O.S. 2021, Section 589, is
13
14 amended to read as follows:
14
15 Section 589. A. It shall be unlawful to willfully, knowingly,
15
16 and without probable cause make a false report to any person of any
16
17 crime or circumstances indicating the possibility of crime having
17
18 been committed, including the unlawful taking of personal property,
18
19 which report causes or encourages the exercise of police action or
19
20 investigation. Any person convicted of violating the provisions of
20
21 this subsection shall be guilty of a misdemeanor punishable by
21
22 imprisonment in the county jail for not more than ninety (90) days
22
23 or by a fine of not more than Five Hundred Dollars ($500.00), or by
23
24 both such fine and imprisonment if the false report accused a person

1 of a misdemeanor. Any person convicted of violating the provisions

2 of this subsection shall be guilty of a felony if the false report
2
3 accused a person of a felony. The punishments for such misdemeanor
3
4 or felony shall be the same as the provisions for such offense of
4
5 the accused crime in the false report.

6 B. It shall be unlawful to willfully, knowingly, and without
6
7 probable cause communicate false information concerning a missing
7
8 child to a law enforcement agency that causes or encourages the
8
9 activation of an AMBER alert warning system. Any person convicted
9
10 of violating the provisions of this subsection shall be guilty of a
10
11 felony punishable by imprisonment in the county jail for not more
11
12 than one (1) year or by a fine of not less than One Thousand Dollars
12
13 ($1,000.00), or by both such fine and imprisonment.

14 SECTION 2. This act shall become effective November 1, 2025.
