7 An Act relating to civil liability; defining term;
7 making vaccine manufacturer liable to individual
8 under certain conditions; establishing deadline for
8 certain civil actions; directing award of certain
9 relief; providing for codification; and providing an
9 effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 113 of Title 76, unless there is
14
15 created a duplication in numbering, reads as follows:

16 A. As used in this section, "advertise" means a media
16
17 communication, including through television, radio, print, the
17
18 Internet, digital or electronic media, product placement, promotion
18
19 by an influencer in exchange for compensation, or other manner of
19
20 paid promotion a vaccine manufacturer purchases to promote the
20
21 manufacturer's vaccine. The term does not include:
21
22 1. Any discussion between a health care provider and the
22
23 provider's patient or written materials a health care provider
23
24 provides to a patient concerning a vaccine; or

1 2. Any posters, decorations, or other materials or promotional

2 items concerning a vaccine that are displayed in or made available
2
3 by a health care facility, health care provider's office, or other
3
4 clinical setting.

5 B. A vaccine manufacturer is liable to an individual if the
5
6 manufacturer advertises a vaccine in this state and the advertised
6
7 vaccine causes harm or injury to the individual.

8 C. Notwithstanding any other law, an individual may bring an
8
9 action under this section not later than the third anniversary of
9
10 the date the cause of action accrues.
10
11 D. A court shall award a claimant who prevails in an action
11
12 brought under this section actual damages, court costs, and
12
13 reasonable attorney fees incurred in bringing the action.
13
14 SECTION 2. This act shall become effective November 1, 2026.
