7 An Act relating to tort liability; defining terms;
7 prohibiting liability of off-road motorcycle entities
8 for injury caused by certain activities; providing
8 certain exceptions; providing for codification; and
9 providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 56 of Title 76, unless there is
14
15 created a duplication in numbering, reads as follows:
15
16 A. As defined in this act:
16
17 1. "Off-road motorcycle" means the same as defined in Section
17
18 1102 of Title 47 of the Oklahoma Statutes;
18
19 2. "Off-road motorcycle area" means a commercial property
19
20 designed to provide recreation or education related to driving an
20
21 off-road motorcycle on unpaved roads or surfaces including, but not
21
22 limited to, driving instruction, practices, competitions, or
22
23 performances, or group driving activities including, but not limited
23
24 to, tours, hunts, or races; and

1 3. "Off-road motorcycle entity" means an individual or entity,

2 including, but not limited to, an employee or volunteer who is:
2
3 a. engaged in the business of owning, operating, or
3
4 leasing an off-road motorcycle area, or
4
5 b. sponsoring, sanctioning, endorsing, or officiating an
5
6 off-road motorcycle area.

7 B. Except as provided in subsection C of this section, an
7
8 owner, employee, participant, member, guest, or customer of an off-
8
9 road motorcycle entity who is acting in good faith and pursuant to
9
10 the standards of the off-road motorcycle industry shall not be
10
11 liable for injuries to any person engaged in off-road motorcycle
11
12 activities when such injuries result from the inherent risks of such
12
13 activities.

14 C. 1. The provisions of this section shall not apply to
14
15 employees in the performance of their duties who are covered by or
15
16 subject to the provisions of the Administrative Workers'
16
17 Compensation Act.

18 2. Nothing in subsection B of this section shall prevent or
18
19 limit the liability of an owner, employee, participant, member, or
19
20 customer, if such person:
20
21 a. commits an act or omission that constitutes willful or
21
22 wanton disregard for the safety of any person engaged
22
23 in off-road motorcycle activities, and that act or
23
24 omission caused the injury, or

1 b. intentionally injures a person engaged in off-road

2 motorcycle activities.

3 SECTION 2. This act shall become effective November 1, 2026.
